DETAILED TERMS AND CONDITIONS FOR COLLECTION, PLUCKING AND SELLING OF CASHEW NUTS AND THALAMUS FOR THE HARVESTING SEASON 2018 i.e. FOR THE PERIOD FROM 15.03.2018 TO 31.05.2018 FROM THE PLANTATION LOCATED AT IISER BERHAMPUR PERMANENT CAMPUS 1) AREA OF PLANTATION & SCOPE OF WORK:- The plantation in the scope of this tender is standing at the sea coast of Bay of Bengal at IISER Berhampur permanent campus (location plan attached). Plucking, Collection and Selling of Thalamus and Cashew nuts available in the land. 3. Safely remove from the land and dispose of the harvest within allowed time period i.e. 15.03.2018 to 31.05.2018. Area (in acres) Permission period for harvesting the crop 200.435 Up to 31.05.2018 Remarks 2) GENERAL CONDITIONS:- a) The above work will be awarded for one fruiting season (for the period from15.03.2018 to 31.05.2018) for the purpose as mentioned in the scope of work only. b) The officer inviting tenders shall have the right of rejecting all or any of the tenders and will not be bound to accept the highest or any other tender. c) Intending bidders who want to take part in the tender process are advised to inspect the IISER Berhampur permanent campus plantation area including position of Cashew plants before taking part in the Tender. Submission of sealed Tender will be taken as sufficient proof of the bidder having inspected the plantation and having satisfied himself/ herself about the condition of plants / expected yield. No complain as regards to area and growth of cashew plants will be entertained at the time of submission of tenders or after acceptance of tenders. d) Submission of the sealed tender will be done in the office chamber of the Project Engineer(E),IWD,IISER Berhampur, Transit Campus ITI Berhampur at Engineering School Road, Berhampur - 760 010, Ganjam District, Odisha and the same will be opened by a tender committee. e) No guarantee regarding quality and quantity of cashew nuts available from the area of plantation will be given by the institute. Further the institute shall not be responsible for any loss/ damage in this regard including any natural calamity like Cyclone, Fire hazard, Hail storm etc. that may occur after award of Work Order. f) Security/ Safety of Deployed manpower and Institute property shall be the responsibility of the Grantee. g) Expenditure incurred in executing the above work, such as for employing man/machine, tools, equipment s shall be borne by the grantee only. Institute will not bear any expenditure in this regard. h) Work orders will be issued to successful bidder only after deposit of 100% bid value along with under taking as per Annexure-2. If successful bidder /grantee fail to deposit the bid value within 7 days of issuance of letter of acceptance from the Institute then the acceptance will stand cancelled and earnest money deposited will be forfeited and grantee will have no right to enter in to the plantation / collect cashew nuts. i) In case, if any portion of land coming under the section of plantation required by Govt./ Institute for any bona-fide purpose then the grantee have to leave the portion immediately. The grantee will have no right over the land/ plantation and his complaint will not be accepted by the institute. However proportionate bid amount as calculated by the institute will be refunded to grantee for the withdrawn portion of the plantation. 3) PROCESS OF TENDER APPLICATION:- a) Intending bidders can only apply in prescribed form which can be obtained from office of the Project Engineer, IISER Berhampur, Transit Campus ITI Berhampur at Engineering School Road, Berhampur - 760 010, Ganjam District, Odisha during office hours by payment of Rs. 200/-(Rupees Two Hundred Only) towards cost of tender form through SBI I Collect. b) The person / institute / organisation on whose name, the tender form is purchased, can only participate in tender. c) The bidder has to deposit Rs. 2,00,000/-(Two Lakhs Only) as E.M.D in the form of Demand Draft / Bankers Cheque/ SBI I Collect in favour of The Director, IISER Berhampur payable at SBl Berhampur main Branch (Branch Code-000033), Berhampur (Odisha). d) Incomplete bid document in any respect, including signature of the bidder, full address for correspondence, Complete proof of identity (Voter ID, Pan Card, Aadhaar card )Institute receipt in support of purchase of tender form in his /her favour, D.D / Bankers Cheque /State Bank I Collect, earnest money with name of bank and date of issue will be summarily rejected. e) The sealed covers containing the tender documents form along with enclosures should be clearly captioned. Tender for collection of cashew nuts and thalamus for the harvesting season 2018 and should be sent through Registered post / speed post/ courier service/by hand, so as to reach the office of the Project Engineer(E),IWD, IISER Berhampur before the due date & time of submission of the tender. The institute will not be responsible for any postal delay. 4) PROCESS OF TENDER OPENING:- a) The bidder or their authorized representative is only allowed to sit before tender committee on the specified date and time of opening sealed covers. b) After opening of the sealed cover by the members of tender committee and recording of required data in tender opening register maintained by committee, the concerned bidder or his authorized representative present before committee will put his signature in token of his presence. c) The Chairman of Tender Committee reserves all rights of post pone or cancel the Tender process. He is also not bound to accept the highest or any bid. He can also negotiate with the bidders if he so desires to finalise the matter. d) On final acceptance of bid-value offered by a successful bidder, the E.M.D amounts deposited by the Un-successful bidders will be refunded by transfer. All the bidders are required to submit the bank details as per the enclosed format in Annexure-3. The successful bidder has to deposit required bid value as per procedure laid down under Para-2(h) of this terms and conditions. 5) PAYMENT OF BIDVALUES:- a) Successful bidder whose bid is accepted by the competent authority should deposit his bid value as per conditions laid down under Para-2(h) within 7 days of the intimation from the institute. The earnest money of the bidder whose bid is accepted will be transferred as security deposit for the plantation. b) The Security deposit amount will be released after successful and satisfactory completion work within the stipulated time period. 6) PROCESS OF HANDING OVER PLANTATION TO BIDDER AND TAKING OVER FROM GRANTEE:- a) After acceptance of Tender and deposit of prescribed bid value within the stipulated period the bidder will have to sign an undertaking in prescribed format as per Annexure-2. Then work order will be issued in his/her favour for collection of cashew nuts and thalamus from the area. 7) DEPOSIT OF TAXES AND REFUND OF SECURITY:- The bidder will deposit tax as prescribed by Govt. of Odisha / Govt. of India and produce tax clearance certificate from concerned authorities or else the same will be adjusted from the security deposit and the rest amount will be refunded to the bidder. 8) DISPUTE REDRESSAL:- In case of any dispute between both the parties, the decision of Director, IISER Berhampur will be final and binding. Annexure - 2 UNDERTAKING FOR ABIDING TERMS AND CONDITIONS FOR COLLECTION, PLUCKLING AND SELLING OF CASHEW NUT FROM CASHEW PLANTATION LOCATED AT IISER BERHAMPUR PERMANENT CAMPUS LAUDIGAM UNDER KANISI TAHSIL OVER 200 Acres (Approx). I / We the Grantee acknowledges the scope of work as mentioned under the Tender document and submits to abide the terms and conditions, beside other general conditions of Tender document mentioned hereunder: 1. That, I/we shall use the premises only for purpose it has been permitted under the Tender document, any deviation may lead to termination of the tender and I/We shall not claim for any compensation of whatsoever nature thereon. 2. That, I/We shall safeguard the plantations forming the part of the said Tender, from and against all sorts of damages including theft, fire, etc. 3. That, I/We shall carry on the work mentioned under the Said Tender only during the harvesting season i.e. 2018 to 2018. 4. That, the said Tender has been awarded for the duration as mentioned under the Work Order. 5. That, I/We shall cause to safely remove the cashew nuts so harvested in a time bound manner from the premises so as to avoid rotting of cashew nuts. 6. That, I/ we shall vacate the premises within the allowed time period. 7. That, I/We shall abide by the terms and conditions in accordance with the said Tender document. 8. That, I/We shall not cause any type of damage to the plants existing in the said premises while carrying out the work. 9. That, I/We shall not cause any damage to the felling material or lift the same which have been felled in the cyclone and lying in the plantation area. 10.
