Fall Craft Sale 2014 ASI Craft Center, UU Plaza, Cal Poly Monday Wednesday, November 3-5 Artists, Fall is here, which makes it the perfect time to sell your crafts in the University Union Plaza under sunny skies. Whether you re a veteran or have never sold your work before, the sale is a fun and friendly event to experience. Come join us for this fun event. Please read this packet CAREFULLY!! It is your responsibility to return all required forms. OUR MISSION The mission of ASI s Fall Craft Sale is to promote Craft Center awareness and to provide a location for talented artists to sell their work. WE SHOWCASE HANDMADE CRAFTS Crafts that are made by the artists themselves are the only crafts we wish to showcase. If you are unsure about the status of your crafts, it is your responsibility to contact me. Food and drinks are not considered craft items and therefore may not be sold. If you have any questions about this policy please contact me for clarification. VENDORS Student vendors will be subject to a commission of 15% and non-students a commission of 25% paid to the Craft Center on all sales. The Craft Center cashier booth will collect sales on each sales day and a check will be issued to each vendor once the sale is over, less the commission fee. A $12.00 application fee is required by all vendors to reserve space. This fee must be paid at the time you turn in your completed application. For any cancellations, a $5.00 processing fee will be deducted. No refunds will be given after October 24. As a volunteer, you are expected to work a minimum of 4 hours at the event. Sign-ups for volunteer hours can be found at the Craft Center Front Desk. Each vendor will receive a Craft Sale T-Shirt that we encourage you to wear to support the event. SECURITY There will be volunteers overlooking all artwork during show hours. However, the Craft Center is not responsible for lost or stolen merchandise during the sale or for goods stored in the Craft Center overnight. VENDOR APPLICATION, W-9 AND SERVICES AGREEMENT: DUE ON 10/24/14 Again, it is your responsibility to complete the information in this packet and complete the W-9 1 taxpayer identification form. Please read and complete the Application and Services Agreement for this year s Craft Sale. By sending in your payment and paperwork, you are signifying that you have read the information and will adhere to all the policies and guidelines herein. Return all paperwork to the Craft Center Front Desk with your $12.00 deposit check. Fall Craft Sale 2014 ASI Craft Center, UU Plaza, Cal Poly Monday Wednesday, November 3 5 TIMELINE October 1 October 24 VENDOR PACKETS AVAILABLE Vendor application packets are available in the Craft Center at the Front Desk. SCHEDULE VOLUNTEER HOURS Vendors are required to volunteer for four hours during the Craft Sale. Sign up Craft Center Doodle calendar starting October 1. Each vendor will be invited to Participate in the Doodle calendar after they submit their completed paperwork into the ASI Craft Center. Friday, October 24 PAPERWORK AND PAYMENT DUE DATE Submit your application, W-9, Services Agreement and payment to the Craft Center Front Desk by Friday, October 24 at 5:00 p.m. Sunday, October 26, 6 8 pm MANDATORY VENDOR MEETING All vendors (vets and newbies) will meet with the Craft Center Staff to discuss the week and distribute last minute details. This will also allow you time to organize your items in the Craft Center for the following week before the sale begins. Monday Wednesday, November 3-5 CRAFT SALE! Monday, Tuesday and Wednesday, 9:45 am 4:15 pm. Set up begins at 8:45 am; take down ends at 5 pm. Each vendor is responsible for the set-up and take-down of their crafts. Monday, November 17 PICK UP YOUR CHECK Checks will be available for pick up at ASI Business Office, Room UU 212, located on the second floor of the University Union.

If you are unsure if you fit this definition, please enclose photos of your work. No food products allowed. THIS CONTRACT IS BINDING, PLEASE READ IT! 1. The ASI Craft Center agrees to provide a space of display at the sale. 2. As a Cal Poly student or member of the community at large, I the under signed, do hereby commission the ASI Craft Center to act in my behalf and receive payment for my products. For this service, I agree to pay the Craft Center 15% of the listed selling price of all products sold. If I am not a Cal Poly Student, I understand that 25% of the listed selling price will be paid to the Craft Center. With this application I will submit a NON-refundable $12.00 application fee for a space reservation. Application and deposit need to be dropped off at the Craft Center by October 24, 2014 at 5:00 pm. No exceptions will be made. 3. I understand that every item must be individually priced. 4. Set up time will start no earlier than 8:45 am. Clean up time will start no later than 4:15 p.m. Selling times are Monday, Tuesday and Wednesday - November 3, 4, and 5 from 9:45 am to 4:15 pm. I understand that I am responsible for ALL set up and clean up of my crafts each day. If my items are not cleaned up by 5:00 pm, they may not be put out for sale the next day. Absolutely nothing (merchandise or displays) can be left in the Craft Center past November 17, 2014. 5. I understand that I am responsible to volunteer at the Craft Sale for a minimum of 4 hours beyond the required setup and cleanup time and will wear the provided ASI staff T-shirt. Sign-ups for these hours will be done on the Doodle calendar web page, beginning October 1, 2014. 6. I understand that the ASI Craft Center will not be held liable for any damages or losses occurring before, during or after the sale. 7. I understand that cancellation past the beginning of the event may result in a loss of opportunity to sell at a future Craft Sale. 8. I understand that leaving the Craft Sale before 4:15 pm on November 5 will result in not being permitted to return to future ASI Craft Sales. 9. If the previously stated requirements are not fulfilled, an additional 5% will be taken from my sales. 10. Absolutely NO late applications will be accepted. Signature: Date:

SERVICES AGREEMENT It is hereby agreed by and between, (hereinafter referred to as the PROVIDER ) and the Associated Students, Inc. of California State University, San Luis Obispo (hereinafter referred to as ASI ): In consideration of the mutual understanding of the parties contained in this Agreement the undersigned PROVIDER and ASI submit to the following terms and conditions for the services described below: Name of the Provider: Type of Service to be provided: Craft Center Fall 2014 Craft Sale. Location of Service: University Union Plaza and Craft Center. Date(s) of Service: November 3, 4, and 5, 2014. It is further agreed and understood that: ASI will not be held responsible for any theft or damage of artwork. TERMS and CONDITIONS INDEPENDENT CONTRACTOR In assuming and performing all obligations of this contract the PROVIDER is functioning as an independent contractor. All persons, if any, hired by the PROVIDER to perform services under this Agreement, shall be independent contractors and shall not be construed as employees of ASI. INDEMNIFICATION The PROVIDER shall defend, indemnify, hold harmless and protect the State of California, the Trustees of the California State University, the California State University, California Polytechnic State University, San Luis Obispo, Associated Students, Inc., the officers, employees, representatives, agents, students and volunteers of each of them (the University ), from and against any and all liability, loss, damage, expense, cost, (including without limitation costs and fees of litigation) of every nature arising out of or in connection with PROVIDER S (any subcontractor, anyone directly or indirectly employed by anyone whose acts any of them may be liable), except to the extent of any loss, damage, claim, injury or liability arises out of the sole negligence or willful misconduct of the State of California, the Trustees of the California State University, Associated Students, Inc. and their officers, employees, agents and/or contractors. INSURANCE ASI requires proof of liability, property, auto and/or worker s compensation insurance with specified limits of coverage and minimum ratings from the PROVIDER prior to initiation of the services described in this Agreement. In order to meet this requirement the PROVIDER must name ASI and the University as Additional Insured on any required insurance policies. Inability of the PROVIDER to meet insurance requirements established by ASI will result in immediate cancellation of this Agreement. All required insurance documentation must be in the possession of ASI prior to commencing the services detailed in this Agreement. CANCELLATION ASI may cancel this Agreement, or any work authorized under this Agreement, with 48 hours written or verbal notice if, in the sole judgment of ASI, the PROVIDER fails, refuses or is unable to satisfactorily perform the work in accordance with this Agreement. In the event of cancellation, ASI will pay the PROVIDER for services satisfactorily performed prior to the effective date of cancellation.

COMPLIANCE WITH LAWS The PROVIDER shall comply with all applicable federal, state and local laws, rules and regulations, and shall obtain all applicable licenses for the conduct of the business and performance of work called for in this Agreement. SOLE AGREEMENT It is mutually understood and agreed that no alteration or variation of the terms in this agreement shall be valid unless made in writing and signed by the parties. This is the sole agreement of the parties and supersedes all prior discussions or communications. This Agreement is not assignable, in whole or in part, by either party. DISPUTE RESOLUTION The Agreement will be interpreted under the laws of the State of California. Any action arising from this Agreement shall be litigated only in the courts located in San Luis Obispo, California and the parties hereby consent to the jurisdiction of any Superior/Municipal court located in the County of San Luis Obispo. For any dispute arising out of this Agreement the prevailing party shall be entitled to recover reasonable attorney fees incurred in resolution of the dispute.
