Recommended by: Jeff Coder Approved by: Jack Ethredge Ordinance previously Presenter(s): Glenda Lainis, Policy Planning Manager introduced by: SYNOPSIS: The Municipal Annexation Act of 1965 requires that cities have a plan in place showing a planned growth area, which is referred to as a Plan in Place or 105 Plan (the Plan) after its abbreviated statutory reference. The Plan may not extend more than three miles from the municipal boundary and generally describes the land use, infrastructure, and public spaces for areas that a jurisdiction proposes to annex. This resolution addresses the annual update of the Plan. In the past, the City has adopted the Comprehensive Plan as the Plan in Place. For the 2016 annual update, the 2012 Comprehensive Plan, which is the most recently adopted Comprehensive Plan, will be used as the Plan in Place. As was done in 2015, it is proposed that the Hammer Reservoir properties located on the west side of the South Platte River north of the E-470 Highway, also be included as part of the Plan in Place for use as a future reservoir in the City s municipal water system. It is further proposed that the E-470 Right-of-Way from Yosemite Street to the South Platte River be included as part of the Plan in Place, to allow for the annexation of the future reservoir referenced above. RECOMMENDATION: Staff recommends Alternative No. 1, that City Council adopt the resolution designating a Plan in Place in order to be in compliance with the Municipal Annexation Act. BUDGET/STAFF IMPLICATIONS: None. ALTERNATIVES: 1. Approve the resolution as presented. 2. Direct staff to make identified changes to the resolution and schedule the item for consideration at a future City Council meeting.
COUNCIL COMMUNICATION PAGE 2 BACKGROUND (ANALYSIS/NEXT STEPS/HISTORY): (includes previous City Council action) The City Councils of Brighton and Thornton entered into an Intergovernmental Agreement regarding future growth areas in 2012, which includes specific reference to the Hammer Reservoir properties and their future annexation into the City of Thornton. History of Plan in Place adoption in Thornton is as follows: Prior to 1998, the City of Thornton utilized the 1985 Comprehensive Plan and the South Weld County Three-Mile Plan in Place City Council utilized the 1997 Comprehensive Plan as its Plan in Place from 1998 to 2006. On September 11, 2007, City Council adopted the 2007 Comprehensive Plan, thereby superseding the 1997 Comprehensive Plan. From 2007 to 2011 City Council adopted the 2007 Comprehensive Plan On September 11, 2012, City Council adopted the 2012 Update to the 2007 Comprehensive Plan. In 2012, City Council adopted the 2012 Comprehensive Plan plus the Hammer Reservoir properties In 2013, City Council adopted the 2012 Comprehensive Plan plus the Hammer Reservoir properties In 2014, City Council adopted the 2012 Comprehensive Plan plus the Hammer Reservoir properties In 2015, City Council adopted the 2012 Comprehensive Plan plus the Hammer Reservoir properties and property along the E-470 right-of-way east of Yosemite Street
R E S O L U T I O N A RESOLUTION DESIGNATING A PLANNED GROWTH AREA IN ADAMS AND WELD COUNTIES FOR THE PURPOSES OF THE MUNICIPAL ANNEXATION ACT. WHEREAS, the Municipal Annexation Act of 1965, Section 31-12-101, et. seq., C.R.S. (the Act) requires a plan be adopted for the three-mile area in which a city may annex; and WHEREAS, the Act requires that said plan be updated annually and generally describe the land use, infrastructure, and public spaces for areas that a jurisdiction proposes to annex; and WHEREAS, on September 11, 2012, City Council adopted the 2012 update to the 2007 Comprehensive Plan; and WHEREAS, the 2012 Comprehensive Plan identifies the future land uses proposed within the City s planned growth area, which extends into both Adams and Weld Counties within an area three miles from the City s existing boundaries; and WHEREAS, the City has acquired certain properties on the west side of the South Platte River (referred to as the Hammer Reservoir, for use as a reservoir in the City s municipal water system, which fall within an area three miles from the City s existing boundaries; and WHEREAS, the City desires to annex certain property along the E-470 Right-of- Way (referred to as the E-470 ROW) east of Yosemite Street; and WHEREAS, the City desires to annex these properties in order to provide for the proper maintenance, use and protection of the future municipal reservoir; and WHEREAS, Exhibit A, identifies the City s Future Growth Boundary, as identified in the 2012 Comprehensive Plan, in addition to the Hammer Reservoir and E-470 ROW properties. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THORNTON, COLORADO, AS FOLLOWS: That the 2012 Comprehensive Plan of the City of Thornton and the Hammer Reservoir and E-470 ROW properties shown on Exhibit A, are hereby adopted and affirmed to serve as the City of Thornton Three-Mile Plan in Place required by Section 31-12-105, C.R.S.
