Terms and Conditions Governing CIMB Bank Sole Proprietor and Partnership Cheque Deflect Campaign 2018. ( Terms and Conditions ) 1. Definition Account(s) Campaign Campaign Period Cash back rewards Cheque Issuance Date CIMB Bank Eligible Customer(s) means CIMB Bank Business Current Account(s) opened and maintained by the Eligible Customer(s) with CIMB Bank Berhad means CIMB Bank Sole Proprietor and Partnership Cheque Deflect Campaign 2018. means the period from 1 st April 2018 until 30 th June 2018, both dates inclusive. means the rewards as set out in Clause 3(a) below. means the date stated on the cheque issued by the Eligible Customer(s) means CIMB Bank Berhad. means Sole Proprietorship or Partnership customer of CIMB Bank who received a short message service ( SMS ) at their mobile number and/or an electronic direct mailer ( EDM ) at their email address, both maintained in CIMB Bank s record from CIMB Bank about this Campaign as an invitation to participate in this Campaign. For avoidance of doubt, the customer s Sole Proprietorship or Partnership status will be as per CIMB Bank s records. 2. Participating Criteria To participate in this Campaign, all of the following conditions must be fulfilled by the Eligible Customer(s): (a) Must be an existing Sole Proprietorships or Partnerships customer of CIMB Bank with a CIMB Bank Business Current Account during the Campaign Period. (b) Fulfill the Qualifying Criteria set out in Clause 3 of these Terms and Conditions. Hereinafter collectively referred to as the Participating Criteria. 3. Qualifying Criteria and Cash back rewards Rewards (a) Subject to the terms and conditions herein, Eligible Customer(s) who successfully reduces their CIMB Bank Berhad cheque issuance according to the group that they fall under during the Campaign Period based on the EDM/SMS blast, customers shall be entitled up to Ringgit Malaysia One Hundred and Fifty (RM 150.00) cash back rewards ( Cash back rewards ).

1 2 Enjoy up to RM150 cash back (RM 50 x 3 months) if they fulfill campaign criterias Table 1: 4 Groups of Sole Proprietors & Partnerships that are eligible to participate in the campaign For clarity, the group which the Eligible Customer(s) belong to will be decided by CIMB Bank at its sole and absolute discretion taking into account the recent number of CIMB Bank cheque issued by the Eligible Customer(s) as per CIMB Bank s records. The Eligible Customer(s) will be informed of the group they belong to and/or the Maximum Number of Cheques Issued during the Campaign Period that they need to comply with in the SMS and/or EDM. (b) Maximum Number of Cheques Issued during the Campaign Period refers to the maximum number of CIMB Bank cheque that the Eligible Customer(s) may issue during the Campaign Month in order to be entitled to the Cash back rewards. For clarity, only successfully presented and honoured cheque during the Campaign Period will be taken into consideration and if the total CIMB Bank cheque issued exceeds the Maximum Number of Cheques Issued during the Campaign Period, the Eligible Customer(s) will not be considered to have fulfill the Qualifying Criteria.

4. Fulfilment Subject to the terms and conditions herein, (a) The Cash Back will be credited into the Eligible Customer(s) s Account within two (2) month after the end of the Campaign Period. (b) After the Campaign Period has ended, even if the Eligible Customer(s) meets the Participating Criteria, no Cash Back will be given thereafter. (c) At the time when CIMB Bank credits the Cash Back into the Eligible Customer(s) Account, the Eligible Customer(s) Account MUST NOT be closed, suspended, terminated, frozen, delinquent, invalid or cancelled, otherwise the Eligible Customer(s) will be disqualified from participating in this Campaign and will not be entitled to receive the Cash Back under this Campaign. (d) CIMB Bank will consider the date stated on the cheque issued by the Eligible Customer(s) during the Campaign Period for the purpose of ascertaining the Maximum Number of Cheques Issued during the Campaign Period set out in Clause 3(a) of these Terms and Conditions. (e) CIMB Bank will not entertain any request from any Eligible Customer(s) or any other person to credit the Cash Back to the Eligible Customer(s) other accounts or third party s accounts, whether or not held with CIMB Bank or any other banks. 5. General Terms and Conditions (a) By participating in this Campaign, the Eligible Customer(s) are deemed to have read, understood and agreed to be bound by the Terms herein. (b) CIMB Bank s decision on all matters relating to this Campaign is final, binding and conclusive provided that the decision made is fairly and reasonably made. (c) CIMB Bank shall not be liable in any manner to the Eligible Customer(s) unless the same is due to the gross negligence or willful default of CIMB Bank. (d) By participating in the Campaign, the Eligible Customer(s) agrees that CIMB Bank shall not in any manner whatsoever be liable or held responsible to the Eligible Customer(s) if CIMB Bank is unable to perform in whole or in part of any of its obligations herein, attributable directly or indirectly to the failure of any mechanical or electronic device, data processing system, transmission line, electrical failure, industrial dispute, war, strike, riot, any act of God beyond CIMB Bank's control or due to any factor in a nature of a force majeure which is beyond CIMB Bank s reasonable control. (e) The Eligible Customer(s) agree to indemnify CIMB Bank against any claim by any third party and against any loss, damage, cost or expense (including solicitors fees and cost) that CIMB Bank may suffer or incur as a result of or in connection with this Campaign unless the same is due to the gross negligence or willful default of CIMB Bank. (f) CIMB Bank s failure to enforce a particular term or condition of these Terms and Conditions does not constitute a waiver of that term or condition by CIMB Bank.

(g) The Terms herein shall be governed by the laws of Malaysia and the rules, regulations and guidelines of Bank Negara Malaysia, and other relevant bodies, in force from time to time. (h) CIMB Bank may at its sole discretion vary, amend, delete or add to any of these Terms and Conditions with prior notification of twenty one (21) calendar days to the Eligible Customer(s) by email or by posting a notice at each of the CIMB Bank s branches or by effecting an advertisement in one newspaper of CIMB Bank s choice, or via CIMB Bank s website or such other means as CIMB Bank may in its sole discretion determine and any of the aforesaid means shall be deemed as binding on the Eligible Customer(s) as from the date of notification. (i) The Eligible Customer(s) consents to the disclosure by CIMB Bank of all or any information of the Eligible Customer(s) and all information in connection with its participation of this Campaign where required by laws or governmental, regulatory and enforcement bodies or agencies or pursuant to any court orders or to the related companies and professional advisers of CIMB Bank. (j) CIMB Bank reserves the right upon giving prior notice of not less than fourteen (14) calendar days to change the duration and/or the commencement and/or expiry dates of the Campaign Period and/or discontinue, cancel, terminate or suspend the Campaign and/or substitute the Cash Back with another reward of similar cost. No compensation in cash or any kind shall be given to the Eligible Customer(s) for any loss or damage suffered or incurred by the Eligible Customer(s) as a direct or an indirect result of such substitution of the reward and/or extension, modification, shortening, discontinuation, cancellation, termination or suspension of this Campaign unless the same is due to CIMB s willful default (not by reason of complying with any regulatory or court order) or gross negligence. (k) The Cash Back given in this Campaign cannot be combined with any other campaigns or promotions organized by CIMB Bank. (l) The Terms and Conditions herein (as the same may be amended from time to time pursuant to Clause 5(h) shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional and/or advertising materials in relation to the Campaign. (m) If there any inconsistency (ies), conflict(s), ambiguity (ies) or discrepancy (ies) between the Bahasa Malaysia and English version or other language version of these Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned where request is made by the Eligible Customer(s) and noted and acknowledged by CIMB Bank in its records that the Bahasa Malaysia version of the terms and conditions shall govern the operation of the Eligible Customer(s) Account, then the Bahasa Malaysia version of these Terms and Conditions shall prevail.
