It has a potential and wide application to buildings, whether in London or elsewhere. But problems remain. To what extent does it create legally enforceable statutory duties? What happens on a change of ownership? How can potential future liabilities be enforced against owners and their successors? How does the exercise of powers under the Act sit with Land Registration? Are surveyors appointed under the Act liable for negligence? Stephen Bickford-Smith, barrister, and Alistair Redler, chartered surveyor, look at some of the current issues.
