HOW TO QUALIFY INDIVIDUAL ADVISORS INDIVIDUAL ADVISOR is a person who has a Producer s Agreement with Equitable Life, under which sales credits are allocated to the identifiable, singular Advisor and tracked accordingly. Individual Life and Health insurance and Individual Investment business are counted towards qualification. Conference credits are earned from Individual Insurance and Individual Investment sales settling from January 1, 2012 up to and including year-end December 31, 2012. The following are the minimum qualification requirements: Total Conference Credits for Individual Advisors: 55,000; and, Minimum Settled Policies: 7 (Life and/or Investment policies) 3

HOW CONFERENCE CREDITS ARE AWARDED Both Individual Life & Health insurance products as well as Individual Investment products qualify: Eligible Equitable Life products Individual Life & Health products (including Universal Life, Term, CI, PAR) Individual Investment products (including Segregated Funds, GIAs and Payout Annuities) Conference Credits 1 credit per $1 of NAFYC 0.50 credit per $1 of NAFYC (please note that FundSERV and paper business are treated equally) 4

ELIGIBILITY All invitations to attend this Conference are at the sole discretion of Equitable Life. The Company may decide not to recognize or invite specific individuals, or revoke their invitation, even though they may have met all the qualification criteria to attend. Qualifiers, who are licensed, under contract and in good standing with Equitable Life and who have been invited in accordance with Conference requirements are eligible to attend. Attendance is by invitation only and not a contractual right. Conference guest (spouse or life partner) is the only person permitted to accompany you. Friends, assistants, colleagues, business associates, children or other relatives are not permitted. Children are not allowed at the Conference or on Conference premises for the duration of our Conference. If your Conference credits come from Life or Health insurance business or Segregated Fund business, you must have a persistency index 1 of at least 85% on each of those lines of business at the end of the qualification period. Business settled on your life or your immediate family members is excluded in the last three months of the Conference qualification period. Equitable Life s determination of an immediate family member will apply. Business settled in the last three months of the Conference qualification period must remain inforce at the time of the Conference. You must comply with all provincial and federal regulations, as well as Equitable Life rules and standards of ethics and conduct. Only business submitted under an individual advisor code is eligible. Pooled business or business under joint codes is not eligible. Advisors are solely responsible for disclosing to clients any aspect of participation in Conference qualification or attendance at Conference. If you qualify as an individual advisor to attend the Conference, you must disclose this to your clients. Conference delegates and their guests are subject to approval by Equitable Life. 6

GENERAL RULES 1. Qualification Period is January 1, 2012 to December 31, 2012. 2. Conference Credits are based on net annualized first year commissions (NAFYC) for Individual Life and Health and Individual Investment sales. 3. The number of Conference Credits required to qualify and the allocation of Conference Credits are set out on page 3. 4. For new Individual Life and Health Insurance and Individual Investment sales, Conference Credits are based on Net Settled Business as shown on company-produced statements. 5. Investment NAFYC includes Credits earned on business known as Non-Participating Investment Plans, such as; Segregated Funds, Immediate Annuities, Guaranteed Interest Accounts, RRIFs, and LIFs, etc. 6. For Individual Life cases administered under the Large Case Commission rules, Conference Credits will be allocated in the same manner as commissions are credited to the Advisor s account. 7. Individual Advisors are responsible for disclosing to clients any aspect of their participation in Equitable Life s Leaders Conference qualification and their attendance at Conference, should they attend. 8. Should an Advisor qualify to attend the Conference, attendance of the Advisor and their spouse/life partner is by invitation only from Equitable Life, at Company expense, and is not a contractual right. Invitations are not transferrable, and can be revoked by the Company. 9. Since the purpose of the Conference is to provide a business and networking environment for qualifiers, only spouses or life partners can accompany the Advisor. No assistants, colleagues, business associates, friends, children or other relatives are allowed to attend. 10. Qualifiers must have an active Advisor s agreement with the Company on the date of the Conference. 11. Conference Credits cannot be transferred from one Advisor to another Advisor under any circumstances. 7

GENERAL RULES (cont d) 12. No credits are given for bonuses or overrides. Any chargebacks are deducted from your Conference credits. 13. Meeting the performance qualifications for the Conference makes individual Advisors eligible to receive an invitation to Conference. However, a qualifier who does not attend the Conference will not receive a substitute award in lieu of attending the Conference. As well, the qualifier cannot name a substitute to attend in their place. 14. MGA principals doing business with personal Advisor production are eligible to participate in this Conference as long as they meet the personal advisor minimum production requirements for 55,000 Conference Credits and seven settled cases. 15. Income Tax regulations require that a portion of each attendee s cost to attend the Conference is reportable for tax purposes. As a result, the Company will issue T4A slips for the 2013 tax year. The amount reported will depend on actual costs incurred. 16. Because of tax consequences, children are not permitted at the Conference or on premises at the Conference. Please also refer to rule #9 above. 17. If you are one of our Top 6 Qualifiers based on our Top 6 Qualification categories, you will arrive one day early and participate in activities and meals as a guest of Equitable Life. An Advisor will be eligible to attend for only one category. If an advisor places first in a category more than once, a second place winner for a category will be chosen. Please refer to the Top 6 Qualification rules on page 8. PLEASE NOTE: Equitable Life reserves the right to determine in its sole and absolute discretion, which h Advisors s it will invite to the Conference and if an Advisor s invitation should be cancelled, regardless s of the Advisor satisfying the qualifiication criteria. The refusal or cancellation of an invitation may be for any reason whatsoe oever, including without limitation, compliance or conduct review or investigation, outstanding debt obligations, poor persistency prior to, during or following the qualifyi ifying period, Producer Agreement not in good standing, non compliance with legislation or Equitable Life rules and standards of ethics and conduct, or it would, in Equitable Life s sole and absolute discretion, be inappropriate for the Advisor to attend the Conference. 8

PUBLICATION OF RESULTS During the qualification period, Equitable Life will provide an individual standings letter to advisors who have achieved 50% of the qualification requirements. Standings will be published and provided on a monthly basis beginning with the March 31, 2012 results. As part of the final Conference materials, qualifier standings will be published without credit totals. By accepting an invitation from Equitable Life to attend the Conference, you grant Equitable Life the right to publish your name, province of residence and MGA association in Conference materials, in standings order and to recognize you as a Top Performer or Top 6 Qualifier, if applicable. During the qualification period, Equitable Life will provide monthly online individual credit standings. Advisors can logon to EquiNet, Equitable Life s Advisor s site www.equitable.ca/advisorhome. Final qualifiers will be notified with an invitation to attend from Equitable Life. MGA offices will be provided a final list of qualifiers from their respective offices. After you logon, click on the Leaders Conference ad or select On-Line Tools and Information/ Conferences and click on the link for San Francisco. 9

RECORDS ATTENDANCE All records with respect to qualification are maintained by Equitable Life at its Head Office and are deemed to be accurate and conclusive. All decisions made by Equitable Life will be final and binding. The Conference is an optional event and attendance at our Conference is not mandatory if you qualify for an invitation. If you do choose to attend our Conference, you must be prepared to: Book your travel arrangements (to be reimbursed by Equitable Life). Accept the accommodation arranged for you by Equitable Life. Extensions are permitted but based on hotel availability. Attend all Conference events, activities and business sessions. 10

ONCE YOU VE QUALIFIED WHO IS INVITED TO THE CONFERENCE? Those Advisors who have satisfied the qualification criteria, and their spouse/life partner ( Spouse ), subject to Equitable Life s discretion as noted above. Your Conference companion must be your Spouse and is the only person permitted to accompany you. The Conference has a business focus, and therefore, children are not permitted to attend the Conference or to stay at the Conference hotel during the Conference dates. Once you have qualified, your attendance and that of your Spouse is by invitation only from Equitable Life and is not a contractual right. Since the purpose of the Conference is to provide a business and networking environment for qualifiers and their Spouses who contributed to their success, no substitutions will be allowed. Where there is no Spouse or the Spouse cannot attend, no others can attend on their behalf. This includes assistants, colleagues, business associates, friends, children or other relatives. Equitable Life reserves the right to restrict the Advisor and their companion from attending any activity associated with the Conference, if this criterion is not met. In such case, the Advisor and their Spouse will be responsible for payment of all costs and expenses associated with their attendance at the Hotel premises and all transportation to and from the Hotel. Equitable Life will not pay or reimburse the Advisor and their Spouse for such costs and expenses. 11

CONTINUING EDUCATION CREDITS TAXATION By participating in Conference business sessions, you may be eligible for continuing education credits. Equitable Life will pay for authorized transportation, accommodation, and all organized Conference functions. Following the Conference, a T4A will be issued to you based on these Conference expenses for you and your spouse that include air and ground transportation, accommodation, meals, cash allowances or any other prizes or benefits. A letter will be provided that details the taxable benefit breakdown, including the basic Conference attendance. Equitable Life reserves the right to amend the rules, requirements, terms or conditions set out in this document at any time. Should a matter arise which is not addressed in this document, the decision of Equitable Life shall be final. NOTE: 1 Persistency index measures the probability that $1 of premium income will stay inforc orce for at least 24 months. Included in the calculation are all individual life and health coverages and segregateded funds issued during the preceding eding 24 months and any terminations occurring in the past 12 months. Coverages use annualized prem remium m and case count as the basis. s. Investment riders and excess premiums are excluded, as well as involuntary claims such as death claims and critical illness claims, term conversions, maturities and expiries, premium waiver, rescinded and not taken policies.
