A number of areas remain uncertain and with very limited offi cial guidance from HMRC, IPs often struggle to know the right approach to take. In this practical session, R3 s Technical and Education Director will try to answer your questions and more, providing valuable insight into how HMRC believe tax in personal insolvencies ought to be treated. For anyone dealing with personal insolvencies this session is not to be missed. Caroline Sumner, R3 Corporation Tax and VAT Update In this session we will provide insight into the VAT and Corporation Tax implications for managing insolvency and restructuring assignments, covering an overview of the applicable rules, case studies based on practical experience, and HMRC s approach. Julia Fox, Darren Hattersley and Dave Taylor, Deloitte LLP (Leeds) Mairéad Warren de Búrca, Alvarez & Marsal Taxand UK LLP (London) Voluntary Arrangements The perspective from HMRC In this practical and informative session, Kevin Hatt from HMRC will provide an update on his team s structure and policies including how a CVA or IVA proposal is considered, when a modifi cation would be put forward and what information HMRC is looking for to assist them in engaging with the process fully. He will also touch on any diffi culties for HMRC in engaging with the process under the new Insolvency Rules and what steps IPs can take to overcome this. Kevin Hatt, HMRC 11:00 Coffee break Tax and Statutory Interest in MVLs HMRC have recently changed approach in their interpretation of the law in relation to statutory interest and the point from which interest should accrue. This session outlines the change in approach, steps that can be taken to mitigate the amount 11:15 of interest arising and the obligations of the practitioner in relation to withholding tax. There will also be a general overview of the key tax issues to consider before and during the process of an appointment. Julia Fox, Deloitte LLP (London) Caroline Jackson and Marcus Rea, Deloitte LLP (Leeds) A Pit Stop for Accelerated Payment Notices The accelerated payment regime in the context of tax avoidance is changing the tax landscape and has led to a huge revenue boost to the Exchequer, signifi cantly more than 12:10 expected. In this session we look at what to do when you encounter APNs as well as PPNs and Follower Notices. Stewart Perry, Fieldfi sher (London) Carly Schiff, Fieldfi sher (Leeds) Chair Close 12:55 Charles Turner, CVR Global LLP How is the course different from last year? This course aims to build on last year s highly regarded course by using market leaders to help tackle a variety of challenging issues which have recently come to the fore. It will continue to look at tax avoidance matters but this year will hear a legal perspective on the consequences of APNs for debtors and IPs alike and consider potential approaches to be taken by IPs. It will also look at tax issues arising in personal insolvency from a practical perspective, an area on which it has been diffi cult to obtain authoritative guidance. What will delegates gain from attending? A good understanding of the current challenges facing IPs and sound practical advice on best practice. IPs and their staff really do need to know how to avoid falling foul of the pitfalls and traps which lie in wait for the unwary, to protect their clients as well as themselves.
