Subtitle TO CLARIFY THAT THE SUBROGATION AND REIMBURSEMENT RIGHTS OF PARTIES TO AN INSURANCE CONTRACT ARE TO BE DEFINED BY THE INSURANCE CONTRACT. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: SECTION. DO NOT CODIFY. Legislative intent. It is the intent of the General Assembly to abolish the common law rule that equitable subrogation and the made whole doctrine cannot be modified by an insurance contract, a rule that has been applied by the Arkansas Supreme Court in a number of cases, including without limitation Franklin v. Healthsource of Arkansas, Ark., S.W.d () and Ryder v. State Farm Mutual Automobile Insurance Company, Ark. 0, S.W.d (0). SECTION. Arkansas Code -- is amended to read as follows: --.
