MOTION I MOVE that Item No.6 on today's Council Agenda, under C.F. No. 13-0600-S109 relative to sidewalk repair, be substituted with the following: That the Council, subject to the approval of the Mayor: 1. Instruct the City Administrative Officer (CAO) to coordinate, through June 30, 2014, a Citywide response to needed sidewalk repairs by identifying locations of damaged sidewalks abutting City facilities (excluding the Departments of Water and Power, Harbor, Airport, Transportation, and Bureau of Sanitation), and to immediately begin implementing repairs through the Departments of Public Works and Recreation and Parks. 2. Establish the Bureau of Engineering (BOE) as Program Manager with quality control support from the Bureau of Contract Administration (BCA) and authorize the Bureau of Street Services and contractor(s) managed by Recreation and Parks to perform sidewalk repairs adjacent to City facilities through June 30, 2014; 3. Authorize the Controller to: a. Establish a new appropriation account within the Capital Improvement Expenditure Program (CIEP), Fund 100, Department 54, as follows: Account No. XXKXXX Account Name Sidewalk Repair b. Transfer $10,000,000 from the Unappropriated Balance, Fund 100, Department 58, Sidewalk Repairs Account No. 000141, and appropriate therefrom to the CIEP, Fund 100, Department 54 as follows: Account No. XXKXXX Account Name Sidewalk Repair c. Transfer up to $1,500,000 with CAO approval from CIEP,Fund 100, Department 54, Sidewalk Repair Account XXKXXX, to the Department of Recreation and Parks, Fund 302, Department 89, Deferred Maintenance, Account 89704H; 4. APPROVE the sidewalk repair allocation plan contained in the Bureaus of Street Services (BSS), Engineering (BOE), Contract Administration (BCA), City Administrative Officer (CAO) joint report, dated January 15, 2014, attached to the Council file. 2. SELECT Implementation Option No.2, which establishes the BOE as Program Manager with quality control support from the BCA. All construction work will be done by private contractor(s). The BSS will help identify priority locations in the first year of implementation and will coordinate a 50/50 program with property owners, Council Offices, and other stake holders once that program is established. 3. AUTHORIZE the Controller to: a. Establish a new appropriation account within the Capital Improvement Expenditure Program (CIEP), Fund 100, Department 50, as follows: Account I.ill.e. XXXXXX Sidewalk Repair b. Transfer $10,000,000 from the Unappropriated Balance Fund No. 100/58, and appropriate therefrom to the CIEP, Fund No. 100/50 as follows: Account Title XXXXXX Sidewalk Repair c. Authorize the CAO to make recommendations for transfers therefrom in a Financial Status Report or Construction Projects Report, to implement Mayor and Council intentions. 4. INSTRUCT the CAO to report on the feasibility of creating a tax incentive for businesses that proactively undertake sidewalk repair. Fiscal Impact Statement: None submitted by the BSS, BOE, BCA, nor the CAO. The Chief Legislative Analyst has not completed a financial analysis of this report. Community Impact Statement: None submitted. SUMMARY At its meeting of February 6, 2014, the Public Works and Gang Reduction Committee considered the BSS, BOE, BCA, CAO revised joint report relative to a limited sidewalk repair plan. The Bureaus and CAO gave an overview of the issue. During the discussion of the item, the Committee Chair recommended amending the report to include a provision that no less than five percent of the work performed by contractors be awarded to companies that employ at risk youth and young adults, for the BOE to report in six months on the status of this program, and for the CAO to report back on the feasibility of creating a tax incentive for businesses that proactively undertake sidewalk repair. An opportunity for public comment was held. After a thorough discussion of the matter, the Public Works and Gang Reduction Committee moved to approve the recommendations as contained in the BSS, BOE, BCA, and CAO joint report with the amendments as detailed above.

Subsequently, on April 7, 2014, the Budget and Finance Committee also considered this matter. After providing an opportunity for public comment, the Budget and Finance Committee amended the recommendations as contained in the revised the BSS, BOE, BCA, CAO joint report as detailed in the separate Budget and Finance Committee report for this item. This matter is now forwarded to the Council for its consideration. At its meeting of April 7, 2014, the Budget and Finance Committee considered the Bureaus of Street Services, Engineering and Contract Administration and CAO's joint report relative to various actions regarding a limited sidewalk repair plan. The Public Works and Gang Reduction Committee considered the matter on February 6, 2014 and recommended various actions. After providing an opportunity for public comment, the Budget and Finance Committee recessed into closed session to further consider this matter. After returning to open session, the Budget and Finance Committee recommended approval of the revised recommendations detailed above. This matter is now forwarded to the Council for its consideration.
