BPS MAHILA VISHWAVIDYALAYA KHANPUR KALAN (SONIPAT) Tender Notice Sealed tenders are invited from established and reputed agencies for providing various services i.e. Cleanliness, Horticulture, Security and Secretarial & support Staff for its campus/constituent colleges/institutions for a period of one year. The Proforma for quotation and Scope of work in respect of Cleanliness, Horticulture and Security may be downloaded from the University website bpswomenuniversity.ac.in. The quotations under sealed cover along with earnest money of Rs 1,00,000/- and the cost of tender documents Rs 500/- in the form of two separate Demand Drafts in favour of Registrar, BPSMV, Khanpur Kalan should be sent by 22 nd Sept.09 up to 03.00 P.M. The interested parties may visit University Campus on any working day between 1100 A.M. to 100 P.M. to study the scope of work. BPS MAHILA VISHWAVIDYALAYA KHANPUR KALAN (SONIPAT) A. SCOPE OF WORKS Sr. no. Work Scope of work Earnest money 1. Cleanliness (On monthly rate) Cleanliness of the Campus and its institution situated in the Campus(Including toilets), all the approach roads leading to Hostels, Administrative Block, Visitors rooms, attached/nearby Toilets. There should be atleast two supervisors in the campus on these cleaners. These supervisors should get uniform by the agency/ Contractors. All the material for cleanliness would be provided by the contractor/agency. Sufficient number of ladies are to be employed for the work of cleanliness. 2 Horticulture (On monthly rate) 3 Security (On monthly rate 4. Secretariat & Support Services (As per requirement on DC rate. There are six institutions, 12 parks/ Lawns and the open area of the entire University. The work includes, cleanliness, maintenance, plantation of seasonal flowers/plants and upkeep of grass, Pruning of trees on all approach roads, housing area situated in whole University Campus. New seasonal plantation, grass in the whole University Security of entire university campus including constituent colleges/institutions/hostels and other property of the University, with a provision to ensure connectivity between the security persons and their supervisors through wireless, establishment of one control room and one supervisory vehicle should be kept. The Proforma and list of staff required are placed on University Website.

B. TERMS AND CONDITIONS 1. The Principal employer reserves the right to cancel the contract agreement or to withhold the payment in the event of non-commencement or unsatisfactory performance of the work contract. In such eventuality, Principal Employer further reserves the right to get the work done from open market or through some other agencies. Contractor will be blacklisted in the department for participating in such type of tender and his earnest money/security deposit may be forfeited if so warranted. 2. Any person who is in Government Service or an employee of the University should not be made a partner to the contract by the contractor directly or indirectly in any manner whatsoever. 3. In every case in which by virtue of the provision of the workman s compensation Act, the Government of India/Government of Haryana if obliged to pay compensation to such person employed by the contractor in execution of the work; the Government/University will be entitled to recover from the contractor the amount of compensation so paid. 4. The contractor shall Indemnify the University against all other damages/charges and expenses for which the government may be held liable or pay on account of the negligence of the contractor or his servants of any persons under his control whether in respect of accident, injury to the person or damages to the property of any member of the public or any person or in executing the work otherwise and against all claims and demands thereof. 5. The contract is awarded for a period from 01.9.2009 and after the expiry of the said period of contract may be extended on, mutual consent on the same rates and terms and conditions and the discretion of the principal employer or at the terms settled mutually in writing. 6. The principal Employer reserves the right to terminate the contract without assigning any reason by giving to the contractor one calendar month s notice of its intention to do so on the expiry of the said period of notice, the contract shall come to an

end without prejudice for any right of remedy that may be accused to other party by reason of any incident which of any terms therof such notice may be signed on behalf of President of India/Vice-Chancellor, BPSMV.Khanpur Kalan by any of the officers. 7. If any information furnished by contractor is found to be incorrect at any time, the contract is liable to be terminated without any notice and the security deposit is liable to be forfeited by the Principal Employer. 8. In case the contractor fails to commence /execute the work as stipulated in the agreement or there is a breach of any terms and conditions of the contractor Pr.Employer reserves the right to impose the penalty as detailed below a. 2%of cost of order/agreement per week, upto 4 weeks delay. b. After Weeks delay Principal Employer reserves the right to cancel the contract and withhold the agreement and get this job carried out through other agencies. The defaulting contractor will be black listed as per clause stated in (1) above and difference if any,will be recovered from the contractor. c. The security deposited by the contractor shall be forfeited. d. The penalty clauses will be strictly imposed for unsatisfactory work of failure to complete the work within scheduled time. 9. The individual signing the quotation form or any document forming part of the contract on behalf of another or on behalf of a firm shall be responsible to the produce a proper power of attorney duly executed in his favour stating that he has authority to bind other such person of the firm as the case may be in all matters pertaining to the contract including the arbitration clauses. If subsequently the person so signing fails to provide the said power of Attorney within a reasonable time the Government may, without prejudice to other civil and criminal remedies cancel the contract and hold the signatory liable to all costs and damages. In case of registered or unregistered or unregistered Partnership Firm, all the parterners should sign the quotations. In case any person signing the agreement on behalf of limited company or firm, he will produce letter of authority/resolution passed by the company empowering him to sign the agreement on behalf of company or firm.

10. The contractor has to maintain all the relevant records, register and documents as required by the Labour Department, Regional Provident Fund Commission and Employees State Insurance corporation or other local bodies as per the existing rules or as amended from time to time. 11. In case of any violation of statutory provision under labour Laws/ Income Tax or Service Tax on behalf of the Contractor there will not be any liability on Principal Employer. 12. Agency may visit the BPSMV campus to acquaint himself about the site conditions. 13. In the event of any dispute arising out in connection with the interpretation of any clauses in the terms and conditions of the contract, agreement,or otherwise the matter shall be referred to the arbitrator as appointed by this University, Courts at Sonipat shall have jurisdiction in connection with any dispute/litigation arising out of this contract. The contractor shall seek instructions from Pr. Employer or other authorized by him for the purpose; hereinafter referred to as Authorized Officer. 15. The contractor shall be fully responsible for the outsourced services in the premises of the University as laid down in the agreement. 16. The contractor shall ensure, good behavior with all the staff in the University as well as with the visitors to the University. They shall abstain from taking part in any staff union and association activities. 17. The University shall not be liable to provide any residential accommodation to the outsource personnel. No cooking or lodging shall be allowed in premises of the University. 18. The outsource staff shall be bound to observe all the instructions issued by the University concerning general discipline and behavior. In case, any person employed by the contractor is inefficient, quarrelsome, infirm,invalid or indulges in an unlawful activity or the like, the contractor shall replace such person with a suitable substitute at the request of the University.

19. The contractor shall comply with all the statutory provisions as laid down under various Labour Laws/Acts/Rules like Minimum Wages, Provident Funds, ESI, Delhi Shops and Establishment Act, Bonus, Gratuity, Contract Labour Act and Labour Laws/ Acts in additions to the provision that contractor shall comply with all legal requirement for obtaining licenece under the Contract Labour (R&A) Act, 1970 at its own cost, In case of violation of such statutory provisions under Labour Law by the contractor, there will not be any liability on Principal Employer and the contract will be liable for termination. 20. The University shall not be responsible financially or otherwise for any injury to the outsource personnel in the course of performing their duties. 21. The Contractor shall not be permitted to transfer their rights and obligations under the contract to any other organization or otherwise. 22. Principal Employer has the absolute right to terminate the contract at any time with assigning any reason thereof. Principal Employer will also have the right to extend contract at the same terms and conditions until such time, the new outsource agency the over in case fresh tendering is required to be reported. 23. In case the contractor wants to terminate the contract, he shall have to give three months notice in advance to this effect. 24. In case of breach of any of the terms of agreement, the security deposits of the contractor is liable to be forfeited by the Principal Employer. Any sum of money due, is payable to the contractor including the security deposits refundable to him under the contract, can be appropriated by the Principal Employer against any amount which the contractor may owe to ( President of India ) Vice-Chancellor, BPSMV, Khanpur Kalan. 25. Any other provisions as advised by the principal employer shall be incorporated in the agreement. The same shall also be binding on the contractor.

26. None of the employees of the Contractor shall enter into any kind of private work at the different campuses of the University during working hours or otherwise, failing which penalty as decided by the University authorities shall be imposed, without giving any notice. The amount of penalty shall be deposited by the contractor immediately with Registrar, BPSMV, Khanpur Kalan or deducted form the monthly bills. 27. The Contractor shall maintain Complaint Book which will be made available to the supervisory staff this University.. 28. The Contractor/ agency shall have a proper office. The Contractor will not engage in employment of those workers who were earlier serving in this University with predecessor for this specified work. 29. That the appropriate deployment of the manpower shall be ensured by the contractor as per the real need and requirement of the premises. 30. That the contractor shall engage the outsource staff as per the requirement of University and any complaint of misbehavior and misconduct comes into the knowledge of the Principal Employer then all such responsibility shall be of the contractor and any loss due to negligence or mishandling by the outsource staff, the contractor shall himself be responsible to make good for the losses so suffered by the department. 31. That the attendance and other relevant records shall be kept by the contractor at his own cost and be produced by him on demand to the Principal Employer or any officer deputed for this purpose by the Principal Employer as the contractor and his staff is under overall supervision of the Principal Employer. 32. That the contractor shall obtain a license under Contract Labour (R&A) Act, 1970 and also submit a copy of such license duly attested in the department prior to furnishing the tender/contract. Moreover, he shall abide by all the necessary provisions of various Labour Laws/Acts viz ESI/Bonus, Contract Labour, workmen s Compensation and any other laws and rules applicable to him in this regard.

33. That the Contractor, him self will be responsible/ liable for any type of statutory /mandatory claims or penalties in light of the default with reference to the above provision. 34. That in case any person engaged by the contractor, found to be inefficient, quarrelsome, infirm, invalid or found indulging in unlawful or union activities, the contractor shall replace such person with a suitable substitute at the direction of the department. 35. That the Contractor shall not, at any stage, cause or permit any sort of nuisance in the premises of the department or do anything which may cause unnecessary disturbance or inconvenience to others working there as well as to the general public in the department. 36. Prior information should be given in writing for any worker/labour engaged who is directly or indirectly related to any employee of the University. 37. That the contractor for providing outsource services shall ensure the following (a) That a daily report of its staff on duty and about their performance is furnished. (b) That its staff do not smoke at the place of work. (d) That any specific outsource assigned to it by the Principal Employer or any officer authorized by him is carried out by him diligently and well in time. (e) That the salary/wages shall be disbursed in full as settled between the contractor and the Principal Employer in the presence of a representative of the department and a certificate and may also be furnished to this effect to the Principal Employer. 38. The agency shall submit the copies of separate challans along with the list of labours/workers engaged by the contractor in the University, viz ESI and PF exclusively in respect of the labour/workers deployed in NSIT and shall produce such challans in original for verification at the time of payment to it or release.

39. The contractor of his authorized representative shall collect the attendance duly verified by the concerned HODS /Selection In-charge at BPSMV, Khanpur Kalan. There after, the attendance sheets in original along with the attendance summary sheet, attendance chart and bill shall be submitted by the Contractor latest by the 5 th of every month to the Sr. Account Officer for verification and processing the bill. 40. Payments to all the workers/labours shall have to be made by cheque by 10 th of each month by the contractor, notwithstanding any situation in which the University due to administrative reasons does not release the payment by the stipulated date,failing which a penalty of Rs 500/- per day will be imposed by the University. No part payment to the labour shall be accepted by the University. Badges will be issued by the contractor to all the labour/workers indicating name of worker/labour and name of the firm only,without any financial cost to the University. AGREEMENT 1. In accordance with the Haryana Govt. policy for engaging/outsourcing of services/activities points no.9 of Part 1, the service provider must pay the minimum wages as prescribed in the agreement ( DC rates) by way of account payee cheque /bank draft/pay order to the employees. In case of default in this regard or any other deficiency/default in providing service the agreement shall be terminated by giving 15 days notice. 2. The service provider shall ensure timely payment to the employees. 3. The service provider shall ensure strict compliance of the rules and regulations framed by the Government of Haryana in this regard. 4. The service provider is required to maintain a complete record and the University or its representative has a right to inspect, audit or take copies of the record thus maintained. 5. It is the duty of the service provider to make good, at its own expense, any loss/damage suffered by the University as a result of the acts of commission or omission,negligence or otherwise,of its personnel. 6. The rules framed by the Government from time to time for outsourcing engagement shall be binding. 7. The contractor shall provide Secretarial and Support Services on 06 days week to University at its premises or its various offices and other locations. 8. The University shall make monthly payment of salary to the Contractor by 5 th of the following month. In return the contractor will release the salary to the staff provider by it latest by 7 th of the following month. 9. The University shall not advance any amount to the personnel of the contractor. 10. That the tenure of this agreement shall be for a period w.e.f-------------- to------ and thereafter may be extended by mutual consent of both the parties. A notice of one month in advance or payment in lieu of the shortfall in the required notice period will have to be given by either party for termination of this agreement. During the contract period, if the strength of the manpower decreases considerably, the contractor will be given one month prior notice for this by the University.

The requirement of the University may increase or decrease and at least a week s notice will be given to the Contractor in this regard. 11. No person shall be appointed to any post, unless he possesses Good Character and his antecedents be got verified by the Contractor. The person so appointed by the Contractor will have to follow the norms of official secret Act under the guidance of his/ her controlling officer. 12. The Person to be provided will be physically fit, neat and tidy and they with a uniform and some insignia by the Contractor so as to be easily identified. If the University through its authorized officers finds any person physically unfit and not properly dressed, the officer will be entitled to ask the Contractor to have him replaced by a proper and fit person. 13. Any dispute arising out of or in relation to this Agreement shall be referred to arbitration as per Indian Arbitration Act, 1996 and the Registrar, BPS Mahila Vishwavidyalaya, Khanpur Kalan or a Nominee shall act as sole arbitrator and his award shall be binding on both the parties. 14. The CONTRACTOR shall be responsible for discipline, salaries and other statutory dues of the personnel deployed by him to the University. However, the personnel of the CONTRACTOR shall not, under any circumstances, be deemed to be employees of the UNIVERSITY and shall not claim from the University regularization/job, any salary, damages, compensation or anything arising out of their normal employment/duty under the present Agreement. The Contractor will be responsible for ensuring payment of all employee related benefits as per law to their respective employees and the University would not be responsible for any benefit/ privileges whatsoever. 15. The contractor will be responsible for overall control and supervision of its staff/personnel while serving at the premises of the negligence of the Contractor s staff, which is not covered by the insurance Agency, the Contractor shall make good such loss. However, the contractor shall not be responsible for any loss caused to the properties of the University for reasons such as natural calamities, robberies, earthquakes etc. or not directly attributable to the contractor s staff/personnel

16. The duties of personnel provided by the contractor shall be as per the guidelines/instructions of his/her controlling officer. The contractor s personnel shall carry out duties in proper uniform. 17. Personnel of the Contractor shall not be permitted to join any Union or to mix up with the staff of the University for unwarranted/undesirable activities.
