Hot Air Jubilee Vendor Rules/Regulations July 18-19, 2014 Festival Hours: Friday, July 18th - 4:00PM -11:00PM, Saturday, July 19th 7:00am 11:00PM, FESTIVAL is Rain or Shine. Vendor Hours: Friday, July 18th 4:00PM to Sunset, Saturday, July 19th 7:00AM to Sunset. Note: The balloons will launch early morning (weather permitting), and the general public is invited to participate. Vendors are not required to be open for the morning balloon launches. New Vendors: New vendors must submit photos of items to be sold with the completed application. Photos become the property of the Hot Air Jubilee and will not be returned. Applications: Prior to the event, all vendors are required to submit a signed application, and signed acknowledgement of rules and regulations. Applications must be submitted with payment in full no later then Monday July 1, 2014. Late applications will not be accepted. Applications will not be considered complete until all forms and payment is received. Any vendor who connote confirm to these guidelines will not be accepted. Please note: No refunds will be given. Accepted Promotional/Sale Items: Vendors will not be permitted to giveaway food or beverages, with the exception of samples of food or beverage items for sale. Only items listed on completed application will be permitted to be sold/given away. Booth Size: Booth layout is approximately 12 x 12 Booth Location and Parking Pass; Booth location will be determined when application is accepted. All vendors will be provided two (2) parking passes in the reserved parking area. Additional vehicles must be parked in the designated General Public Parking areas. Any unauthorized vehicles in the vendor area will be towed at the owner s expense. Electricity: If electricity is required, please complete the attached request form and include the cost with the application. Set up Time: Set-up time will be Friday, July 18th from 9:00AM until 3:00PM. All vendors are required to be set up and ready to conduct business no later then 4:00PM when the gated are open to the general public. Tear Down Time: Tear down may be permitted to occur Saturday night after closing with permission. Scheduled tear down time is Sunday morning by 12:00 Noon. NO EARLY TEAR DOWNS PERMITTED WITHOUT PERMISSION. Vendors are responsible for cleaning their area of trash, boxed, etc. These items should be placed in the receptacles provided by the event. A fee will be assessed if a site in left with trash. Initial
Supplies and Equipment: Vendors will supply their own tent, tables, display units, chairs, and etc. and any additional equipment necessary to operate their booth space. Restocking: If necessary, restocking of booth will be permitted on Saturday July 19th starting at 7:00AM, and must be completed no later than 9:00AM. Sales: Vendors are responsible for their own sales. Only one company per booth permitted. Sales Tax: Each vendor selling items must submit a current copy of the Michigan Sales Tax License with the application, and is responsible for submitting all applicable taxes, including sales tax to the proper agencies. No exceptions. Michigan law requires sales tax to be collected on every sale to the consumer. Security: Security is provided to monitor the festival grounds; however, the Grantor is not responsible for any loss or stolen items. Indemnification: The Hot Air Jubilee, Inc. will not be liable for any expense/loss incurred by the vendor and the vendor agrees to indemnity the Hot Air Jubilee, Inc.as additional insured. Certificates must be submitted with the vendor application. Failure to do so will result in a returned application. Insurance: Vendors must provide a valid Certificated of Liability Insurance naming the City of Jackson, Ella Sharp Park, and The Hot Air Jubilee, Inc. as additional insured. Note: Hotels might be booked up around Jackson because of other events going on this weekend, so please book yours as soon as possible. I agree to work in a cooperative manner with the Hot Air Jubilee, Inc. as we all work together for a successful event. RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT ( AGREEMENT ) IN CONSIDERATION of participating in the Jackson Hot Air Jubilee Festival ( Event ), I (Company name/participant) Agree to indemnify, defend and hold harmless the Jackson Hot Air Jubilee Festival Committee, City of Jackson, Ella Sharp Park, Event sponsors, and all others directly associated with the Event and Location at which the Event is conducted, from and against all claims, losses, damages, and expenses Of any nature whatsoever arising from Participant s involvement in the Event. I, as a duly authorized Representative of the Participant, acting with full authority on Participant s behalf, hereby covenant not To sue, release, and discharge the Jackson Hot Air Jubilee Committee, City of Jackson, and Ella Sharp Park, Event sponsors, and all others directly associated with the Event, or their respective Administrators, directors, agents, officers, volunteers, employees, other participants, any sponsors, Advertisers, and if applicable, owners and lessees of the premises on which the Event takes place (Collectively, the Releasers ), from all liability, claims, demands, losses, or damages on my account or That of my agents, employees, or volunteers, caused or alleged to be caused in whole or in part by the Negligence of the Releasers or otherwise. I further agree that if, despite this release, waiver of liability, And assumption of risk, I, or anyone on my behalf or that of my agents and/or employees, makes a Claim against any of the Releasers, I will indemnify, save, and hold harmless each of the Releasers From any loss, liability, damage, and/or cost which may occur as the result of such a claim. Furthermore, I release and discharge the Releasers from all liability, claims, demands, losses, or Damages relating to any claims, demands, losses, or damages relating to any claims by myself, my Agents, employees, or volunteers resulting from injuries, including death, damages, or loss which I or My employees or volunteers may have and/or which may occur due to my participation in any portion Of this Event, and any act, omission, wrongful act, or negligence of Participant or any of Participant s Contractors or subcontractors, or the partners, directors, officers, agents, employees, invitees of Participant or Participant s contractors or subcontractors. I have read this Agreement and understand that I have given up substantial rights by signing it And have signed it freely and without any inducement or assurance of any nature, and I intend This Agreement to completely and unconditionally release the Releasers from all liability as Herein described. I further agree that if any portion of this Agreement is held to be invalid, the Balance, notwithstanding, shall continue in force and effect. Furthermore, I agree to abide by the rules And regulations of the Event and agree to remove any items that the Event deems inappropriate or Potentially dangerous to the public, and I agree to keep Participant s area clean and free of garbage And to completely clean Participant s area at time of departure.
