He then studied for the Common Professional Examination at Nottingham Law School. He appears and advises in the entire range of personal injury claims, particularly those involving road traffic accidents, employers liability, public liability, highways and product liability matters. He regularly represents both Claimants and Defendants at joint settlement meetings. He is involved in litigation from the provision of preliminary advice, through to conclusion at trial or joint settlement meeting. counsel to share the risks of litigation with solicitors and will enthusiastically accept instructions on a CFA basis. He is also frequently instructed to represent the interests of parties at inquests. He also undertakes CICA appeal work. He has experience of advising and appearing on detailed assessments of costs and in addressing the issues of entitlement to certain costs. Catastrophic Injury Richard regularly advises Claimants and Defendants in high value catastrophic injury claims, including those arising from brain and spinal injuries, and limb amputations. He is commonly involved from an early stage, and is able to assist in shaping the claim or defence, and the generation of medical evidence and evidence in relation to special damage. He usually maintains his involvement in these cases until trial or settlement, most often at mediation and joint settlement meetings. Disease Richard has experience of all aspects of disease litigation, from limitation to breach of duty, causation and quantum. He has particular experience in claims involving noise-induced hearing loss, hand-arm vibration syndrome, dermatitis, respiratory complaints, asbestos-related conditions and work-related upper limb disorders. The majority of Claimants who are not union-funded need to rely upon representation by conditional fee agreement and he is more than willing to share the risk in this regard. Clinical Negligence Richard advises both Claimants and Defendants in all aspects of clinical negligence and the complicating issues as to causation and quantum which often occur. As with his personal injury work, he recognises the need of many Claimants to seek representation through CFA funding and the imperative of sharing risk with solicitors in doing so. Counter Fraud Richard regularly appears for insurers in claims involving suspected fraud.
He has a wealth of experience in claims involving phantom passengers, switched drivers, fictitious accidents, staged accidents, exaggerated injuries, exaggerated special damages, low velocity impact claims and disproportionate hire and storage claims. Criminal Regulatory Richard is experienced at all levels of defending prosecutions brought under the Health and Safety at Work Act. Recent cases include accidents at construction site, those involving work equipment and protective equipment and falls from height.
