TOWN OF PLATTEKILL REGULAR TOWN BOARD MEETING Time: 7:00 PM August 1, 2018 SALUTE TO FLAG Supervisor Croce opened the meeting with a salute to the American Flag. ROLL CALL The following Town Board Members were present: Supervisor Croce Councilman Putnam Councilman Farrelly Councilman Matthews Councilman DePew MINUTES * Supervisor Croce made a motion to dispense with the reading of the minutes from the July 18 th, 2018 Regular Town Board Meeting. * Supervisor Croce made a motion to accept the minutes from the July 18 th, 2018 Regular Town Board Meeting. Councilman Matthews seconded. On the vote: Supervisor Croce Councilman Putnam Councilman Farrelly Councilman Matthews Councilman DePew Abstained (absent) ADDITIONS Supervisor Croce stated that he had two additions to the evening s agenda. One was a Police Dept. memo and the other is a Highway Dept. request. 1.Police Officer Stationed At Plattekill Elementary School: Supervisor Croce stated that he had given each town board member a copy of a request from Chief Ryan, stating that he had received a request from the Assistant Superintendent of the Wallkill School District. It seems the School District has received a grant to pay for full time officers to be on duty at the Elementary Schools for one full year and they wanted to know if our Town Police Department would want to provide that officer for Plattekill Elementary School. In the memo, Chief Ryan further explained that the job would be for a period of 180 days (the school year) at 8 hours per day. The Town would bill 1

the School District on either a monthly or quarterly schedule and the officer would need 8 hours per day at $25.00 per hour. Supervisor Croce started the discussion stating that he has not had much time to discuss this idea with the Chief as he just received this memo. He stated that the Chief was thinking we could maybe hire someone who is a retired officer, for this position, and we could work out a voucher system, with the bookkeeper and the School District, to do the payroll. Councilman DePew questioned that if we hire this person full time, what does that do to our Department as it is considered a part time Department? Supervisor Croce stated that he was thinking we would have to hire two people to cover this situation. The department works on the number of hours an officer is allowed to work during the year (1,040) and the school year is for 180 days, which could be less for snow-days or superintendent days. This would all have to be worked out. Supervisor Croce stated that he felt this was a good idea as the officer can be introduced as a friend and would be monitoring the hallways and lunch room. He stated that it is terrible to think we have to do this, but we need to do what has to be done to make schools safe. Councilman Putnam stated that maybe we could have someone work Monday, Wednesday and Friday and the other person work Tuesday and Thursday and then rotate hours on a weekly basis. Supervisor Croce stated yes, this can all be worked out. He stated that he felt this was a good idea, but the grant will only pay for one year. They will have to budget for this somehow, so it can be continued in the future. The Town Board was in agreement to support Chief Ryan in providing an officer, or two, to work at the Plattekill Elementary School. 2. TRANSFER OF FUNDS FOR MOWING CEMETERIES Supervisor Croce explained that the Highway Superintendent is requesting that additional funds be transferred to the Cemeteries budget line as the bids that came in for mowing came in at a higher cost than the previous year and what was budgeted for this year. * Supervisor Croce made a motion to transfer $3,000.00 from the General Fund Budget Line #A1620.4 Buildings & Grounds Contractual to General Fund Budget Line #A8110.4 Cemeteries Contractual to cover the mowing of the cemeteries until the end of the year 2018. (A copy of the complete transfer is attached to these minutes). Councilman DePew seconded. PUBLIC INPUT Mr. Philip Fetter stated that the schools have to do 180 days regardless of whether they have snow days or not. Supervisor Croce stated yes, he was thinking more like the days they close for teacher planning days or superintendent days. The officer would not have to be on duty if the children are not there. Supervisor Croce asked Gladys Figueroa and Rose Guerrieri if the Plattekill Latino-American Festival was a success? He stated that he could not make the event, but he spoke to the person who cleans on Saturday and Sunday morning at the Park and he stated that everything was as clean as a whistle. 2

Mrs. Figueroa and Ms. Guerrieri both stated that it went very well; until it rained. They stated that they had a doo-wop group that played around 4:00 PM and everyone seemed to have a good time. There were no further comments or questions from the Public. * Supervisor Croce made a motion to close the Public Input section of the meeting at 7:15 PM. SECTION 1 KITTY LANE PRIVATE ROAD MAINTENANCE AGREEMENT Supervisor Croce stated that Mrs. Patti Brooks was present this evening to further discuss the Kitty Lane Private Road Maintenance Agreement that has to be accepted/approved by the Town Board so that she can receive final approval from the Planning Board. Mrs. Brooks stated that there were some concerns with meeting the Chapter 118A regulations, but all the lots will be part owners of the roadway and will share in the maintenance of the roadway and the drainage. She stated that she tried to set up a meeting with the Highway Superintendent and her engineer, to have them make up a schedule, but she could not get a date when they all could meet. So she had her engineer set up a schedule. However, she stated that she still wanted to present it to the Highway Superintendent for his blessing. Supervisor Croce stated that in the end, it is the Town Board making the final decision. Mrs. Brooks stated yes, that is the way the code is written and she would need this to be accepted by the Town Board to receive final approval. Supervisor Croce asked who would be making the inspections? Mrs. Brooks stated that Mr. Wager felt the Town s MS4 Officer should do the inspections. Supervisor Croce asked who was going to be in charge? Mrs. Brooks stated that it is in the maintenance agreement that they have to meet once every 3 months and after an incident occurs. Councilman DePew asked about the liability to the Town? The Town has no liability, right? And they would have to take a civil action if needed? Mrs. Brooks stated yes, they would need to take a property owner to court for a civil matter. She stated that the Town of Plattekill is different from other Towns. Other Town Boards do not have to approve these maintenance agreements. Supervisor Croce stated that it could be possible that the owners could ask the Town to make this road a Town Road. He feels that that is why the Town Board is involved. Mrs. Brooks stated that each property owner, on this road, will have a 1/6 percent interest of the entire road. That way they cannot say that they only own in front of their own property. Supervisor Croce stated that his major concern is that they do not disturb the drainage. * Supervisor Croce made a motion that the Town Board accepts this Declaration of Common Private Road Easement and Maintenance Agreement for Kitty Lane Properties, LLC. SECTION 2 GREENE COUNTY LOGGING PERMIT Supervisor Croce explained that the Greene County Logging Company has filed a permit, with the Town of Marlboro, to do logging in the Town of Marlboro, but his access to bring the logs out will be on 3

a road in the Town of Plattekill. He is looking to come out on the very end of New Unionville Road and use the Cariola Property. Since he will be removing the logs through Plattekill, he also needed to file a logging permit here. Supervisor Croce stated that we have received all the necessary paperwork, he has spoken with the Building Inspector who will be checking and doing inspections and he has met with the Highway Superintendent. The only thing we still need is the $5,000.00 check for the road maintenance. Mr. Jordan Heller, the representative from the logging compay, stated that he would bring in a check to the Supervisor s Office tomorrow. * Supervisor Croce made a motion to approve the Greene County Logging Permit contingent on receiving the $5,000.00 road maintenance fee check. SECTION 3 RCI PROPOSAL FOR FIXED ASSET UPDATE ON TOWN FACLITIES & PROPERTIES (GASB#34) Supervisor Croce stated that the Town Board spoke about doing this update on our Town Facilities and properties (GASB#34) at the last meeting. He explained that he confirmed with the accountant that the proposal from RCI would be acceptable, so if everyone is in agreement, we can make a motion to hire RCI to do this update. Councilman DePew asked about the first part of the proposal where it says they will do a scan and tag update and the Historical Cost Research for $9,500.00? Supervisor Croce stated that they already did the scan and barcode tag review which his office has been keeping up-to-date. We do not need them to update the inventory. We just need them to do the cost research on the land, improvements, buildings and infrastructures. He stated that the accountant has been after him to do this for a number of years as we should be including this in our annual AUD (Financial Report). He stated that we only want the second part of the proposal which will cost $5,000.00. Councilman DePew stated that he felt this would also be a good thing to do for our insurance. We will have a true value of our Town which will help in estimating how much insurance we need. Supervisor Croce agreed. He stated that the only thing we need to do is decide where we will get the money to pay for this. He stated that he would suggest transferring funds from the General Unassigned Fund Balance and to do this we would need to adopt a resolution to amend the 2018 General Fund Budget and then do a transfer of funds. * Supervisor Croce made a motion that the Town of Plattekill hire RCI to do an Actual Historical Cost Research for Land, Improvements, Buildings and Infrastructures only, at a cost of $5,000.00. * Supervisor Croce made a motion to adopt the following Resolution #13: Town of Plattekill Transfer of General Funds Amend General Fund Budget - RESOLUTION #13 WHEREAS, the Town Board of the Town of Plattekill has approved the hiring of RCI to do an Actual Historical Cost Research for Land, Improvements, Buildings and Infrastructure, and 4

WHEREAS, the cost of this inventory is necessary to bring the Town of Plattekill up-to-date with New York State regulations for GASB#34, NOW THEREFORE BE IT RESOLVED, by the Town Board of the Town of Plattekill, Ulster County, to amend the year 2018 General Fund Budget Line item #A1320.400 Auditor Contractual by an increase in the amount of $5,000.00, and BE IT FURTHER RESOLVED, that funding shall be supported by a transfer of $5,000.00 from the General Unassigned Fund Balance. * Supervisor Croce made a motion to transfer $5,000.00 from the General Unassigned Fund Balance Line item #A0917 to the General Fund Budget Line item #A1320.4 Auditor Contractual to cover the cost for Fixed Assets services relating to the GASB#34 provided by RCI. (A copy of the complete transfer is attached to these minutes). SECTION 4 TIRE FEES AT TRANSFER STATION Supervisor Croce explained that he had given the Town Board members an invoice from the company that takes our tires collected at the Transfer Station. He pointed out that the Attendant had taken the tractor tire for $25.00 and it cost the Town $92.00 to get rid of it. He stated that he would like to see the Town Board increase the fees to come a little closer to breaking even. The Town Board discussed the fact that the Town does not break even on what is budgeted to run the Transfer Station and what funds are collected at the Transfer Station. Councilman DePew suggested that they look at what other Towns are charging for tires at their Transfer Stations. There was more discussion on the problem of increasing fees and then finding tires thrown along the sides of the road because people don t want to pay to get rid of them. Councilman DePew suggested that the Town Board should add Tractor Tires as a separate tire on the list and charge $50.00 for them. He stated that people who would have a large tractor tire would probably know that it is expensive to recycle them. There was discussion that when anyone goes to a garage to purchase new tires, there is always a fee for them to recycle the old ones added to the bill. Mrs. Figueroa stated that she thought there were companies who take the tires for free because they recycle them and use them for other purposes. Supervisor Croce stated that he was not sure what is done with the tires, but all the companies that he is aware of, charge for taking the tires. * Councilman Putnam made a motion to add a separate tire and fee to the list of tires taken at the Transfer Station; it would say Tractor Tires - $50.00. Supervisor Croce seconded. 5

SECTION 5 HIGHWAY DEPARTMENT FLOATING HOLIDAY Supervisor Croce read a memo from the Highway Dept. stating that the employee s would be taking their floating holiday this year, on August 30, 2018. SECTION 6 EXECUTIVE SESSION * Supervisor Croce made a motion to enter into Executive Session at 7:58 PM to discuss PBA negotiations. * Supervisor Croce made a motion to close Executive Session and re-open the Regular Town Board Meeting at 8:30 PM. Councilman DePew seconded. SECTION 7 VOUCHERS * Councilman DePew made a motion to pay the Voucher Detail Report dated, which includes: the General Fund amount of $ 38,716.87, the Highway Fund amount of $19,653.17, and the Trust & Agency amount of $4,259.88 for a total amount of $62,629.88 recognizing that the Audit Committee has reviewed the claims and found them acceptable for payment. SECTION 8 ADJOURNMENT * Supervisor Croce made a motion to adjourn the meeting at 8:32 PM. 6
