Special conditions for Elektronisk Indbetalingskort debtors 1.1 Registration 1.1.1 The customer s registration with Elektronisk Indbetalingskort is subject to the General conditions for Elektronisk Indbetalingskort debtors, see below, and the special conditions set out in this clause 1. 1.1.2 This Netbank agreement makes up the customer s debtor agreement on Elektronisk Indbetalingskort. 1.2 Termination 1.2.1 Upon termination of the agreement the customer will receive printed copies of all electronic payment slips that have been delivered but not yet authorised. About Elektronisk is a payment slip from a creditor which the customer receives in Netbank. contains the same information as a printed payment slip. The customer can only pay by using Netbank. 2. Definitions 2.1 Banking Day Banking days are all days except Saturdays, Sundays, Danish public holidays, the Friday after Ascension Day, 5 June, 24 December and 31 December. 2.2 Payment date The payment date is the day on which the amount is debited from the customer s account. Payments are processed on Danish banking days only. 2.3 Payment slip The term payment slip refers to payment slips used in the Fælles Indbetalingssystem and the Giro system. 2.4 PBS PBS A/S, CVR no. 20 01 61 75, is the company that enters into the agreement on with the creditor. 2.5 Debtor agreement on A debtor agreement for Elektronisk is an agreement between the customer and Nykredit Bank enabling the customer to receive payment slips electronically in Netbank. 3. The customer s registration as recipient of 3.1 Debtor agreement for If the customer wishes to receive electronic payment slips, the customer must enter into a debtor agreement for with Nykredit Bank. By entering into the debtor agreement, the customer agree that Nykredit Bank may forward the customer s name, address and the customer s personal registration number (CPR no.) to PBS. PBS uses this information to identify the customer as the correct recipient of. PBS does not pass the customer s personal registration number on to creditors or to others. The customer must pay payment slips received on print, until the customer receives the payment slips electronically. The customer must terminate his or her debtor agreement with Nykredit Bank, if the customer wishes to discontinue receiving electronic payment slips in general, see 6.1. 3.2 The customer s obligations When the customer enters into a debtor agreement on, the customer is obliged to comply with the terms and conditions stipulated in the agreement. 3.3 General registration of creditors The customer can choose a general registration for Elektronisk. A general registration means that the customer can receive electronic payment slips from all creditors who send. Please note, the customer can only receive electronic payment slips from creditors who send payment slips via PBS. 3.4 Specific registration of creditors Once the customer has a debtor agreement for, the customer can specify the creditors from whom the customer wishes to receive electronic payment slips. The customer will only receive electronic payment slips from creditors specified by the customer. The customer s customer number with creditor Please note, the customer can only receive electronic payment slips from creditors who send payment slips via PBS. 3.5 Foreign address If the customer resides outside of Denmark or Greenland, he or she should make a specific registration of creditors. If the customer undertakes a general registration, the payment slip will typically be sent by post. 3.6 Printed payment slips PBS will send printed payment slips to the customer, if it is not possible to send electronic payment slips to the customer and his or her creditor uses this service. 4. Receipt of Elektronisk 4.1 Notification of receipt When the customer has received an electronic payment slip, he or she can see it in Netbank. The customer will receive a notification in Netbank as well as an email, text message or the like, depending on the type of notification the customer has chosen. 4.2 Access to electronic payment slips Electronic payment slips are available in Netbank in the month of the electronic payment slip s payment date plus the following 12 months. If the customer wishes to keep the information in electronic payment slips for a longer period, Nykredit Bank can inform the customer of the options available for saving or printing electronic payment slips. Moreover, Nykredit Bank can inform the customer of what to do, if the customer decides to terminate his or her Netbank agreement; see 7.1. 4.3 Printed copy The customer can order a printed copy of electronic payment slips. It will be stated on the copy that the payment slip has already been sent electronically. Nykredit Bank can provide the customer with a printed copy during the transaction year and the following five years. Nykredit Bank can inform the customer of the charge for this service on request. 5. Payment execution 5.1 The customer s authorisation To initiate a payment based on an electronic payment slip, the customer must authorise the payment in his or her Netbank. 5.2 Payment execution date If the customer authorises a payment containing the payment data specified by creditor in an electronic payment slip, the payment will be executed on the specified payment date with the specified amount. Before the customer approves the payment, he or she can change the payment date and the amount disregarding the payment data provided by creditor. 5.3 Liability for the customer s changes in the payment data If the customer changes the payment data that creditor has specified in an electronic payment slip or if the customer do not pay, the matter must be solved between the customer and the creditor. Neither Nykredit Bank nor PBS assumes any responsibility in this connection. 5.4 Payment and receipt An account statement specifying the payment is considered evidence of the executed payment. 5.5 Maximum execution time The maximum execution time is one banking day from the payment date the customer has approved; see 5.2. 5.6 Cancellation of payment The customer cannot cancel a payment order after the payment has been executed. Authorised payments that have not yet been executed may be cancelled in accordance with the rules that apply to the customer s Netbank. 6. Termination of debtor agreement on Elektronisk 6.1 Termination by the customer The customer may terminate his or her debtor agreement for Elektronisk with Nykredit Bank at any time. The customer s notice of termination must be in writing or be submitted via the customer s Netbank. 6.2 Termination by Nykredit Bank Nykredit Bank may terminate the agreement in writing with the notice that applies to the customer s Netbank agreement. 6.3 Effect If the agreement is terminated, all general and specific creditor registrations will be deleted. The customer will subsequently receive printed payment slips. The termination becomes effective as soon as possible after Nykredit Bank has received the customer s termination notification. If Nykredit Bank has terminated the agreement, the termination is effective on the date specified by Nykredit Bank. agreed unless the customer cancel the payment order; see 5.6. Electronic payment slips that the customer has already received will be available in the customer s Netbank in accordance with 4.2. Depending on the customer s Netbank, it may still be possible to pay electronic payment slips that have not yet been authorised. 7. Termination of online banking agreement 7.1 Termination of debtor agreement If the customer s Netbank agreement is terminated, the customer s debtor agreement for will be terminated at same time. The customer will subsequently receive printed payment slips. 7.2 Unpaid electronic payment slips Nykredit Bank is not responsible for any electronic payment slips that the customer has not paid because the customer s access to his or her Netbank has been terminated. Unpaid electronic payment slips are deleted when the customer s access to Netbank is terminated. Please contact Nykredit Bank if the customer wishes to receive unpaid electronic payment slips on print. If Nykredit Bank terminates the customer s Netbank agreement, Nykredit Bank must send the customer printed copies of all unpaid electronic payment slips. This only applies to electronic payment slips with a payment date within three months of the date of termination. 7.3 Authorised but not executed payments Payments that have been authorised but not yet executed will be executed as agreed unless the customer cancels the payment order in accordance with the rules for cancelling payments established by Nykredit Bank. 8. Creditor s responsibilities Creditor shall be liable if creditor causes late delivery of an electronic payment slip or if the electronic payment slip is erroneous. In this case, creditor cannot require any remedies for breach of contract. Please, contact creditor as soon as possible if the customer notices that he or she has not received an electronic payment slip or that the payment slip is erroneous. 9. Nykredit Bank s liability Nykredit Bank shall be liable for late or defective performance of its contractual obligations resulting from error or negligence. Even in areas of increased liability, Nykredit Bank shall not be liable for losses arising from breakdown of, or lack of access to, IT systems or damage to data in these systems due to any of the factors listed below and regardless of whether Nykredit Bank or a third-party supplier is responsible for the operation of these systems; power failure or a breakdown of Nykredit Bank s telecommunications, legislative or administrative intervention, war, revolution, civil unrest, sabotage, terrorism or vandalism (including computer virus attacks or hacking); strikes, lockouts, boycotts or picketing, regardless of whether Nykredit Bank or its organisation is itself a party to or has started such conflict and regardless of its cause (this also applies if the conflict affects only part of Nykredit Bank); this also applies when the conflict affects part of Nykredit Bank; or other circumstances beyond Nykredit Banks control. Nykredit Bank shall not be exempt from liability, if Nykredit Bank ought to have foreseen the cause of the loss when the agreement was concluded or ought to have avoided or overcome the cause of the loss; under Danish law, Nykredit Bank is liable for the cause of the loss under any circumstances. 10. Price list Nykredit Bank will inform the customer of applicable charges on request. 11. Changes to the agreement and the general conditions 11.1 Notification Changes of these conditions to the customer s disadvantage are subject to two months notification. Other changes may take effect without notice. The customer will be notified of changes electronically. 11.2 Approval The customer are assumed to have approved the notified changes unless the customer informs Nykredit Bank that he og she does not wish to be bound by the revised conditions. If the customer cannot approve the changes, his or her Elektronisk debtor agreement will terminate as from the day when the changes take effect. 12. Law and jurisdiction These conditions are governed by Danish law. Disputes may be brought before the Danish Complaint Board of Banking Services or the ordinary courts in the jurisdiction of Nykredit Bank s domicile. 4 TO THE FRONT PAGE
Disputes relating to PBS role as a payment service provider may be brought before the Danish Financial Supervisory Authority. 13. Precedence In case of discrepancy, the Danish version will take precedence over any other version of the General conditions for - debtors. 5 TO THE FRONT PAGE
