Pursuant to Article 17, paragraph 1 point 2) of the Central Bank of Montenegro Law (OGRM 52/00, 47/01), and Article 103 paragraph 2 of the Banking Law OGM 17/08), the Council of the Central Bank of Montenegro, at its session held on 23 and 24 October 2008, passed the following DECISION on Reports to be submitted to the Central Bank of Montenegro pursuant to the Banking Law 1. General Provision Subject Matter of Regulation Article 1 This decision determines types, format, content and deadlines for the required reports and other data to be submitted to the Central Bank of Montenegro (hereinafter referred as: the Central Bank) pursuant to the Banking Law. 2. Reports and Reporting Periods 2.1. Bank Reports Daily Reports Article 2 Bank shall submit to the Central Bank the following daily reports: 1) Report on available liquid funds, liabilities and executed payments (Form RLS); 2) Report on total number of payment orders and total value of interbank payment system (Form UPP); 3) Report on cash balance (Form SGN) Bank shall submit to the Central Bank daily reports referred to in paragraph 1 point 1) of this article the following working day not later than 3 p.m.
Bank shall submit to the Central Bank daily reports referred to in paragraph 1 points 2) and 3) the following working day not later than 9 a.m. Ten-day Reports Article 3 Bank shall submit to the Central Bank ten day liquidity reports (Form DPL). Bank shall submit to the Central Bank report referred to in paragraph 1 of this article not later then five days following the expiry of the reporting ten-day period. Monthly Reports Article 4 Bank shall submit to the Central Bank the following monthly reports: 1) Report on condition and turnover of the funds at the accounts (Form SRB); 2) Report on information for credit risk monitoring (Form KR); 3) Report on cash and deposit account with depository agencies (Form M- ND); 4) Report on securities held to maturity (Form M-HOV); 5) Report on loans and lease operations (Form M-KL1); 6) Report on past due loans and lease operations (Form M-BSK1); 7) Report on loan structure by purpose (Form M-SKN); 8) Report on loans and lease operations with natural persons (Form M-KFL); 9) Report on deposits (Form M-D); 10) Report on deposits and loans by industries (Form M-DK); 11) Report on borrowings taken (Form M-P); 12) Report on equity investments (Form M-UK); 13) Report on provisions for losses (Form M-RPG); 14) Report on claims and obligations to banks and financial institutions in bankruptcy and liquidation proceedings balance and off balance sheet items (Form M-PSL). 15) Reports on weighted average deposit interest rates (Form KS-PPP); Bank shall submit to the Central Bank the reports referred to in paragraph 1 of this article not later than eight days following the expiry of the reporting monthly period.
Quarterly Reports Article 5 Bank shall submit to the Central Bank the following quarterly reports: 1) Report on bank s own funds (Form SSB); 2) Reports on bank s capital required: - reports on capital required for credit risk (Forms PBA and PVB); - reports on capital required for market risks (Forms OR1, OR2, SR, RPO, RVI, KDR, RDS and RP), and - report on capital required for country risk (Form RZ); 3) Report on bank s solvency ratio (Form KSB); 4) Balance Sheet with the supporting Forms (Forms BS, BS-VB, BS-PR, BS- OA and BS-ST); 5) Income Statement (Form BU); 6) Reports for credit risk monitoring (Forms KA1, KA2, KNA, KI, IAK, LPB, LLI, PKL, VIB, KID, PRK, SKK, SPL, SKN, NDB, NDI and ZPN); 7) Reports on market risk monitoring (Forms DTK, ETK, RVD1, RVD2, RKS and PDV); 8) Reports on liquidity risk monitoring (Forms RU, IP and ND); 9) Reports on shareholders structure of the bank (Forms AB and PLK). Bank shall submit to the Central Bank the reports specified in paragraph 1 of this article shall be submitted no later than 20 days following the expiry of the reporting quarter. Notwithstanding paragraph 2 of this article, bank shall submit to the Central Bank the reports specified in paragraph 1 of this article for the last quarter of the business year based on the final information not later than 15 February of the following year. Annual Report Article 6 Bank shall submit to the Central Bank its annual operating report which shall include, at a minimum, the following: 1) Review and evaluation of operating conditions of the bank; 2) Information on important business events; 3) Information on relations with other legal persons; 4) Information on the Board of Directors performance; 5) Review of organization and personnel;
6) Review and evaluation of the operating performance and financial position; 7) Review of development of investment activities in the following investment period. Bank shall submit to the Central Bank its annual operating report together with the bank s annual financial statements. Article 7 Bank shall inform the Central Bank without delay on any changes occurred in its business policy and strategy. 2.2. Micro-credit Financial Institutions Reports Monthly Reports Article 8 Micro-credit financial institution (hereinafter referred to as MFI) shall submit to the Central Bank the following monthly reports: 1) Report on condition and turnover of the funds at the accounts (Form SRB); 2) Report on information for credit risk monitoring (Form KR); 3) Report on cash and deposit account with depository agencies (Form M- ND); 4) Report on loans and lease operations (Form M-KL1); 5) Report on past due loans and lease operations (Form M-BSK1); 6) Report on loan structure by purpose (Form M-SKN); 7) Report on loans and lease operations with natural persons (Form M-KFL); 8) Report on borrowings taken (Form M-P); 9) Report on provisions for losses (Form M-RPG); 10) Report on loans by industries (Form M-KD). MFI shall submit to the Central Bank the reports referred to in paragraph 1 of this article not later than eight days following the expiry of the reporting monthly period.
Quarterly Reports Article 9 MFI shall submit to the Central Bank the following quarterly reports 1) Balance Sheet (Form BS-MFI with the supporting Forms BS-OA, BS-VB, BS-PR and BS-ST); 2) Income Statement (Form BU-MFI); 3) Report on assets classification and allocated reserves (Form KA-MFI). MFI shall submit to the Central Bank the reports specified in paragraph 1 of this article no later than 20 days following the expiry of the reporting quarter. Notwithstanding paragraph 2 of this article, MFI shall submit to the Central Bank the reports specified in paragraph 1 of this article for the last quarter of the business year based on the final information not later than 15 February of the following year. 3. Reporting Format Article 10 The reports set forth in this decision shall be submitted to the Central Bank using the printing forms enclosed with this decision and making an integral part hereof. The manner of filling out the forms of balance sheet, off balance sheet records and income statement shall be included in the Attachment 1 and shall make an integral part hereof. The Central Bank shall offer guidance and clarification as necessary for filling out the positions in the reporting forms referred to in the paragraph 2 of this Article and other reporting forms in the Decision. Reporting Form Article 11 Bank shall submit reports referred to in this decision in electronic form, and in hard copy upon Central Bank request.
4. Final Provisions Article 12 On the day this decision comes into force, the Decision on Reports that Banks submit to the Central Bank of Montenegro (OGRM 09/04, 25/04, 62/06 and 40/07) and the Instructions on the Content and Format of Reports that MFI submit to the Central Bank of Montenegro (OGRM 70/04 and 40/07) shall cease to be valid. Article 13 This decision shall enter into force on the eighth day following that of its publication in the Official Gazette of Montenegro and shall be applied from 1 st January 2009.
