ORDINANCE # AN ORDINANCE OF THE CITY OF FERNDALE WASHINGTON, SETTING RATES AND FREQUENCY OF BILLINGS FOR WATER AND SEWER SERVICE AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH. WHEREAS, it is necessary to amend the City s billing rates and procedures relating to utility taxes in order to comply with new requirements set forth by the Washington State Auditor; NOW THEREFORE, The City Council of the City of Ferndale do ordain as Ordinance 1801 is amended to read: Section 1. The following rate schedule for water and sewer service is hereby adopted effective with bills mailed approximately December 31, 2013: 2015. Section 1. A. Commercial/Industrial Effluent: Commercial/Industrial users contributing effluent which might be expected to impact the system to a greater degree than normal may be required to provide an industrial waste study from which an equitable rate may be established. Out of City Customers: Customers outside the corporate limits of the City of Ferndale shall pay the rates shown in the above schedule, together with a surcharge of 50% to be applied to both the base fee and use charge. Summer Use: When the use of water is such that a portion does not flow into the sewer system due to irrigation by single family residences and duplexes during the irrigation season, which is hereby defined as that billing period beginning approximately June 15 and ending approximately October 15, the maximum chargeable water entering the sewer system during a Bi-Monthly billing period shall be based upon the average for the previous four billing periods. The average may be based upon a lesser number of billing periods if reliable data is not available. If reliable data can not be obtained for at least two billing periods the average chargeable shall be the City-wide average. Section 1. D. Sewer Service CPI Adjustment An annual CPI adjustment for bi-monthly rates shall occur on June 30 th annually as All rates increase (no decreases) by 150% of the Seattle CPI-W, change from April to April of the current year. Section 2. Repeal of Ordinances in conflict. All Ordinances in conflict hereof are hereby repealed. 15

ORDINANCE NO. AN ORDINANCE OF THE FERNDALE CITY COUNCIL AMENDING STORM DRAINAGE SERVICE RATES AS DESCRIBED IN FERNDALE MUNICIPAL CODE 13.40 AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH WHEREAS, the City of Ferndale charges a Stormwater Utility fee necessary to pay for the ongoing expenses related to the City s Stormwater Capital Improvement Program; and WHEREAS, it is necessary to amend the City s billing rates and procedures relating to utility taxes in order to comply with new requirements set forth by the Washington State Auditor; NOW THEREFORE, the City Council of the City of Ferndale do ordain as Section 1: FMC Chapter 13.40 Storm Drainage, is amended as 13.40.070 Rates Methodology ERU. A baseline standard residential storm drainage fee equaling $11 per month is imposed for billings mailed December 31, 2014 (see rates FMC 13.40.080). This equivalent residential unit (ERU) fee is based on the assumption that the average single-family lot equals approximately 10,000 square feet. Modifications to this baseline fee shall be effective and imposed with the December 31 billings mailed the prior year as A 9% utility tax is included in rates. 2016: $12 $13.08 per month 2017: $13 $14.17 per month 2018: $14 $15.26 per month 2019: An annual CPI adjustment for bi-monthly rates shall occur on December 31 st annually as All rates increase (no decreases) by 100% of the Seattle CPI-W, change from October to October of the current year. 17

The fees for other customers classifications shall use this 10,000-squarefoot ERU baseline as the basis for the calculation of the fee. 13.40.080 Rates Fee calculation. The following ERU-derived fees shall apply. The derived ERU-based fees shall be calculated out to two decimal points and in no case shall the ERU-based fee be less than the baseline ERU fee pursuant to 13.40.070. Rates: Class 1 Customers includes all single-family residential units and all multifamily and condominium units with one or two units (up to duplex). Class 1 Fee equals baseline ERU fee pursuant to 13.40.070. Class 2 Customers includes all multifamily units and condominiums with three or more units. Class 2 Fee equals 50 percent of the Class 1 fees on a per-unit basis. Class 3 Customers includes all commercial and industrial customers. Class 3 Fee is calculated based on one of two options as Option 1: The baseline ERU fee, pursuant to 13.40.070, per month for every 10,000 square feet of land area. Option 2: Two-hundred percent of the baseline ERU fee, pursuant to 13.40.070, per month for every 10,000 square feet of impervious surface. Class 4 Customers includes all public-use customers (schools, hospitals, churches, government buildings, etc.). Class 4 Fee is calculated based on one of two options as Option 1: The baseline ERU fee, pursuant to 13.40.070, per month for every 10,000 square feet of land area. Option 2: Two-hundred percent of the baseline ERU fee, pursuant to 13.40.070, per month for every 10,000 square feet of impervious surface. Class 5 Customers includes all mixed use structures. Class 5 Fee equals the baseline ERU fee, pursuant to 13.40.070, per month per commercial unit for every 10,000 square feet of land area and the baseline ERU fee, 18

pursuant to 13.40.070, per month for every residential unit. However, should there be more than two residential units, the fee shall be 50 percent of the Class 1 fees on a per-unit basis.
