FILE CODE: GO/4153.1 Sick Time Definition Sick time shall mean absence from work because of an employee's personal disability due to injury or illness, or injury or illness in the {immediate] family, or for an appointment for medical services for an employee or for [an immediate] a family member which only can be scheduled during office hours, or for absence due to the employee s or family member s circumstances resulting from domestic or sexual violence, or where the employee s child s school or place of care has closed due to a public health emergency, or for the employee to attend the child s school function. Sick time is accrued according to the employee s date of hire and applied on the first of the month after completion of a full month worked. Accrued sick time may be taken and paid to the employee, upon their request while on an approved NJ Family Leave (NJFLA) or a Federal Family Medical Leave (FMLA). The Executive Office determines if an employee s absence is a qualifying event for family medical leave purposes. Unused sick time shall not be converted into personal leave hours, partial or full salary, or be included in separation or retirement benefits calculations. Based upon the specific circumstances of the situation, a physician's statement may be required by the Human Resources Director when an employee is absent from work due to an illness. The Human Resources Director may require examination by a physician selected and paid for by the Association. If a staff member is incapacitated by illness and/or requires hospitalization while on vacation, such time may, at the discretion of the Director, Human Resources, be converted to sick time hours upon presentation of a physician's and/or hospital certificate. In case of illness or injury which continues beyond the employee s accrued sick leave, either short-term disability benefit and/or FMLA policies may be applicable. Accrual for [New] Full-Time Employees In the first year of employment, sick time accrues at the rate of 7 hours per month. Accrued sick time is applied on the first day of every month after completion of a full month worked. [Accrual for All Other Employees] In the second year of employment and thereafter, sick time accrues at the rate of 8.75 hours per month to a maximum of 105 hours per fiscal year. Accrued sick time is applied on the first day of every month after completion of a full month worked. If an employee uses less than the number of accrued hours he/she has earned in any fiscal year of service, all accrued hours shall be carried over into the subsequent year. FILE CODE: GO/4153.1R Sick Time Accrual Sick time hours are accrued on a monthly basis and are applied on the first of the month following completion of a full month worked and may only be taken after they are earned. Use of sick time, shall be per request, and may be taken in units of not less than one-half hour per request. During a[n] full-time employee s first year of employment, sick time hours accrue at the rate of 7 hours per month. In the second anniversary year of employment and thereafter, sick time hours accrue at the rate of 8.75 hours per month. Pursuant to NJSA 34:11D-1 et. seq. part-time employees accrue one hour of earned sick leave for every 30 hours worked, up to a maximum of 40 hours of leave per benefit year. An employee may work additional hours to compensate for work missed rather than use earned sick leave, at the discretion of the Executive Director. If the need is foreseeable, seven days advance notice of an employee s intention to use earned sick leave, must be provided. If the need is unforeseeable, notice must be provided as soon as is practical. Notification Employees must notify their supervisor by 9:00 a.m. on each day of any unplanned absence. An employee must contact his/her immediate supervisor directly to report his/her absence. It is not appropriate to leave a message on the answering machine before 9:00 a.m. or after 5:00 p.m. Failure to provide proper notification may result in disciplinary action. Usage When an employee has been absent from work due to personal disability, injury or illness for more than three (3) consecutive work days, he/she is required to submit documentation from a health care provider certifying the medical necessity for the absence and the expected date of return to work. An employee who does not have a return to work date shall keep Human Resources informed on a weekly basis as to the employee s status and ability to return to work. Where the employee has been out on sick leave for more than three (3) consecutive work days, Human Resources will notify the employee that NJSBA is provisionally designating the use of that sick leave as Family Medical Leave, if eligible (running concurrently with sick leave). Sick leave is provided for the reasons stated herein, and may not be used for other purposes. Human Resources may request a doctor s note certifying the medical necessity for an absence. [Employees using sick leave are prohibited from working either in the workplace or at any other location, including the employee s home.] The employee may be required to submit a return to work note from the treating physician prior to reporting back to the workplace.
