ANNEXURE II GENERAL CONDITIONS 1. The Kendriya Vihar Complex built by the Central Government Employees Welfare Housing Organization consists of 603 residential flats in 8 Blocks with diesel generator and pump rooms, Community Centre, parks, sewage treatment plants etc. The required facilities at the complex are provided and managed by the Kendriya Vihar Apartment Owners Association (KVAOA), also termed as Owner hereinafter in this document, through its Management Committee of elected Representatives/ Members. 2. The KVAOA desires to invite tenders for the Maintenance of Passenger Lifts Make Olympus/Bharat Bijilee (also used to ferry limited extent of cargo, in the nature of personal belongings or baggage of the residents) at the complex for the period of January 1, 2017 to December 31, 2017. The contract will be taken on a AS IS WHERE IS basis. 3. The successful bidder shall adhere to the following conditions of contract. 4. The contract shall remain valid for a period of 12 months from January 1, 2016 till December 31, 2016 and the Owner (KVAOA), at its discretion, reserves the right to extend the contract for a further period of one year under the same terms and conditions. 5. The scope of work of this contract is maintenance of 16 numbers of Olympus Make Lifts, each with a passenger capacity of 8 or a total weight of 544 kgs at Kendriya Vihar complex, Yelahanka, Bangalore 560064 as per details given in this tender document. 6. The Contractor should quote as a lump sum for operation and maintenance of 16 numbers of Olympus Lifts installed in the eight different blocks of Kendriya Vihar complex, namely A1, B2, B3, B4, D5, D6, C7 and C8 as indicated in Annexure 1. The Contractor will arrange for the services enumerated in this contract by employing/ deploying sufficient number of qualified and experienced electricians/technicians/mechanics, in order to provide efficient and satisfactory services. The age of any of the employees should not be less than 18 years. 7. The Mechanics should be suitably trained and qualified and conversant with Bharat Bijlee/Olympus make Lifts. Minimum of two mechanics should work together all times for safety. They will attend Kendriya Vihar on daily basis during day time and check the performance of all the lifts and repair wherever necessary. 8. The tender is for the comprehensive maintenance of Lifts and the rates must include the cost with Octroi, excise duty sales tax or similar taxes and cesses, duties, overheads and profit etc. of all components replaced due to malfunction, ageing, wear and tear. The rates also include periodical greasing and lubrication of all equipment and accessories. Any increase or decrease of all taxes and duties is also payable by the Contractor only. 9. The rates quoted shall also include for all provision of labour regulation/statutes promulgated by the Central/state government. The rates quoted shall be deemed to include annual safety inspection and submission of fitness certificate to the President, KVAOA, in the prescribed format approved by the Competent Authority. - 5 -
10. Cost of replacement of spares will be borne by the Contractor. Nothing extra shall be admissible. Spare parts for replacement shall be generally of the same make as those already used on the lifts or they should be suitable for M/S Bharat Bijlee/Olympus make lifts for their smooth operation. No repaired or reconditioned part shall be used. 11. Separate log book for maintenance of each lift should be maintained and produced to the persons nominated by the Owner for inspection at any time called for. Various maintenance operations, inspections, testing and change of spares, etc, carried out on each lift should be recorded in the respective log books. A copy of all the details of the above works carried out during the month should be enclosed with the monthly bill presented for payment 12. No equipment and tools shall be supplied by the Owner. 13. The Contractor shall provide identity badges issued by the Owner to the Contractor s staff. The identity badges shall be handed back to the Owner when no more required for any personnel on or after completion of contract. 14. All personnel and their bags and baggage connected with the contract shall be liable for a physical check both at the time of entry into the campus and passing out of the complex at the Security Gate. 15. Any theft or breakages caused by the Contractor s personnel shall be borne by the Contractor. The Contractor will not allow or permit the workers to participate in any trade union activities or agitation inside the premises of the Owner. 16. Promulgation on restricted area imposed by users that is the Owner shall be followed. The movement of the maintenance personnel shall be limited to the particular building(s) and they shall not trespass to the surrounding building(s)/ flats for any reason. They shall not be under influence of alcoholic drinks while on duty. Contractor shall provide the Dos and Don ts and other precautions to be taken by the operational staff. 17. Contractor should provide 2 Lift attendants (one in day, one in the night) to take care of the up keep of the lifts and ensure cleanliness of the cabins and lift pits at all times and attend emergency requirements. They should maintain a log of problems faced during their period and inform the office and Contractor for immediate action. 18. Contractor s authorized service personnel/ representatives (separate from Lift Attendants) shall be posted in the Kendriya Vihar Complex, every day from 9 am to 5 pm on all working days to keep watch on the satisfactory working of lifts. They shall also clean, oil, grease/lubricate or adjust all those parts, where such services are necessary for smooth operation of all lifts. For this purpose the Contractor shall supply the required oil, grease, cotton waste, etc. Contractor shall take care to ensure that the lift equipments remain in proper and safe operating conditions all times. The rate to be quoted shall be inclusive of all the above. 19. A periodic Preventive maintenance/service should be organized and record of the service details should be available with KVAOA. Any failure as per schedule will be penalized. 20. For all emergency calls, minor adjustments, recall of the workers for attending to emergencies, beyond regular hours of working by concerned staff to set the lifts in operation shall be the responsibility of the contractor. - 6 -
21. If the attendance of any worker falls short, an amount equal to one day for each day of absence shall be deducted from the monthly bills. Similarly, if the work is found unsatisfactory and below the expected standards in a particular area or areas, proportionate charges determined by the President of the Association will be deducted from the contractor s monthly bill. The amount so deducted shall be final. 22. The contractor shall be responsible to conduct surprise checks of his staff meant for the above services and also for their punctuality, behavior and availability. 23. In case of exigencies of services the Contractor s personnel may be required at times on a holiday and Sunday for which advance notice of 24 hours will be given to the Contractor and payment will be made as per applicable rate. 24. The Contractor shall not be entitled to any additional payment during the tenure of the contract except on account of revision of minimum wages. In the event of revision of minimum wages to workers/supervisors, it shall be paid by the Owner through Contractor as per rules. 25. Contractor shall send the maintenance personnel to the site as quickly as possible during the non-working hours and/or on public holidays, on receipt of information from any Resident/ Security and other staff, in case of any breakdown, or mal-functioning in working of the lifts and get the lifts in satisfactory operative condition as quickly as possible. 26. The Contractor shall arrange to keep the lift machine rooms and lift shafts and pit clean at all times. 27. In all matters regarding satisfactory working of the Lifts, the decision of the President KVAOA, Yelahanka shall be final and binding on the Contractor. 28. A penalty amount calculated at double the proportionate rate worked out on the basis of the rate quoted for the number of days of non-working condition of the lifts as intimated to the contractor by the Owner, and the penalty amount will be deducted from the amounts due to be released to the contractor. 29. Payment will be made in the first week of the succeeding month. Necessary deductions on account of TDS in respect of the Income tax, or any other charges imposed by the government from time to time, and as per rules will be effected from the amounts to be released to the contractor. 30. The Contractor shall comply with provision of the payment of Wages Act 1934, Minimum Wages Act 1948, employment Liability Act, 1938, Workmen s Compensation Act, 1923, Factory Act 1948, Maternity Benefits Act 1961, and similar other Statutes promulgated by the Central or the State government of Karnataka, or such modifications thereof and the rules made there under from time to time. The responsibility for total compliance of various statutes, Rules, Guidelines rests completely with the Contractor. 31. The Contractor will obtain PF and ESI numbers from the authorities concerned, if not already obtained, and remit the required amounts in time as per the statutory provisions. In case the payment towards, PF (if applicable), ESI are not remitted to the authorities in respect of all labourers or staff employed including such additional labourers as applicable and documentary proof to this effect is submitted to the Owner by 15 th of the following month, payment towards such statutory charges will be withheld by the Owner and the payment made for the previous month on this account will be recovered from the Contractor s bill. - 7 -
32. The Contractor is presumed to have obtained a valid license under the Contract Labour Act (R&A) 1970 and rules framed there under and should be in possession of such license before the commencement of the work and continue to hold it till the completion of the contract. 33. Storage space will be allotted to the Contractor for stocking of tools and implements for use inside the complex. 34. The Contractor shall maintain requisite documents, registers or records as required by the Labour Authorities and make these available for inspection at any time as required by such authorities. 35. The Contractor on receiving any complaint shall attend to it promptly and complete the job to the full satisfaction of the Owner. The Contractor will ensure maintenance of a Block wise complaint register indicating that the nature of the complaint, time complaint received & time rectified etc. The Contractor shall ensure the down time for each of the sixteen lifts is kept less than 5% of the total time failing which the services are liable to be treated as unsatisfactory thereby calling for invocation of appropriate penal provisions including withholding of proportionate amount of monthly contractual payment. 36. In case of failure on the part of the Contractor to provide workers on any working day, the Owner can have the option to engage workers and pay their wages from the monthly contractual amount without any reference or recourse at the expense of the Contractor. 37. The agreement shall be liable for termination on giving one-months notice by either side. During the period of notice both the parties shall continue to discharge their duties and obligations notwithstanding the above. In case the services provided by the contractor are not satisfactory or if irregular services are provided even after two written intimations, it will be open to the owner to terminate the contract without any further notice and in such an event the Contractor is liable to pay all incidental expenditure including the expenditure involved in maintaining the services continued during the interim period till new contract is finalized and in the event of default the owner is at liberty to make necessary deduction in this regard from the Security deposit held. 38. The Contractor shall submit his bill on the first working day of each month. No advance payment will be made. The Owner shall pay the amount of monthly bill by cheque in the name of the firm. The Contractor will have to bear the full responsibility for regular payment of wages to his personnel. The disbursement of wages by the Contractor shall be made inside the complex in the presence of the representatives of the Owner. The Contractor shall visit Kendriya Vihar complex in person at least once a month and meet the President or Vice President or the Secretary for general appraisal. 39. Notice showing rates of wages, hours of work etc., shall be submitted to the Office of the Labour Enforcement Officer (Central), Bangalore under intimation to the Owner and the same shall be displayed on the Notice Board within 7 days from the day of concluding the contract agreement. 40. If the work is found unsatisfactory in a particular period being sub-standard, an amount, which the Owner determines shall be deducted from the Contractor s bill. The decision of the owner in this regard shall be final. 41. The Owner shall not be responsible for any injury or loss of life of any workers of the Contractor that may take place while on work. Any compensation or expenditure towards treatment for such injury or loss of life shall be the sole responsibility of the Contractor. - 8 -
RISK & COST 42. In case the services provided by the Contractor are not satisfactory or is irregular, and continue to be unsatisfactory, even after written intimation, it will be open to the Owner to terminate the contract without any further notice, as brought out in clause of the General Conditions, and the Owner will be at liberty to go in for a fresh contract with any other party at the risk and cost of the Contractor ARBITRATION 43. If any dispute arises and persists between the Contractor and Owner, the same shall be referred to a sole Arbitrator to be appointed on mutual consent by the Owner and the Contractor, whose award shall be final and binding on both the parties. The Arbitrator shall submit his award within one month of his receiving the reference. The period may be extended by the Arbitrator with the consent of the parties subject to this not exceeding 3months. Such reference shall not take place by either party until the physical completion or alleged completion of works or termination or determination of the contract referred to herein before. 44. The Contractor shall execute an Agreement with the KVAOA on a stamp Paper of Rs. 50 (Rupees Fifty only) incorporating the conditions and Rate Schedule of the Tender document. 45. The Earnest Money (EMD) remitted along with the tender offer will be retained by the KVAOA in case of the accepted Tenderer and adjusted against the Security Deposit of Rs. 10,000 payable by the Contractor to the Owner. The entire Security Deposit will be refunded on completion of the contracted period. The contractor is liable for forfeiture of Security Deposit amount in the event of unsatisfactory performance and also in the event of invoking the contract termination clause. 46. In addition, the Contractor should accept such other conditions as mutually agreed upon between KVAOA and the Contractor, at the time of entering into the contract. - 9 -
SPECIAL TERMS AND CONDITIONS FOR LIFTS MAINTENANCE CONTRACT - 10 - ANNEXURE III The successful bidder shall adhere to the following conditions of the contract. 1. During the contract period, the Contractor shall repair or replace with new genuine parts and materials free of cost for comprehensive maintenance of the lifts as a result of normal wear and tear. The contract excludes maintenance of lighting, fans, batteries of the Alarm systems, flooring, walls and other equipment inside the lift cage but includes maintenance/repair/replacement of parts like Machine and Controller electronic printed circuit cards, digital electronic components, electromagnetic relays, control transformers, indication lights, control and power fuses, isolating switches, limit switches, sensors, worms, gears, pulleys, thrust bearings, brake magnet coils, brake shoes, brushes, windings, commentators, rotating elements, contactors, resistors, hoisting motor and other mechanical parts such as guide shoes, cables, ropes, floor selector parts, door locks and any other component used in the design of the lifts by the manufacturer. 2. Separate log book for maintenance of each lift should be maintained and produced to the persons nominated by the Owner for inspection at any time called for. Various maintenance operations, inspections, testing and change of spares, etc, carried out on each lift should be recorded in the respective log books. A copy of all the details of the above works carried out during the month should be enclosed with the monthly bill presented for payment. 3. For all emergency calls, minor adjustments, recall of the workers for attending to emergencies beyond regular hours of working by concerned staff to set the lifts in operation shall be the responsibility of the contractor. 4. Providing manpower for cleaning of lifts cars (16 Nos) and to attend emergency calls of passengers in the lift car and also for some basic repairs until a proper Lift Mechanic attends to the problem. They should be available on 24/7 basis in two shifts. 5. Contractor shall send the maintenance personnel to the site as quickly as possible during the non-working hours and/or on public holidays, on receipt of information from any Resident/KVAOA Member/ Security and other staff, in case of any breakdown or mal-functioning in working of the lifts and get the lifts in satisfactory operating condition as quickly as possible. In any residential block, both lifts should be available all the time. In case of emergency, one lift should be available all the time and the unavailable lift should be restored to service within 6 (six) hours. 6. Penalty amount (s) calculated at double the proportionate rate, worked out on the basis of the rate quoted by you per lift per day basis (worked out on computation), for the total number of days of non-working condition of the lift(s) as intimated to the contractor by the Owner will be deducted from the amounts due to be released to the contractor. The decision of President of KVAOA on imposition of such penalties is final and binding on the Contractor. Regular records of log entries of preventive and breakdown maintenance activities carried out by the technicians shall be entered day by day basis in a register for routine monitoring and countersigning by the maintenance supervisor. The records should be available for inspection by KVAOA at anytime. Breakdown reports should clearly show the date and time of starting of unavailability of the lift and date and time of restoration to service and major activities carried out in between.
7. The Contractor will ensure that the breakdown of any of the 16 lifts in KV Complex is attended within four hours. In case both the lifts of a particular block breakdown at the same time (Simultaneously), the contractor will ensure that at least one of the lift is made functional within one hour, so that passengers can use it. 8. The contractor shall be responsible for training the technicians on normal and emergency operations of the lifts, technical aspects on maintenance procedures of electrical/electronic/mechanical components, counseling the occupants of lifts in emergency situations and evacuating them in a peaceful and correct manner without causing panic in such situations. 9. No equipment and tools shall be supplied by the Owner. 10.
