INDEMNITY 1. I acknowledge that the words the Club shall, whenever used in this indemnity, mean any or all of the following: The Johannesburg Light Plane Club and its servants, agents, members and / or guests. 2. In consideration of the Club granting me facilities for flying, the renting of hangar space, tuition for flying, the use of the club s social facilities, or allowing me the use or occupation of property or premises owned or controlled by the Club, I agree that... 2.1 I will, at all times, pay, (in advance if so required by the Club), the Club s charges for hangar rental and for all facilities and services granted me by the Club based on its schedule of charges, as amended from time to time. 2.2 That I will at all times obey, and comply with all Air Navigation Regulations, Bye-laws and instructions applicable in the Republic of South Africa, as well as any flying regulations imposed by the Club and instructions issued by the Club s instructors, safety officer or authorised officials, whether such regulations be in writing or communicated verbally. Under no circumstances whatsoever shall the Club be held responsible or liable for any damages or otherwise, or any loss, damage or expense suffered by me or by my estate or anyone claiming by or through me, due to or arising from the granting of the said facilities, and/or tuition for flying, or hiring of an aircraft and/or the use and/or occupation of any property or premises owned or controlled by the Club, notwithstanding that such loss or damage or expense shall have been caused through negligence: I indemnify the Club in respect of any such claim made by my dependents or my guests or their dependents. 2.3 I indemnify the Club against all losses, damage or expense which it may suffer or be called upon to pay, whether for damages or otherwise, arising from my conduct or act of omission on my part in connection with or arising out of the use of any aircraft loaned or supplied by the Club to me and/or the negligence of any pilot employed by the Club or any servants of the Club or the use and/or occupation by me of any property or premises owned, controlled and used by the Club, and I agree that this indemnity shall apply to all legal costs which the Club may be called upon to pay. I further agree that the Indemnity shall apply to the conduct, act or omission of any person who shall have been invited by me to use the said aircraft, or use and/or occupy the property or premises. Supplementary Rules, By-laws, Terms and Conditions Relating To Use of the Facilities and The Hiring Of Hangars From The Johannesburg Light Plane Club At Baragwanath Airfield. 1) Amendments to the Club s Rules, Regulations and Constitution, whether they be of a permanent or temporary nature, may be published as a Supplementary Rule / Regulation / By-Law / Ts & Cs, until such time as the relevant document is revised. 2) All members who rent hangars, or ground on which they build their own hangar, are required to sign the JLPC Hangar Rental Agreement. 3) For the benefit of members who do not rent hangars, some of the more important Rules / Regulations, By-laws / Ts &Cs are summarised here. 4) An Airfield Project / Development Levy, which is not refundable, shall become due and payable on joining the Club. This Levy applies to all new members. 5) The monthly Hangar Maintenance/Utilities Levy, (which includes services such as electricity charges and security costs), is subject to revision at any time at the discretion of the committee. Members shall be notified one month in advance of changes to be effected to this levy. 6) Johannesburg Light Plane Club reserves the right to terminate occupancy / membership should the Member not adhere to any of the club s Rules / Regulations / By-laws / T's & Cs. 7) All persons using the facilities provided by the JLPC are required to be members of the club. Syndicated Aircraft:- All members involved in a syndicated aircraft ownership shall be members of the club. Syndicate shareholders who are not members of the club shall be refused access to and use of the club s facilities. Apart from the member s spouse/partner, family and Friends of JLPC Members who are not themselves members of JLPC may not make use of the club s facilities unless they are accompanied by the member. If said family and friends are themselves pilots they may not use the club s taxiway and runway facilities without the prior written consent of the committee. If they intend to use the facilities on a regular basis they are obliged to become members of the club in their own right. 8) Persons accessing the airfield / hangars may be required to show proof to a duly authorised person, (committee member or airfield caretaker / manager), that they are authorised to do so. 9) Supplementary Rules and By-laws approved by the committee may be displayed in the form of signs or notices erected around the airfield or communicated to members by mail. These may be changed or withdrawn at the sole discretion of the committee at any time as is deemed appropriate. The onus is on the member to ensure that he / she is informed of the current rules and by-laws in effect at the club.
