TERMS AND CONDITIONS (FO ADVANTAGE CARD) These terms and conditions apply to your FO Advantage Card. You must read them carefully. In these terms and conditions "you" means the named FO Advantage Cardholder and the authorized user of the FO Advantage Card. "We", "us" or "our" means may refer to Forte Oil Plc or First Bank Ltd or Interswitch Ltd each acting in its individual capacity under the agreement. Website means the website at www.forteoilplc.com 1. Your FO Advantage You can use your FO Advantage Card at any location that displays the Verve Card Acceptance Mark, including Forte Oil Service Stations, shops and restaurants. Prior to the use of your FO Advantage Card, the card must be loaded with funds for your purchase and you do not earn interest on any funds loaded on your FO Advantage Card. You will not be able to use your FO Advantage Card after its expiry date. The FO Advantage Prepaid Card is not a credit or debit card and is not in any way connected to your bank account. By using the FO Advantage Card you are automatically agreeing to these terms and conditions. 2. Applying for and activating your FO Advantage Card You can request for the FO Advantage card at any Forte Oil Station or First Bank of Nigeria Ltd (FBN) Branch. To apply for the FO Advantage Card you must be at least 18 years old and resident in Nigeria. We will require proof of identity and residential address prior to the issuance of the FO Advantage card. To activate your card, kindly change your default PIN to your PIN of choice. This can only be done on the First Bank POS terminal available at any Forte Oil Service station or any First Bank ATM Note that only a first time PIN change is allowed on the POS terminal.

3. Loading your FO Advantage Card Funds can be loaded to your FO Advantage Card in a number of ways; www.myvervecard.com 1. Log on to this website using your quickteller login details 2. Select my verve cards option 3. Follow the prompts to transfer funds from your account using your debit card to your FO Advantage (prepaid) card. If you do not have quickteller log in details, you will need to register on the site - www.myvervecard.com. Then follow the same steps. FBN Branches Payment over the counter at any FBN branch will be loaded unto the card. PayDirect Top-up at any bank of your choice by requesting to load funds on your FO Advantage card via the paydirect payment platform The loaded funds will reflect on your card - immediately. Ensure you check your card balance at the ATM after loading to confirm your loaded funds. 4. Using your FO Advantage Card All instructions and details on how to use your FO Advantage Card can be found on our website www.forteoilplc.com and in your welcome pack. You will need to follow these instructions when using your FO Advantage Card. The value of your transactions will be deducted from the funds on your FO Advantage Card as soon as they are made. The FO Advantage Card belongs to Forte Oil Plc and Forte Oil reserves the right upon issuance of due notice by regulation to oblige or decline the issuance, re-issuance, and /or to restrict, suspend or retrieve the cards in its sole discretion, including but not limited to identified grounds relating to the following: Breach of card security and safety of your funds and Card Unauthorized use of the card in a fraudulent manner; Like all payment cards, we cannot guarantee the acceptance of your FO Advantage Card by all retailers. We also retain the right to refuse transactions based on the following; To ensure the security of your FO Advantage Card Prevent the unauthorized or fraudulent use of the FO Advantage Card Insufficient funds on your FO Advantage Card at the time of a transaction to cover the amount of the transaction and any applicable fees

A breach of any terms of this agreement Suspicious or illegal transactions due to errors, failures (whether mechanical or otherwise) or refusals by merchants, payment processors or payment schemes processing transactions. Any refusal to authorize a transaction will be notified to you immediately unless such notification is deemed unlawful under the Law. You may correct any information we hold and which may have caused us to refuse a transaction by contacting the First Bank Customer Service Desk on 0700FIRSTCONTACT (0700-34778-2668228), 01-4485500, 0708-062-5000 or email firstcontact@firstbanknigeria.com for card support enquiries. 5. Authorizing Transactions Subject to the features of your FO Advantage Card, the authorization of a transaction can include approving any single transaction, a series of recurring transactions (including transactions for an indefinite period) or pre-authorizing future transactions of a certain or uncertain amount. A FO Advantage Card transaction will be regarded as authorized by the customer: 1. At the point of sale by following the instructions provided by the merchant or retailer to consummate the transaction, which may include: providing the FO Advantage Card details and/ or providing any other details relating to the card either by physical presentation or provision of such information as requested on payment channels for transaction consummation Inserting the FO Advantage card into a POS terminal and entering your PIN or providing any other security code; signing a sales voucher; swiping the FO Advantage Card over a card reader 2. When the FO Advantage Card is inserted and the PIN entered to request a cash withdrawal at an ATM 3. Authorization for a transaction cannot be withdrawn (or revoked) by you after the transaction value has been received. 6. Cancellation and expiry of your FO Advantage Card This agreement will remain valid during the duration of validity of your FO Advantage card and 12 months after its expiration except otherwise restricted by regulations. Your FO Advantage card will be replaced upon your request 21 days prior to its expiry, with a further validity of 36 months,, provided you have used your FO Advantage Card within the last 3 months to its expiration and can be picked up at a Forte Oil Station or First Bank branch where the request was made.

All replaced FO Advantage Cards are automatically valid for an additional period of 36 months. All cards are issued at a fee. Please see section 12 for a summary of applicable fees. This agreement will be cancelled for any of the reasons below Expiration of the Card with no prior notice to renew this Agreement; Breach of an important part of this agreement, or repeated breach of the agreement and failure to resolve the matter in a timely manner; In the event of the death of the cardholder and upon notification of same to Forte Oil Plc or FBN. This agreement or FO Advantage card and/or account may be suspended immediately if your FO Advantage Card is deliberately being used to commit fraud or for any other illegal purposes. Your FO Advantage Card will be immediately blocked so it cannot be used. You will not be entitled to a refund of money you have already spent on transactions authorized or pending or any fees for use of the FO Advantage Card before the FO Advantage Card is cancelled or expires. You can cancel your FO Advantage Card by sending an email to us at firstcontact@firstbanknigeria.com and upon confirmation that you have destroyed your FO Advantage Card. 7. Keeping your FO Advantage Card secure If your card is lost or stolen, you may lose some or all of your money on your FO Advantage Card. As a result, you must keep your FO Advantage Card safe and the PIN only known to you; you should memorize the PIN and never disclose the PIN or security information to anyone. If you suspect that someone else knows your PIN, you should change it as soon as possible. You can change your PIN at any First Bank ATM machine by following the on screen instructions. We recommend that you check the balance on your FO Advantage Card regularly at any ATM machine (remember to select current as the account option). 8. Lost and stolen FO Advantage Card and unauthorized or incorrectly executed payments In the event that you know or suspect that your FO Advantage Card is lost, stolen, compromised - or if you think a transaction has been incorrectly executed, you must contact the 24 hour helpline without delay 0700FIRSTCONTACT (0700-34778-2668228), 01-4485500, 0708-062-5000 or send a mail to firstcontact@firstbanknigeria.com

9. Liability Forte Oil Plc, First Bank Nigeria Ltd and Interswitch Ltd shall not be liable for any disputed transaction leading to fraud that is authorized by the customer, or for any direct fraudulent or negligent acts of the customer on his/her FO Advantage Card. In addition, all parties shall not be deemed liable for any direct or consequential loss under the following circumstances; In the event or occurrence of Force Majeure being the failure or delay by either party in the performance of its obligations due to unforeseen, unavoidable circumstances beyond the reasonable control of such party including but not limited to acts of God, flood, strikes, lockout, labor, unrest, riot or civil disorder, insurrection, acts of war, fire, tornado or any extreme weather condition, law or regulation which may impede the party s performance of its obligations under this Agreement any inconvenience arising from the non-acceptance of the FO Advantage Card by a 3 rd party retailer The statutory compliance with any regulation in force Unavoidable corruption of data unless caused by our willful default 10. Changes to these terms These terms and conditions may be amended at any time upon notification to you by e- mail or other agreed means at least 1 month before the change is due to take effect. The up-to-date version of the FO Advantage Card terms and conditions will always be available on the www.forteoilplc.com website. The change will automatically take effect and you will be taken to have accepted the change unless you communicate otherwise. In that event, we will treat that notice as notification that you wish immediately to terminate. In such circumstances, you will be expected to withdraw the balance on your card from the ATM machine and destroy your card or return to the nearest First Bank branch within two weeks as your card will be blocked thereafter. 11. Fees and usage restrictions We do not charge any fees for checking your balance on the ATM, and for transactions done on POS. However the following fees do apply: Fee Type Amount

Authorization will be requested for all transactions at the time of each transaction. In the unlikely event, for any reason whatsoever, a transaction is completed when there are insufficient funds on the FO Advantage Card (thereby causing a "Shortfall"), the Shortfall shall be reimbursed by you unless it is due to an error on the part of the retailer where the FO Advantage Card was presented, in this circumstance we may seek the Shortfall from the retailer. You agree that once FBN makes this Shortfall known to you, FBN may charge your card for the Shortfall amount. FBN may charge the amount of the shortfall from any other FO Advantage Cards or Verve Cards that you hold with us, to any other payment method which you may designate at that time, or against any funds which you may subsequently load onto your FO Advantage Card or on any additional FO Advantage Card ordered by you. Until we are reimbursed the Shortfall amount, FBN may suspend your FO Advantage Card and any additional FO Advantage Cards connected to you. In addition FBN reserves the right to charge you an Administration Fee for each transaction that you make using your FO Advantage Card that results in a Shortfall or increases the Shortfall amount on your FO Advantage Card. 12. Your details You must notify Forte Oil and First Bank (depending on where you made your card request) of any change in name, address, and phone number or e-mail address as soon as possible. Your most recent contact details you have provided will be used in contacting you in relation to your FO Advantage Card. Any information sent to you via this contact information will be treated as being received as soon as it is sent by us. We will not be liable to you if your contact details have changed and we have not been notified.

A failure to update your contact details with us or to provide accurate information shall be a ground for the cancellation of your FO Advantage Card and termination of the agreement. 13. Data Protection In purchasing the FO Advantage Card and using it, you agree that Forte Oil can use your personal information in accordance with our Privacy Policy. Our Privacy Policy is set out on our Website, it includes details of the personal information that we collect, how it will be used, and who we share it with. Disputes with Retailers/Complaints If you have any dispute about purchases made using your FO Advantage Card outside our retail outlets this should be taken up and settled with the affected merchant. Forte Oil Plc, Interswitch Limited and First Bank Ltd will not be responsible for the quality, safety, legality or any other aspect of any goods or services purchased with your FO Advantage Card outside of Forte retail stations. Please be advised that transactions once consummated cannot be reversed except in proven cases of not receiving service or value as purchased in which case such claims can be lodged at any FirstBank branch closest to you for investigation against the acquiring merchant s bank. Such claims once validated and accepted by the acquiring bank will be reversed and credited to your FO Advantage Card through your branch of complaint. 15. Communication For enquiries relating to your FO Advantage Card, you can call First Bank Customer Service Desk 0700FIRSTCONTACT (0700-34778-2668228), 01-4485500, 0708-062-5000 or email firstcontact@firstbanknigeria.com. The customer services telephone line is a chargeable service. Call costs from each network may vary. 16. Enquiries If you have reservations concerning your FO Advantage Card or the way it is managed, contact Forte Oil via our email; foadvantage@forteoilplc.com so Forte Oil can respond to you directly. 17. Assignment We may assign the benefit and burden of these terms and conditions to another company at any time, upon 1 month s prior notice of this. If we do this, your rights will not be affected. 18. Moving to a new FO Advantage Card

Forte Oil may move your unused balance to a new FO Advantage Card provided by a Prepaid Card issuer other than First Bank Nigeria Ltd at any time. Before doing this, Forte Oil will give you 1 (one) months notice of the new Prepaid Card arrangements and the new Prepaid Card terms and conditions. Unless you advise us within the 1 month period that you do not want a new FO Advantage Card from the new Prepaid Card issuer, you agree that Forte Oil can automatically transfer the unused balance on your FO Advantage Card to a new Prepaid Card provided by the new Prepaid Card issuer. 19. Governing Law This Agreement shall be read and construed in all respects in accordance with the laws applicable for the time being in Nigeria. 20. Fund Protection As a responsible e-money issuer, First Bank Nigeria Ltd ensures that once it has received your funds they are deposited in a secure account, specifically for the purpose of redeeming transactions made by your FO Advantage Card. In the event that First Bank of Nigeria Ltd becomes insolvent funds that you have loaded which have arrived with and been deposited by First Bank Nigeria Ltd are protected against the claims made by creditors. 21. FO Advantage Card Issuer Your FO Advantage Prepaid Card is issued by First Bank of Nigeria Ltd ( FBN ) pursuant to license by the CBN. FBN is authorized by Authority to conduct electronic money service activities under the Guidelines for the Regulation of Card Issuance and Usage in Nigeria. Your FO Advantage Card is the property of Forte Oil Plc and is not transferable to anyone else.
