INTRODUCTION The Husing Opprtunities Cmmissin f Mntgmery Cunty (HOC) established the HOC Wrks prgram in 2015 in rder t guarantee that HOC emplyment and ther ecnmic pprtunities lcated within Mntgmery Cunty are directed tward lw- and very-lw incme persns, particularly thse wh participate in HOC husing prgrams. In this way, HOC Wrks helps HOC and its partners t give back t the cmmunity by fstering lcal ecnmic develpment, neighbrhd ecnmic imprvement, and individual self-sufficiency. The ultimate gal f HOC Wrks is t prvide jbs fr HOC residents and award cntracts t businesses that share HOC s cmmitment t cntinually bettering the cmmunity which this Agency serves. HOC develped this dcument t set frth guidelines and gals, establish frms, and create preferences fr its administratin f the HOC Wrks prgram. HOC WORKS PROGRAM GUIDELINES Wrk perfrmed under any cntract with HOC, which is funded by any surce ther than the U.S. Department f Husing and Urban Develpment (HUD), is subject t the HOC Wrks Prgram Requirements described herein. HOC established the HOC Wrks Prgram Requirements, as may be amended by the Agency, upn directin by the Executive Directr f HOC. Depending upn the value f the cntract, different numerical gals will apply. The varius numerical gals are as fllws: Cntracts Valued Belw $50,000: Fr a cntract valued belw $50,000, the cntractr must cmply with the fllwing requirements, t ensure it prvides at least ne f the fllwing: 1. Training: Cntractrs may prvide training pprtunities fr HOC residents (especially n-the-jb training). Opprtunities shuld fall under ne, r mre, f the fllwing categries: Life skills/emplyment readiness skills Budgeting, resume writing, interview techniques, etc.; Wrkfrce training Applied training such as frklift peratin, truck driving, cmputer skills with Micrsft Office, etc.; Business develpment skills Entrepreneurship and small business training skills. Other Cntractrs may submit recmmendatins, which HOC staff will review fr apprval. In lieu f prviding direct training pprtunities, cntractrs may make a minimum cash cntributin f three (3) percent f the ttal value f the cntract amunt, plus any mdificatins t the price, t HOC s nnprfit affiliate, Husing Opprtunities Cmmunity Partners (HOCP). Cntributins are directed twards emplyment-related skills training pprtunities fr HOC residents and are tax deductible. Payment shuld be made ut t 1

Acts f Service: Cntractrs may spnsr family activities fr HOC residents. Fr this ptin, cntractrs must submit recmmendatins t the HOC Wrks Prgram Crdinatr fr apprval. Cntracts Valued Abve $50,000: Fr a cntract valued abve $50,000, the cntractr must cmply with the fllwing requirements, t ensure it prvides at least ne f the fllwing: 1. Direct Hiring: Cntractrs and their respective sub-cntractrs may demnstrate cmpliance thrugh a cmmitment t emply HOC residents as five percent (5%) f the aggregate number f new hires fr each cntract executed with HOC. HOC maintains a list f resident resumes and will advertise psitins t qualified residents. Please cmplete the frm prvided in Appendix A s that HOC may apprpriately advertise the psitin. Please nte that this ptin is nt available if the rganizatin des nt plan t hire additinal emplyees fr the purpses f a given cntract. 2. Cntracts: Cntractrs and their respective subcntractrs may demnstrate cmpliance thrugh a cmmitment f awarding HOC Wrks Business Cncerns at least three percent (3%) f the ttal dllar amunt f the given cntract. Please see Appendix B fr the definitin f an HOC Wrks Business Cncern. 3. Other Ecnmic and Training Opprtunities: Cntractrs may make a minimum cash cntributin f five (5) percent f the ttal value f the cntract amunt, plus any mdificatins t the price, t HOC s nnprfit affiliate, Husing Opprtunities Cmmunity Partners (HOCP). Cntributins are directed twards emplymentrelated skills training pprtunities fr HOC residents and are tax deductible. Other Cntractrs may submit recmmendatins, which will be reviewed by HOC staff fr apprval. Mnetary Value f Other Ecnmic Opprtunities A cntractr may use any ne r mre f the abve described ther ecnmic and training pprtunities, but the cntractr must demnstrate that the cst r value f such ecnmic pprtunities with respect t each HOC Wrks Cvered Cntract is nt less than five (5) percent f the ttal cntract amunt fr cntracts valued abve $50,000 and nt less than three (3) percent f the ttal cntract amunt fr cntracts valued belw $50,000. In rder t demnstrate that the cst r value f such ecnmic pprtunities meets the minimum percentage described abve, cntractrs are subject t the fllwing: Fr paid ecnmic pprtunities such as purchasing materials, hiring HOC Wrks Residents fr ther prjects, and subcntracting t HOC Wrks Business Cncerns fr ther prjects, cntractrs must use the real amunt paid t demnstrate that the cmbined ttal cst r value meets the minimum percentage described abve. Fr nn-paid ecnmic pprtunities such as training, internship, and mentrship pprtunities, cntractrs must assume that the mnetary value f every ne hur f assistance is equal t $100. Cntractrs then must prvide the apprpriate number f hurs f ecnmic pprtunities needed t equal the minimum percentage described abve. These hurs can be divided up amng multiple recipients. Fr example: If the value f the HOC Wrks Cvered Cntract is $51,000, then the cntractr must prvide at least $2,550 wrth f ther ecnmic pprtunities (5%). At a rate f $100 per hur, the cntractr wuld need t prvide apprximately 26 hurs wrth f ecnmic pprtunities. If the value f the HOC Wrks Cvered Cntract is $49,000, then the cntractr must prvide at least $1,470 wrth f ther ecnmic pprtunities (3%). At a rate f $100 per hur, the cntractr wuld need t prvide apprximately 15 hurs wrth f ecnmic pprtunities. The HOC Wrks Prgram Crdinatr will mnitr t ensure that cntractrs adhere t these cmpliance requirements. HOC WORKS COMPLIANCE REQUIREMENTS Assuring cmpliance with HOC Wrks plicies requires affirmative effrts frm all invlved parties. All cntractrs, subcntractrs, and develpers subject t HOC Wrks are required t prvide ecnmic pprtunities t HOC Wrks Residents and/r HOC Wrks Business Cncerns. Failure r refusal t cmply with HOC Wrks plicies will necessarily lead t the penalties and sanctins identified in this sectin. 3
Befre a new cntract is released fr public bid, HOC s Real Estate Develpment Department submits a cmpleted Prject Infrmatin (PI) frm t the Cmpliance Department. Cmpliance staff reviews the scpe f wrk and funding surce f each prject t determine if the prject is subject t these HOC Wrks Prgram Requirements. The Cmpliance Department cmpletes its prtin f the PI frm and returns it t the Real Estate Develpment Department. The Real Estate team infrms the Prcurement Department f the apprpriate HOC Wrks requirements s that they may be added t the bid prpsal which is released t ptential respndents. HOC cntractrs and subcntractrs must cmply with the versin f these Prgram Requirements which are in effect at the time HOC releases the Request fr Prpsal (RFP), Request fr Qutatin (RFQ), Invitatin fr Bid (IFB), r Payment Order (PO) fr the cvered cntract, s lng as the cntract is awarded and executed within 10 days f the RFP, RFQ, IFB, r PO issuance. If the cntract is awarded and executed mre than 10 days after the RFP, RFQ, IFB, r PO issuance then the current versin f these Sectin 3 Prgram Requirements at that time is in effect. Once the cntract is awarded and executed the applicable versin f these Prgram Requirements is lcked-in based upn the abve criteria. Prir t cntract award, all cntractrs subject t HOC Wrks must submit t HOC an HOC Wrks Plan which features all f the fllwing: 1. Identificatin f which cntract value categry the cntractr is subject a) Cntracts Valued Belw $50,000 r b) Cntracts Valued Abve $50,000. 2. Identificatin f which ecnmic pprtunity categry the cntractr seeks t implement. a) Fr cntracts valued belw $50,000, the ptins are: i. Training r ii. Acts f Service. b) Fr cntracts valued abve $50,000 the ptins are: i. Direct Hiring, ii. Cntracts, r iii. Other Ecnmic and Training Opprtunities. 3. A narrative describing hw the cntractr will track and implement HOC Wrks requirements. If the HOC Wrks Crdinatr has questins r cncerns, the cntractr s apprpriate representative(s) must address them within five (5) business days. In the event a cntractr, subcntractr, r develper refuses t cmply with the HOC Wrks Prgram Requirements after the award f a cntract, HOC will prvide the cntractr with 10 business days frm the date f ntificatin t remedy their nncmpliance. If the cntractr fails t cure the breach f cntract, HOC may chse t terminate the cntract r apply the fllwing penalties: Fr cntracts under $50,000, HOC will retain three percent (3%) f the ttal value f the cntract amunt, plus any mdificatins t the price. HOC Academy will receive these funds and use them fr emplyment-related skills training pprtunities fr HOC residents. 4
Fr cntracts ver $50,000, HOC will retain five percent (5%) f the ttal value f the cntract amunt, plus any mdificatins t the price. HOC Academy will receive these funds and use them fr emplyment-related skills training pprtunities fr HOC residents. Cntractr Reprting: Cntractrs subject t HOC Wrks are required t submit regular reprts t the HOC Wrks Prgram Crdinatr n a schedule t be determined based n the length f a given cntract. These reprts are designed t demnstrate a cntractr s prgress twards meeting the gals identified in their HOC Wrks Opprtunities Plan. In cnnectin with an audit fr cmpliance, HOC reserves the right t request additinal infrmatin frm a cntractr at any time during the cntract t supprt the cntractr s effrts t cmply with the requirements f HOC Wrks. Appendix B: HOC Wrks Definitins Cntractr Any entity which cntracts with HOC t perfrm wrk generated by the expenditure f funds by any surce ther than the U.S. Department f Husing and Urban Develpment. HOC Wrks Business Cncern An entity that prvides ecnmic pprtunities fr lw- and very lw-incme persns and is ne f the fllwing: 1. A business that is at least 51 percent r mre wned, cntrlled, and managed daily by HOC Wrks Residents; r 2. Permanent, full-time emplyees include persns, at least 30 percent (30%) f whm are currently HOC Wrks Residents, r within three years f the date f first emplyment with the business cncern were HOC Wrks Residents; r 3. An entity that prvides evidence f a cmmitment t subcntract in excess f 25 percent (25%) f the dllar award f all subcntracts t be awarded t business cncerns that meet the qualificatins set frth in paragraphs (1) r (2) in this definitin f HOC Wrks Business Cncern ; r 4.
