SECTION A: SUPPLIES OR SERVICES AND PRICES/COSTS Geauga Park District is seeking a contractor to complete design and construction of a stream restoration project for Griswold Creek at Bessie Benner Metzenbaum park. This project is funded through a United States Environmental Protection Agency (US EPA) Great Lakes Restoration Initiative (GLRI) grant through the Ohio Environmental Protection Agency (Ohio EPA). This contract will include assistance to Geauga Park District and coordination with its project partner, the Chagrin River Watershed Partners, Inc. (CRWP). CRWP is a non-profit technical organization founded by the cities, villages, townships, counties, and park districts of the Chagrin watershed. CRWP assists their 34 members with addressing flooding and erosion problems, protecting and restoring natural areas, and land use and natural resource planning. More information about CRWP is available at www.crwp.org. The contractor shall furnish all necessary drawings, plans, labor, equipment, and construction oversight services to complete the project. The contractor will be responsible for providing all information and for securing, on behalf of Geauga Park District, all necessary local, state and federal permits for the project. No work shall be commenced until the permits are secured. The total maximum cost/price for performance under this contract is $253,765. This maximum amount of $253,765 shall not be exceeded under any circumstances unless written authorization is obtained from Geauga Park District. All proposals shall include the total amount necessary for completion of the project. The proposal shall include an itemization of the cost of materials, labor and any additional cost the contractor deems necessary. Candidates may provide discussion and comment on alternative approaches to achieve the restoration objectives identified for the site, and to propose alternate and/or complimentary tasks to complete the project more economically. SECTION B: BACKGROUND DESCRIPTION AND CONCEPTUAL PLAN Griswold Creek is a coldwater habitat tributary to the Chagrin River. It drains 7.27 square miles (USGS StreamStats), with its headwaters in Chester and Russell Townships in Geauga County and flows south to the Chagrin River mainstem in the Village of Hunting Valley in Cuyahoga County. Griswold Creek was recommended for Superior High-Quality Water or General High-Quality Water designations under the Antidegradation Rule (3745-1-05) based on its exceptional habitat, declining species, and its high level of biological integrity (Chagrin River TSD, 2006, p. 30). However, the creek is impaired by poor habitat and thermal modification due to suburban development, stormwater runoff, and removal of riparian vegetation. These sources of impairment have destabilized the stream corridor, causing entrenchment, severe
erosion, and loss of floodplain connection. Several locations in the creek are in partial or non-attainment of water quality standards. In 2012 a Griswold Creek Restoration Plan was developed by Enviroscience with funding from the Lake Erie Protection Fund. The full plan can be found here: http://crwp.org/index.php/projects/research-projects/152- griswold-stream-study The project is located at Geauga Park District s Bessie Benner Metzenbaum Park at 7940 Cedar Road in Chester Township. This park includes 2 parcels: 11-711300 (50.0 acres) on the west side of the park and 11-711400 (17.65 acres) on the east side of the park (Exhibit A). At Bessie Benner Metzenbaum Park, Griswold Creek is destabilized and exhibits entrenchment, downcutting and loss of floodplain connection. In the upper reaches of the stream through the park, the recommendation from the Griswold Creek Plan is to aggrade the streambed and restore hydrologic connection between the stream and its riparian floodplain and wetland. Conceptual restoration plans were developed by Enviroscience using data from the study and are included in this RFP. The Conceptual plan developed by EnviroScience (Exhibit B) calls for: 1,345 linear feet of stream restoration to aggrade the streambed, reconnect to the floodplain, and stabilize banks At least one distinct grade control structure to convey base flow and stormwater flow into the existing channel from the restored section. Native plantings in riparian areas and plants for access road and borrow areas SECTION C: CONTRACTOR SCOPE OF SERVICES AND SCHEDULE Through this Request for Proposals, Geauga Park District will select the lowest and most qualified contractor to provide recommendations, designs and restoration specifications, permitting and permit compliance including monitoring and reporting and construction for the Bessie Benner Metzenbaum Park Restoration Project. The selected contractor will complete a restoration design, be responsible for preparing, filing and obtaining all necessary local, state and federal permits and certifications under the Clean Water Act, and complete construction of the project. The selected contractor will complete construction of the project and provide as-built plans and a QHEI and BEHI assessment after project completion. A summary of the contractor scope of services and proposed schedule are as follows: CONTRACTOR SCOPE OF SERVICES 1. Provide plans, restoration specifications, and complete construction of 1,345 linear feet of streambank stabilization. Plans should achieve the following: a. Reconnect Griswold Creek with its historic floodplain by aggrading the streambed. b. Use at least one distinct grade control structure at the downstream terminus to convey water from the restored section to the existing channel. c. Planting plan with lists of plant species to be utilized.
2. Revise plans based on comments from CRWP, Geauga Park District, and regulatory agencies. At least two rounds of plan review and revisions are anticipated. 3. Provide calculations and quantities for soil excavation associated with this project if applicable. 4. If wetlands are impacted as a result of this project, mitigation will be completed on site and included as a part of this design/build project. Bidders shall indicate whether they anticipate any wetland impacts in their proposal. 5. Disturbance to existing natural vegetation shall be minimized in accessing the site and restoring the stream. 6. Prepare, file, and obtain all necessary state and federal permits and certifications under the Clean Water Act. 7. Provide and execute a Stormwater Pollution Prevention Plan (SWP3) for the project. Erosion and sediment discharge must be controlled throughout the construction process in accordance with the Ohio EPA construction general permit and local erosion and sediment control regulations, if applicable. 8. Project design shall protect water quality and stream integrity as much as possible during construction. 9. A floodplain development permit must be filed for this work. The floodplain development permit applications shall comply with all federal and state statutes, and local laws, rules and ordinances. 10. All work shall be performed in a lien-free, good and workmanlike manner and in accordance with the requirements of all applicable government ordinances, codes, regulations and laws. 11. Any areas disturbed to access the site, including roadways/right of ways must be restored to former condition at the close of this project at the Contractor s expense. Contractor must obtain photographs and video of Cedar Road and submit copies to Geauga Park District prior to the commencement of construction. 12. Contractor must provide a one-year warranty on plant materials installed through this project, ensuring 75% survival of all live stake plantings and 90% survival for all other plant material. Plant materials shall be replaced by the warranty if more than 25% of the plant is dead, diseased, or dying. The one-year warranty will also allow for repair or replacement of any deficient stream stabilization and inwater structures. a. Warranty Period means a period of one (1) year from the Final Completion Date of the entire Work (or a specific part of the Work) or the longer periods of time as may be required by specific warranties contained in the Construction Agreement, provided by manufacturers or suppliers, or as otherwise stated in any Certificate of Final Completion, during which the contractor, at its sole cost and expense, shall remove or correct all Work performed by Contractor under the Contract Documents, which Geauga Park District deems to be defective in material or workmanship or not in conformance with the Contract Documents. 13. Contractor shall be responsible for conducting all project monitoring activities and reporting required for compliance with federal, state, and local permit conditions.
14. All materials, reports, surveys, delineations, plans, etc. will be available to Geauga Park District to use for educational materials and signage, grant documentation and reporting, and permitting. 15. Each part or detail of work shall be subject to inspection by Geauga Park District. 16. Perform QHEI and BEHI at the project site to provide updated baseline data. 17. In addition to any required permit compliance documentation the contractor shall provide the following to Geauga Park District upon completion of the project: asbuilt construction plans, a Qualitative Habitat Evaluation Index (QHEI) evaluation and a Bank Erosion Hazard Index (BEHI) evaluation. Any additional planting/seeding to be completed. All work under this contract, including invoices, must be completed and delivered to Geauga Park District. SECTION D: APPLICABLE LOCAL, STATE AND FEDERAL REQUIREMENTS The selected contractor must comply with all duties and obligations under the Ohio EPA GLRI Grant (Exhibit C). GENERAL In the performance of the duties and obligations under the Ohio EPA GLRI Grant Agreement, contractor shall comply with all applicable: a. Ohio Governor Executive Orders; b. Federal, state and local laws, regulations (rules), assurances, orders, and Ohio Department of Commerce Prevailing Wage Guidelines, regarding prevailing wages, deductions, worker compensation, taxes, social security and unemployment, compensation, and any contributions thereto; and c. Federal state, and local laws and regulations (rules, ordinances), assurances, and orders, whether or not specifically referenced herein. d. All terms and conditions of the Bessie Benner Metzenbaum Park Restoration GLRI grant through Ohio EPA.
LIABILITY The Contractor agrees to indemnify and to hold Geauga Park District and CRWP harmless and immune from any and all claims for injury or damages arising from this Agreement which are attributable to Contractor s own actions or omissions or those of its trustees, officers, agents, employees, subcontractors, suppliers, third parties utilized by Contractor, or joint venturers while acting under this Agreement. In no event shall either party be liable to the other party for indirect, consequential, incidental, special, or punitive damages, or lost profits. CONTRACTOR S LIABILITY Throughout the contract period, the Contractor shall carry Workers' Compensation Insurance, as required by the Ohio Workers' Compensation Act, upon all its employees engaged in this work and shall be responsible to see that any sub-contractors carry such insurance on their employees. The Contractor shall also provide public liability and property damage insurance for the entire period, thus insuring the interests of all parties against any and all claims that may arise out of Contractor operations under the terms of this contract. It is agreed that in the event any carrier of such insurance exercises cancellation, notice will be made immediately to Geauga Park District of such cancellation. TRANSFER OF RECORDS Data shall be collected and formatted in a manner consistent with common good engineering practices. All records (bank erosion and habitat assessments, original tracings, maps, field sketches, lab reports, flow data, graphics originals, design calculations, electronic files including model input and output files, etc.) generated by the project shall be the property of Geauga Park District and shall be turned over to Geauga Park District upon completion or as directed. SECTION E: INSTRUCTION TO OFFERERS PROPOSAL FORMAT In responding to this RFP, please submit a proposal addressing the following items: 1. Description of Consultant Understanding of the Project. 2. Description of Services to be Performed. 3. Assumptions and Expectations. 4. Cost Proposal. Please provide a cost proposal including total hours available, hours per staff, and direct labor by labor category; overhead and other direct costs; and profit. 5. Personal Experience and Resumes of Personnel. 6. Proposal shall include proof of worker s compensation, and proof of liability insurance with a $1,000,000 minimum. 7. Monitoring SELECTION AND AWARD PROCESS The selection process will involve screening of submitted proposals and may also involve interviews. Geauga Park District will select a contractor on the basis of contractor qualifications, understanding of the scope of services, and level of services to be provided. Any contract awarded under this invitation will be financed through the Ohio EPA GLRI Grant. Any contract awarded under this invitation will be financed through the GLRI grant program. No employee of the Ohio EPA, the US EPA or any departments or subdepartments thereof shall be a party to this invitation for proposals or any resulting contract. A mandatory pre-bid meeting will be held on March 1, 2018 at 10:00 a.m. at the Bessie Benner Metzenbaum Park picnic area (GPS coordinates: 41.509898, -81.357828) to discuss the project. A visit to the project site will follow the meeting in order to tour the project area. Contractors must attend the mandatory pre-bid meeting to submit proposals but also may conduct additional site visit with pre-notification to Geauga Park District. Sealed proposals will be received by Paul Pira with Geauga Park District, 9160 Robinson Road, Chardon, Ohio 44024-9148 until 11:30 a.m. local time on Monday, March 19, 2018. Proposals received after this time and date will not be accepted. All proposals shall be received in sealed envelopes and clearly marked with the project title, Bessie Benner Metzenbaum Park Restoration and contain the full name of the submitting Contractor. The Board reserves the right to accept separate proposals on various items or work, or to accept any combination of proposals, in whole or in part. The Board will award the Contract based on the lowest and best proposal. Geauga Park District may reject any or all proposals on any basis and without disclosure of a reason or to waive any informalities or irregularities in the proposals received. The failure to make such a disclosure shall not result in accrual of any right, claim, or cause of action by any unsuccessful bidder against Geauga Park District.
No Contractor may withdraw their proposal for a period of sixty (60) days after the date of proposal opening. If not accepted within such period, said proposal may be withdrawn. The successful Contractor will be required to furnish within ten (10) days after receiving a written notice of award the following information: A Certificate of General Liability Insurance with a 30-day notice of cancellation and the Geauga Park District listed as Additional Insured in the amount of $1,000,000. A current copy of the Contractors Workmen s Compensation Certificate. A notarized copy of the Geauga County Real Estate Tax Disclosure. Certification of Compliance with ORC 9.24 (HB-95) as of January 1, 2004 regarding Auditor of Sate Search for Findings for Recovery database. Upon acceptance of the required information, a formal contract agreement will be prepared and forwarded to the successful Contractor. Geauga Park District expects to award the contract by April 10, 2018. Work will commence after successful execution of a contract for services between the contractor and Geauga Park District and contract approval by Ohio EPA. All work under this contract, including invoices, must be completed and delivered to Geauga Park District by Sunday, June 30, 2019. Geauga Park District reserves the right to waive any informalities or minor irregularities, reject any and all statements that are incomplete, conditional or obscure, accept or reject any and all proposals with or without cause. Neither Geauga Park District, Chagrin River Watershed Partners, Inc., nor their representatives shall be liable for any expenses incurred in connection with the preparation of a response to this RFP. Geauga Park District reserves the right to obtain financial data or other supplemental information concerning the bidders, if relevant. Bidders should prepare their proposals simply and economically, providing a straightforward and concise description of their abilities to provide the services described at the expected quality level. Geauga Park District reserves the right to accept the proposal deemed most advantageous and in the best interest of Geauga Park District.
