Full Terms & Conditions Brew & A - Ask a Question Promotion 1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid. 2. Entry is open to residents of Australia who are 18 years and over. Employees and their immediate families of the Promoter, its agencies and venues/outlets associated with this promotion are ineligible to enter. 3. The promotion commences at 12.00 AEDT on 7/03/2016 and closes at 23.59 AEST on 3/07/2016 ( Promotional Period ). 4. To enter: (a) (b) (c) visit www.beerthebeautifultruth.com and access the online entry form for the Brew & A: Ask a Question promotion; enter your question you wish to ask relating to beer in 25 words or less; and fully complete all sections of the online entry form (including first name, last name, address, email address, date of birth and mobile number) and submit the form during the Promotional Period. 5. Limit applies of one (1) entry per person per day and one (1) Minor Prize per person. 6. This competition is a game of skill. Chance plays no part in determining the winner(s). All entries will be judged individually on their merits based on creativity and eloquence of question, appropriateness of the question being asked, the question having sufficient detail within it to allow an interesting answer to be created and if the question or its components can be tailored to deliver an engaging and marketable response in the eye of the general public. The best entry each week, as determined by the judges in accordance with these judging criteria, will each receive a Minor Prize. The best entry overall, as determined by the judges, will receive the Major Prize. Minor Prizes: 7. Entrants will be eligible to win a minor prize on a weekly basis. At the time and dates specified in the table below, the entries submitted during the week up until midday on the day of judging will be judged. All weekly judging will take place at Lion, Level 7, 68 York St, Sydney, NSW, 2000, Australia. Entries will be judged by a panel of judges appointed by the Promoter. Minor Prize consists of one (1) Gift Card to the value of AU$100. The value is redeemable in Australia and overseas where MasterCard is accepted. See Coles Financial Services Terms and Conditions for exclusions. Total RRP value of all Minor Prizes = AU$1700. All taxes (excluding GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner. Prizes will be delivered to winners within seven (7) days of the winner being notified, subject to any delivery or processing delays. Winners will be notified of any delay. 9. Winners will be notified by telephone and email within two (2) days of the relevant judging. Winner must accept the prize by return email within seven (7) days of notification in order to accept the prize. 10. If any Minor Prize remains unclaimed in accordance with clause 10 or is otherwise forfeited despite the Promoter making all reasonable efforts to notify the winner, the Promoter may deem any winner as ineligible to receive the prize. In that event, the Promoter will reconvene the judges on 2 August 2016 at the same time and place as the first judging in order to distribute any unclaimed prizes. The next best entry based on the set criteria will be deemed the replacement winner. Major Prize: 11. All valid Minor Prize entries will also be eligible for the Major Prize. determined by the judges, will receive the Major Prize. 12. Judging for the Major Prize will take place at 3pm AEST on 12 July 2016 at Lion, Level 7, 68 York St, Sydney, NSW, 2000, Australia. Entries will be judged by a panel of judges appointed by the Promoter. 13. Major Prize consists of a trip for the winner and one (1) guest to Brussels, Belgium, including: (d) (e) return economy class airfares for two (2) adults (including all airline and airport taxes) from the winner's nearest Australian Capital city to Brussels, Belgium (RRP = up to AU $7600); return private transfers for two (2) adults from Brussels airport to accommodation (RRP = up to AU$600); (f) seven (7) nights 4 star accommodation twin share for two (2) adults in a 4 Star (*) hotel in Brussels (including breakfast daily), (RRP = up to AU$3900); (g) (h) (i) (j) forty-eight (48) hour hop -on-hop-off city bus tour for two (2) adults (RRP = up to AU$200); gourmet dinner for two (2) people at the iconic Brussels restaurant Comme Chez Soi up to the value of p to AU$500; sightseeing tour with a private guide in Luxembourg for two (2) people including transfers (RRP = up to AU$1900); and AU$1,500 spending money in the form of cash is payable to the winner s nominated bank account via electronic funds transfer. Total RRP value of the Major Prize = up to AU$16,200. 14. Travel must be completed between 31 August 2016 and 07 September 2016. The Promoter takes no responsibility for any variations in value of a Major Prize. 15. There is one (1) Major Prize to be won. Major Prize is valued at up to RRP AU$16,200 (depending on point of departure). All other ancillary costs including but not limited to insurance, taxes (excluding GST), meals (unless specified above), drinks, transfers (unless specified above), activities, incidentals, passports, transport to and from departure point, additional spending money, any applicable insurance including excesses, and any and all other expenses which may be payable as a consequence of receiving a prize are the sole responsibility of the winner and his/her nominated guest. 16. Prize winner and his/her guest must be Australian residents aged 18 years and over. 17. All travel arrangements must be must be made by the prize winner through Free2Travel Holidays Pty Ltd or its agents by 31 July 2016. 18. It is a condition of accepting the Major Prize that the winner and their guest arrange at their own expense valid travel insurance with the highest available coverage for their period of travel that includes medivac and emergency relocation cover. 19. The Major Prize is a single trip for the winner and his/her guest and cannot be separated into separate trips or components. The winner and his/her guest must depart from and return to the same departure point and travel together.
20. Major Prize winner will be notified by telephone and email within two (2) days of the judging, and their name and suburb published in The Australian on 22 July 2016. Winner must accept the prize by return email no later than seven (7) days from 12 July 2016 in order to accept the Major Prize. 21. All travel is subject to availability at all times and may be dependent on select seat class with airlines or specific room category availability with accommodation partner. Travel must be completed between 31 August 2016 and 07 September 2016. 22. Before the Major Prize is awarded, the winner and their guest will be required to: (k) (l) sign an agreement to release the Promoter from, and indemnify the Promoter against, any loss, damage or injury arising from the use or participation in the prize, except to the extent any loss, damage or injury is due to the negligence or willful misconduct of the Promoter; and provide evidence of valid travel insurance with the highest available coverage for their period of travel. 23. Major Prize Winner and their guest may also be required to provide a credit card imprint at check-in to the accommodation that will be used to charge for incidentals (such as optional activities) and/or as a bond in case of damage to the property. 24. Accommodation and flight arrangements, including suppliers, will be determined by the Promoter in its sole discretion. The Promoter may refuse any requested changes, and will not accept any request made within 24 days before departure. If any requested change is accepted by the Promoter, change fees may be applicable. 25. If the Major Prize remains unclaimed in accordance with clause 21 or is otherwise forfeited despite the Promoter making all reasonable efforts to notify the winner, the Promoter may deem any winner as ineligible to receive the prize. In that event, the Promoter will reconvene the judges on 2 August 2016 at the same time and place as the first judging in order to distribute any unclaimed Major Prize. The next best entry based on the set criteria, as determined in the discretion of the judges, will be deemed the replacement winner. General: 26. Total RRP of all prizes = up to AU$17,900: 27. Prizes are not transferable and are not redeemable for cash. The judges decision is final and binding - no correspondence will be entered into. 28. To the extent permitted by law, the Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury in connection with the conduct of the promotion whether as a result of: (m) (n) technical or telecommunications problems, including security breaches, technical website malfunctions or glitches; or acts or omissions (including negligent acts of omissions) of the Promoter's servants or agents involved in the conduct of this promotion. In the event of such problems or conduct, the Promoter may modify, cancel, terminate or suspend the promotion.
29. If any prize or any element of a prize becomes unavailable for reasons beyond the Promoter's control, or is unable to be delivered to a winner's address, the Promoter may substitute a prize or element of a prize of equal or greater value at the Promoter s sole discretion, subject to any written directions from the relevant authorities. Winners will not be entitled to any additional compensation in the event that the prize or element of a prize has been substituted at equal or greater value. 30. The Promoter reserves the right to request verification of age, identity, residential address and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. 31. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or is otherwise involved in any conduct that involves manipulating, interfering or tampering with this promotion or otherwise preventing the conduct of the promotion as intended by the Promoter. In the event of such problems or conduct, then the Promoter may (where necessary with approval from the relevant lottery authority) modify, cancel, terminate or suspend the promotion. 32. The Minor Prize is subject to the terms and conditions of Coles Gift MasterCard and Coles Financial Services Pty Ltd (ABN 94 169 156 165) and the Major Prize is subject to the terms and conditions of third party prize suppliers including airlines, transfer company, accommodation and any other third party prize suppliers (all "Third Party Prize Suppliers"), including the booking and reservation policies of Third Party Prize Suppliers. 33. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner and or guest as a result of the conduct of any Third Party Prize Suppliers, or otherwise as a result of the winner accepting and/or using any prize offered in this promotion, except for any loss, damage or injury which is due to the negligence or willful misconduct of the Promoter or which otherwise cannot be excluded by law. 34. Entrants agree that the Promoter has a royalty free, perpetual licence to use, reproduce, edit, communicate to the public, and adapt all material provided to the Promoter as part of the promotion (including the question being submitted on or in connection with any media) (together "the Content"), on or in connection with any media. Winners agree to sign any further documentation required by the Promoter to give effect to this arrangement as a precondition to being awarded their prize. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry. 35. Entrants further warrant and agree that: a. they will not submit any Content that is unlawful, defamatory, obscene, derogatory, pornographic, sexually inappropriate, politically incorrect, violent, abusive, harassing, threatening, racist, ageist, sexist, objectionable with respect to religion, origin or gender, unsuitable for persons under the age of 18 years, or otherwise unsuitable for publication; b. all of the Content has been personally created by them, and does not breach any intellectual property, privacy, publicity or other rights of any third party; c. they have full authority to grant the Promoter the rights referred to in these Terms & Conditions; and
d. they will indemnify the Promoter against all loss, damage and liabilities arising from a breach of any of the warranties in these Terms & Conditions. 36. Any personal property rights in entries are owned by the Promoter. Details from entries will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants content to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter's privacy policy by contacting the Promoter on 1800 308 388 during office hours. 37. Entries will be deemed accepted at the time of transmission if all mandatory fields are completed. In any dispute relating to whether entries have been received or not will be determined by the Promoter, whose decision is final. 38. Any entry that contains content that the Promoter, in its sole discretion, considers to be incomplete, inaccurate, underage, erroneous, ineligible, offensive, misleading, inappropriate or incomprehensible will be deemed invalid, as well as any entry that the Promoter, in its sole discretion, considers to infringe any intellectual property rights or other rights of any person, corporation or entity. 39. The Promoter may, in its sole discretion, determine whether any of the Content will be posted or remain posted on its websites. The Promoter reserves the right to vet or remove Content from its websites at any time, without prior notice and in its sole discretion (including if properly notified that such Content infringes any third party intellectual property rights). Notwithstanding any decision by the Promoter to post any of the Content on its websites, the terms and warranties set out in these Terms & Conditions continue to apply. 40. Entrants consent to the Promoter using their name, image, entry, and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter. 41. Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party. Further, entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and licence to use and modify their entry for the purposes of the Promoter s business without the payment of any further fee or compensation. The entrant agrees to sign any further documentation required by the Promoter to give effect to this arrangement as a precondition to being awarded their prize. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry. 42. Entrants will be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any relevant laws, codes or policies including those of the relevant liquor licensee relating to the responsible service of alcohol.
