Our business practices and the volume of filings required in our circuit necessitate we focus on the most efficient methods of delivery services, including implementation of batch filing. The Public Defender's Office of the Fifth Judicial Circuit will be prepared to participate in single session e-filing by October l, 2013. That being said, we will be requesting a deferral in our circuit's e-filing deadline. This requested delay is based upon the unnecessary burden and workload that single session e-filing will place on our staff. My office will support any delay that allows all interested parties to address any issues that prevent us from performing batch filing. This includes, but is not limited to, matters pertaining to the portal, training, and testing of the system. The Public Defender, along with the other criminal justice filers in the 6th Circuit, are developing a case management system that will be operational in 2014. Significant resources are currently dedicated to development of the new case management system. Therefore, we request a deferral for e-filing and e-service until such time as batch filing and e-service is developed and tested, and our attorneys and assistants can be trained on its use. Due to technical issues, and an inability to test or train staff, this office cannot technically achieve single-session filing or e-service by October 1. In addition to technical issues, there are significant workload concerns with implementing with single-session filing and e-service in the 11th circuit. With a volume of close to 700 filings per day, implementing single-session filing and e-service will cause significant interruption to and disrupt our ability to meet our statutory duties and responsibilities to our clients and the courts. Our business practices and the volume of filings required in our circuit necessitate we focus on the most efficient methods of delivery services, including implementation of batch filing and e-service through the portal. Requiring this office to focus on implementing single-session filing and e- service will result in our having to divert resources for preparing for batch filing and cripple our business operations. Therefore, we request a deferral for e-filing and e-service until such time as batch filing and e-service through the portal is developed and tested, and our attorneys and assistants can be trained on its use. While this office can technically achieve single session filing, significant resources will have to be allocated to ensure its implementation on October 1, thereby causing significant interruption to existing services and court business. These resources will continue to have to be devoted to single session filing until the more efficient batch filing process is available. Our business practices and the volume of filings required in our circuit necessitate we focus on the most efficient methods of delivery services, including implementation of batch filing. Requiring this office to focus on implementing single session filing will not only disrupt our ability to meet our statutory duties and responsibilities to our clients, but will also result in our having to divert resources that could be expended on preparing for the more efficient batch filing, delaying its readiness. This office can technically achieve single-session filing in civil mental health/probate cases. However, we have been unable to test either singlesession filing or batch filing on criminal cases and will be unable to implement them on October 1. The case management system presently in use by the Hillsborough County Clerk of Court is technically unable to accept filings through the portal, and our information indicates the Clerk s new case management system will be operational in Summer 2014. Additionally, we have been advised that the State Attorney s Office will be unable to implement e-filing or e-service on October 1 and intends to seek a deferment. To ensure consistency, uniformity, and efficiency of operations, we ask that any deferment granted to the State Attorney s Office or the Clerk of Court also be granted to this office so as to ensure we have the ability to properly test and train our attorneys on both e-filing and e-service.

While this office can technically achieve single session filing, its implementation on October 1 will cause significant interruption to services and court business. Our business processes and the volume of filings required in our circuit necessitate we focus on implementation of batch filing. Requiring this office to focus on implementing single session filing will not only disrupt our ability to meet our statutory duties and responsibilities to our clients, but it will also adversely affect our ability to be ready for batch filing. Therefore, we request a deferral for e-filing and e-service until such time as batch filing is developed and tested, and our attorneys and assistants can be trained on its use. While we believe this office can technically achieve single session filing by October 1, significant resources will have to be allocated to ensure its implementation, thereby causing significant interruption to existing services and court business. These resources will continue to have to be devoted to single session filing until the more efficient batch filing process is available. Our business practices and the volume of filings required in our circuit necessitate we focus on the most efficient methods of delivery services, including implementation of batch filing. Requiring this office to focus on implementing single session filing will not only disrupt our ability to meet our statutory duties and responsibilities to our clients, but will also result in our having to divert resources that could be expended on preparing for the more efficient batch filing, delaying its readiness. Additionally, our information indicates the Clerk of Court has encountered issues during testing and our State Attorney intends to seek a deferment. Therefore, we request a deferral for e-filing and e-service until such time as batch filing is developed and tested, and our attorneys and assistants can be trained on its use. As of this date, we have not been able to achieve single session filing to our clerk although they anticipate this happening within the next week. However, even if we are able to do so, significant resources will have to be allocated to ensure its implementation on October 1, thereby causing significant interruption to existing services and court business. These resources will continue to have to be devoted to single session filing until the more efficient batch filing process is available. Our business practices and the volume of filings required in our circuit necessitate we focus on the most efficient methods of delivery services, including implementation of batch filing. Requiring this office to focus on implementing single session filing will not only disrupt our ability to meet our statutory duties and responsibilities to our clients, but will also result in our having to divert resources that could be expended on preparing for the more efficient batch filing, delaying its readiness. Batch filing is not simply a desire but an absolute necessity for us to function. Therefore, we request a deferral for e-filing until such time as batch filing is developed and tested. We are actively training our attorneys This county is currently unable to accept batch filings, and the Public Defender case managment system (Pioneer) needs additional development to communicate correctly with the portal.

Glades County Clerk of Court is developing a new case management system that is expected to be completed at the end of September 2013. As a result, the Public Defender's Office has been unable to time to test functionality or train employees. We have been advised there is a deferment request for this county until the Judicial Viewer is available.
