UAE to Finish Corporate Tax, VAT Laws Draft this Quarter DUBAI - The UAE, seeking to bolster state revenues, is likely to complete the drafting of laws introducing corporate tax and valueadded tax in the third quarter of 2015, a senior Ministry of Finance official said. The draft of the corporate tax law and the value-added tax law has been discussed with the local and federal governments, Younis Haji al-khouri, under-secretary at the Ministry, told Reuters. He added that authorities were still evaluating the social and economic impact of these laws, but drafting was expected to be finished very soon. Al-Khouri declined to comment on the proposed tax rates or when they might take effect. There might often be gaps of many months or years between the drafting of UAE laws and their going into effect upon approval by the President. Introducing corporate tax and VAT in the UAE, which has promoted its lowtax environment to investors, would be a major shift in policy, and sensitive. Officials have said in the past that VAT is unlikely to be introduced before adjacent countries adopt it too. Otherwise, the UAE s competitiveness could be hurt and there might be a surge in smuggling across borders. Neighboring countries are discussing plans for VAT but do not have a firm timetable. Last year s plunge in oil prices has hurt the finances of even wealthy Gulf States such as the UAE, pressing them to consider new ways of raising revenue. 3 TAG-Legal tag-legal.com

The UAE will this year post its first consolidated fiscal deficit since 2009, the International Monetary Fund (IMF) projects; it sees the budget swinging to a deficit of 2.3% of gross domestic product from a 5.0% surplus of year before. The IMF has urged the UAE to consider introducing excise taxes and a uniform corporate tax for both local and foreign firms. At present, there is little corporate taxation outside the oil sector, apart from a 20% levy on foreign banks in Dubai. Zeine Zeidane, Head of the IMF mission to the UAE, told Reuters that a UAE corporate tax could be introduced at a lower rate, initially to accustom the government to running a national tax system. A UAE Ministry of Finance s report released that the cabinet had approved several versions of the corporate tax and VAT draft laws. Bahraini King Ratifies Arbitration Law MANAMA- His Majesty King Hamad bin Isa Al-Khalifa ratified and issued law No. (9) for 2015 on the promulgation of the law on arbitration. The articles of the Law are as follows: Article 1 Taking into account the provisions of international conventions in force in the Kingdom of Bahrain 1. The provisions of the UNCITRAL Model Law on International Commercial Arbitration Act attached to this law shall apply to all arbitration whatever the nature of the legal relationship of the dispute herewith, if this arbitration takes place in the Kingdom of Bahrain or abroad and that two parties agreed to comply with the provisions of the attached law. 2. The provisions of the law shall apply to all arbitrations which begin after the law enters into force even if based on an arbitration agreement concluded before the entry into force of this law. Article 2 1. The provisions of paragraph (1) of Article (1) of the law shall not prejudice the application of its provisions on all arbitration, whatever the nature of the legal relationship of the parties to the arbitration agreement. 2. The international source shall be taken into account in interpreting the provisions of the law contained in Article (2- A) of this law, in case of an international commercial arbitration Article 3 The High Civil Court shall perform the functions referred to in Article (6) of this law. Article 4 The definition of the arbitration agreement and its form shall be made in accordance with the first option provided for in Article (7) of the law. 5 TAG-Legal tag-legal.com

Article 5 Charges levied on applications related to the recognition of arbitral awards and requests for implementation and cancellation requests shall be subject to the provisions of the law to the rules on imposing judicial fees stipulated in the law on judicial fees. Article 6 Non-Bahraini lawyers shall be authorized to represent the two parties to the dispute in case the international trade arbitration is held in the Kingdom of Bahrain. Article 7 Any arbitrator appointed on the basis of the provisions of the law shall not be held accountable for any act or omission when carrying out his duties unless it was done in bad faith or was the result of a serious error; and this provision applies to employees of the arbitrator or authorized by him to undertake some of the work associated with the tasks entrusted to him without prejudice to the responsibility if the arbitrator steps down without serious reason or at the wrong time Article 8 The 7th clause on arbitration, the Article (253) of the Civil and Commercial Procedures Law promulgated by law-decree (12) for 1971 and the International Commercial Arbitration Act issued by decree (9) for 1994 shall be abrogated. Bahrain Announces Six-month General Amnesty for Illegal Workers MANAMA- The Bahraini government announced a six-month general amnesty for illegal workers to leave the country without penalties. The amnesty, which started from July 1 to Dec. 31 of 2015, allows illegal workers to either stay by obtaining legal gainful employment or return to their countries without penalties, said Ausamah Al Absi, chief executive officer of the Labor Market Regulatory Authority (LMRA). Thousands of workers from different countries, who are absent from work, ran away after termination of contract, overstayed on visas or overstayed after termination of contract, will benefit from the amnesty, Al Absi said in a statement. We offer this opportunity to all those who may have found themselves on the wrong side of the law to rectify their situation without having to pay penalties or face legal procedures, said Al Absi. We aim to remove as many people as possible from this vulnerable position of being illegal and subject to exploitation and give them the opportunity of a new start without financial or legal costs, he added. Electronic Filing and Processing of International Applications GENEVA- The Algerian National Institute of Industrial Property, the Industrial Property Office of the Czech Republic and the Companies and Intellectual Property Commission (CIPC) (South Africa) started receiving and processing international applications in electronic form. The three entities in their capacities as receiving Offices, have notified the International Bureau (IB), under PCT Rule 89bis.1(d), that they will be prepared to receive and process international applications in electronic form with effect from 1 July 2015. The Offices started accepting international applications filed using the epct-filing function in the epct Portal. IRAQ: Kurdistan is Now a Completely Independent IP Jurisdiction KURDISTAN- Since 2011, the Ministry of Trade and Industry of Kurdistan has been claiming that Iraqi trademark registrations before Iraqi PTO in Baghdad no longer cover Iraq jurisdiction. Now, the State Council of Iraq has issued an opinion clarifying this question, informing that there is no longer possibility of extending the trademark registrations from Iraq to Kurdistan. In this sense, Kurdistan is now a completely independent IP jurisdiction and the protection has to be sought directly before Kurdistan authorities. It is worth mentioning that in the past, there were two options of obtaining trademark protection in Kurdistan: request an extension of protection in Kurdistan for the already registered trademarks in Iraq, or file directly in Erbil, before the Kurdistan Registrar. ANGOLA: Trademark Applications No. 1 to 5000 Must Re-submit Documents before IAPI LUANDA- In order to update trademark files, the Angolan Intellectual Property Office (IAPI) issued a notification, requesting all applicants and/or attorneys of trademark applications numbered from 01 (one) to 5000 (five thousand) to present the following documents by September 9, 2015: 1. Copy of the official filing receipt or application request; 2. Power of Attorney; 3. Certificate of Incorporation, proving the company s commercial activity in its native country. All documents shall be translated into Portuguese and duly certified by a Notary Public. The Power of Attorney shall also be duly legalized at the Angolan Consulate of the applicant s country or the nearest country. In light of the above, in case the aforementioned trademarks were not updated with the requested documentation, they will lapse/expire, in accordance to Angolan Law. The deadline to present the referred documents is 120 (one hundred and twenty) days, counting from the publication date of June 1st 2015 of the Industrial Property Bulletin No. 03/2015. Meaning that the deadline is until September 28 th, 2015. This notification was issued to improve IAPI s efficiency and promptness in dealing with IP related matters, as to promote this area as one of the country s main development strategies. New Implementations of Cooperation Fund Tools BRUSSELS- The European Trade Mark and Design Network (ETMDN) recently announced two new implementations of Cooperation Fund tools. The Benelux Office for Intellectual Property (BOIP) has implemented trademark e-filing developed by the Cooperation Fund. Users of BOIP s electronic services will be able to avail of the following benefits: An intuitive and user-friendly interface. Quick and easy to find and select all the relevant goods and/or services. Immediate PDF confirmation in user mailboxes, with the application number and a financial overview. While the Irish Patents Office (IEIPO) has implemented the Quality tool, also developed by the Cooperation Fund. The Quality tool provides a common statement of transparent service commitments for end users, which are structured to enable adoption by any European Industrial Property office. Quality standards are divided by category and measure timeliness, quality, accessibility and consistency of the services as perceived by the users. The overall aim of the Cooperation Fund is to benefit users across the EU by providing state of the art tools and services for EU national and regional offices.
