Date of Hearing: 08.06.2016 Date of Decision: 08.06.2016 RTI application: O R D E R 1. The appellant filed an RTI application dated 02.09.2013 seeking information regarding list of projects that have been cleared by CCI or PMG, list of projects about which CCI or PMG have made any recommendations to Ministry of Environment and Forest. The CPIO responded on 03.10.2013. The appellant filed first appeal dated 12.10.2013 with the first appellate authority (FAA). The FAA responded on 12.11.2013. The appellant filed a second appeal dated 24.03.2014 with the Commission.

Hearing: 2. The respondent participated in the hearing personally. The appellant participated in the hearing through video conferencing. 3. In the course of the hearing the respondent (CPIO/PMG) stated that they have sent a copy of CIC s hearing notice to the CPIO/Cabinet Committee of Infrastructure (CCI) for his presence in the hearing. 3. The appellant referred to his RTI application dated 02.09.2013 and stated that the respondent has wrongly denied the information u/s 8(1) (d) of the RTI Act. 4. The respondent stated that PMG does not clear any project. The respondent further stated that as and when the nodal Ministry or the State Government resolves all the issues and clear the project, the information shall be made available on the portal. 5. The appellant stated that the respondent has not provided copies of correspondence with Ministry of Environment and Forests regarding clearance of Thermal Power Plants and Hydel Power plants. 6. The respondent (CPIO/PMG) stated that information on para 5 above related to CCI. Discussion/Observations 7. Representative from CCI did not appear in the hearing. Decision: 8. The CPIO/CCI is directed to appear in the next hearing on 27.6.2016 at 1.00 P.M. The CPIO/PMG should also attend the hearing on 27.6.2016 at 1.00 P.M. This is in continuation of earlier order dated 08.06.2016 in the instant matter.

Hearing: 2. In compliance of the order dated 08.06.2016 the CPIO, CCI and the respondent participated in the hearing personally. The appellant participated in the hearing through video conferencing. 3. The appellant stated that the respondent, PMG has wrongly denied the information u/s 8(1) (d) of the RTI Act. The appellant stated that CCI has transferred his RTI application to a large number of concerned ministries but only one ministry has given one page reply to him. The appellant stated that information should be provided to him by the information holding authority. 4. The CPIO, CCI stated that in compliance of the order dated 18.12.2013 of first appellate authority, the appellant s RTI application has been transferred to concerned Ministries/Departments. The CPIO CCI stated that a list of Ministry wise subjects has been provided to the appellant. 6. The CPIO, CCI referred to para 4 of the order of the first appellate authority and reiterated that proposals for consideration of the Cabinet Committee on Investment are moved by the concerned Ministry/Departments as per allocation of business to them. Only the concerned Ministry/Department can decide whether it can provide the desired project specific information or not. The CPIO, CCI stated that a response to the appellant s RTI application has already been given by Ministry of Finance on 08.01.2014, Ministry of Shipping on 23.01.2014, and Ministry of Petroleum & Natural Gas on 07.01.2014. The appellant is free to approach first appellate authority in all the concerned ministries, if he is not satisfied for any reason. Discussion/Observations

6. The action/steps taken by the respondents, including CPIO CCI in dealing with the RTI application are satisfactory. Since the Cabinet Note can be moved only by the concerned Ministry/Department, the respondent has correctly transferred the matter to them, as they are the holder of information. Decision: 7. No intervention is required in the matter at the level of this Commission. The appeal is disposed of. Copy of decision be given free of cost to the parties.
