Eligibility Silver Dollar City s 2018 DREAM BIG. DO GOOD. EDUCATORS CONTEST (the Contest ) is offered only in Missouri, Arkansas and Eastern Oklahoma, and is open to full-time employed School (as herein after defined), Kindergarten (K) through Twelfth (12th) Grade teachers, who are legal residents of the United States, excluding where otherwise prohibited by law, rule or regulation, which are at least 18 years of age at the time of entry. THIS CONTEST IS SPECIFICALLY VOID OUTSIDE THE UNITED STATES, IN PUERTO RICO, AND WHEREVER PROHIBITED BY LAW. NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN CONTEST AND IT WILL NOT INCREASE YOUR ODDS OF WINNING. Limit one (1) winner per household. All entries submitted in compliance with these Official Rules and not disqualified are considered Eligible Entries. As used in these Contest rules, School means: (a) a publicly funded or private daytime school; (b) that has education of individuals under college age as its primary purpose; (c) in which students attend on a full time basis; and (d) that is organized according to a grade or grades K-12, and maintained for a grade or grades, K-12. K-12 means kindergarten and grades 1 through 12. Employees of Silver Dollar City, LLC ( Sponsor ) and its parent and their respective affiliates and subsidiaries, and each of their respective officers, employees, directors, members, legal representatives, agents, district managers, successors and assigns are not eligible. Proof of legal U.S. residency, proof of employment as a full-time school teacher (K-12th grade) at time of entry and at time of prize award and age may be required. The Winner must be a full-time, employed school teacher in the United States at the time of entry and on the date the Prize is awarded. Timing The Contest begins on Wednesday, April 11, 2018 at 8:00 a.m. Central Standard Time ( CST ) and ends on Friday, August 10, 2018 at 11:59 p.m. CST (the Contest Period ). How to Enter To participate in the Contest, entrants must upload a 2-minute or less video or a 250-word essay describing a teacher s initiatives to Dream Big. Do Good in his or her classroom (see Judging Criteria as defined below). A teacher may enter himself or herself into the Contest, or a teacher may be nominated. Each entry submission will need to be accompanied by two (2) references. address, e-mail address and telephone number, as well as your nominee s name, grade level, subject, school name, school district, school address, school phone number, and email. Limit one (1) submission per person throughout the Contest Period. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled submissions, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Only fully completed submissions are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor. Entry Conditions and Release By entering, each participant agrees to: 1. Have read and understood and be bound by these Official Rules; 2. Comply with these Official Rules and the decisions of the Sponsor and/or the Contest judges which are binding and final in all matters relating to this Contest; and 3. Grant Sponsor the non-exclusive, royalty-free, and irrevocable rights to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, and otherwise exploit your submitted video and essay (collectively, the Submission ) and to incorporate the Submission in other works in any and all markets and media worldwide in perpetuity. You warrant that you have the sole and exclusive right to grant such rights to Sponsor and that Sponsor s reproduction, publishing, displaying, and/or other use of the Submission will not infringe on any rights of third parties, including, without limitation, copyright, trademark, privacy, or publicity, or create claims for defamation, false light, idea misappropriation, intentional or negligent infliction of emotional distress, or breach of contract. Participant is responsible for licensing any and all licensable material included in the Submission, including footage, photos and music (the Licenses ). Sponsor reserves the right to clear Submission elements and secure any necessary Licenses. 4. The posting of your name and Submission on Sponsor s social media pages, including but not limited to Twitter, Instagram, and Facebook. 5. Release and hold harmless the Sponsor and its respective subsidiaries, and affiliated companies, and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the Released Parties ) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or 2
use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Sponsor from and against any and all claims, expenses, and liabilities (including reasonable attorney s fees) arising out of or relating to an entrant participation in the Contest and/or entrant s acceptance, use or misuse of prize. Winner Selection/Judging Official final judging of all Eligible Entries and selection of the winner will occur on August 24, 2018, by a panel of five (5) judges using the following criteria ( Judging Criteria ) in their sole discretion: o 30% Inspiring students to Dream Big to make a difference Teacher creates learning experiences that make the subject matter they teach meaningful and engaging far beyond what is expected as the standard for the grade/subject level. Nominee uses a variety of instructional strategies to encourage students critical thinking and problem solving skills. And, provides learning opportunities that are adapted to diverse learners and supports the intellectual, social and personal development of all students. o o o 30% Developing students into Doers not just Dreamers Teacher actively encourages students to do more than just learn the subject matter and to apply the knowledge/skills they retain to do good. Nominee fully understands the motivation and behavior to create a learning environment that encourages active engagement in learning, positive social interaction and self-motivation and helps students apply learnings in real world applications. 20% Teacher leads by example to Dream Big and Do Good Nominee engages in a variety of leadership roles and has effective working relationships with students, parents and school colleagues, plus is actively involved in the educational community and in the community the school resides in. 20% Teacher is an Innovative Trailblazer Nominee is an out-side-the-box thinker who innovatively pushes scholastic, social and emotional boundaries within the school and with students. Plus, teacher actively seeks out opportunities to grow professionally in order to improve learning for all students and propel education forward. All judging will be in Sponsor s sole and absolute discretion and Sponsor s decisions are final and binding on all matters relating to the Contest. Sponsor reserves the right in its sole discretion to disqualify any entrant. The winners will be notified by telephone on August 27, 2018. POTENTIAL CONTEST WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. IF THE POTENTIAL CONTEST WINNER DID NOT ENTER HIMSELF OR HERSELF BUT WAS A NOMINATED ENTRANT, 3
SUCH NOMINATED POTENTIAL CONTEST WINNER AGREES TO COMPLY WITH ALL TERMS AND CONDITIONS OF THESE OFFICIAL RULES IN ORDER TO RECEIVE THE PRIZE. Verification of Potential Winner Potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be required to sign and return to Sponsor, within five (5) days of the date notice is sent, an affidavit of eligibility and liability/publicity release granting Sponsor and its agents and its agents use of winner s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration (except where prohibited) in order to claim his/her prize if applicable. If a potential winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, the potential winner forfeits his/her prize. In the event that a potential winner of a Contest prize is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner from among all remaining eligible entries. Grand Prize Ten (10) Grand Prize Winners will each be awarded a $1,000.00 credit in the Winner s name to be used solely and only for classroom purposes through https://www.adoptaclassroom.org/ (the Prize(s) )*. Winners will not be receiving any cash or cash equivalent value. The $1,000.00 Prize value will be paid in the Winner s name directly to Adopt-A-Classroom only. If Winner loses his or her position as a full-time school teacher before expending or using the entire $1,000.00 Prize amount, the unspent or unused portion of the Prize may be forfeited as determined by Sponsor. All Prizes must be spent or used within one (1) year from the date of award of Prize or otherwise the Prize or any remaining portion of the Prize is forfeited. *(ARV of all prizes totals $10,000.00). No cash equivalent for the prize and nontransferable nor substitution will be made except as provided herein at the Sponsor s sole discretion. Sponsor reserves the right to substitute listed prize for one of equal or greater value for any reason. General Conditions Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an 4
attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Limitations of Liability The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant s participation in the Contest or receipt or use or misuse of any prize. Disputes Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate Missouri State Court located in Stone County, Missouri; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Missouri, without giving effect to any choice of law or conflict of law rules (whether of the State of Missouri or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Missouri.
