Specifications Overview The Orleans County Marine Park is a public recreation facility consisting of two sites, one at Point Breeze and one at the Lake Ontario State Parkway Interchange, comprising approximately 12 acres. The facility provides boaters, anglers and picnickers with access to the scenic Oak Orchard River gorge and Lake Ontario. The park offers boat slip rental for 71 vessels, boat launch, fishing dock, sheriff communications center, picnic area with two pavilions, park office, three comfort stations, playground, paved parking, scenic overlook and walkway. The general public is permitted access to the Marine Park for dock fishing, boat launching, special events, picnicking, parking, walking, restroom use and the general enjoyment of the Marine Park. A third parcel, at the intersection of Routes 18 and 98, is the site of a gateway sign welcoming visitors to Point Breeze. This parcel is not part of the Marine Park, however, it is to be mowed and trimmed under this agreement. The County of Orleans is seeking written quotes from qualified Contractors to provide turf mowing and trimming services at two parcels comprising Orleans County Marine Park on Point Breeze Road in the Town of Carlton, and a third parcel described above. This bid request is for a one (1) year contract period with the opportunity for up to four (4) annual renewals. One year is defined as April 15 th to October 31 st. If the work is satisfactory at the end of each year, as determined by the County, the contract will be renewed for a successive 1-year term. Work To Be Performed 1. The services to be performed by the Contractor include mowing turf areas to a height of 3 and trimming along fences, walkways, structures, trash receptacles, curbs, stored boat trailers and drainageways at the Marine Park s launch and dock facilities and at the Rt. 18 site. Roadside mowing on the outside of the Park fence along Point Breeze Road shall be included. 2. Contractor shall make all reasonable efforts to complete mowing and trimming of all three sites in one (1) day, preferably Monday, to avoid conflict with regularly scheduled events and activities at the Park. In any event, all mowing and trimming must be completed in two (2) working days, from Monday to Friday, inclusive. Upon prior authorization by the County for each occurrence and under extenuating circumstances, mowing and trimming may be permitted on Saturdays and/or Sundays at the price of weekday service. 3. Frequency of mowing should be on an as-needed basis on advisement of the Contractor to the County. No mowing of the same area should occur more than once per week without prior authorization of the County. Mowing rounds should also be scheduled prior to any special events at the Park such as the Summer Concert Series (Tuesday evenings in July and August), a Cruise Nite (a Friday in July) or group gatherings at the pavilions. The County will notify the Contractor of Park events. 4. All mowing and trimming should be completed between the hours of 7:00 a.m. and ending of daylight hours. If the Contractor cannot perform its duties under the contract due to adverse weather, illness, vacation or other reasons, it is the Contractor s responsibility to notify the County immediately. 5. Partial mowing of the Park is allowed upon agreement with the County. Such mowings shall be at a price agreed upon with the County. 6. The Contractor shall collect twigs, branches, paper, cans, bottles and other discarded debris on the ground before mowings and deposit in the on-site dumpster. Cut grass is not to be placed in the on-site dumpster, trash receptacles or on any part of Park land. 7. Trimming of grass shall be performed at each mowing. Trimmings of grass shall be swept or blown off all hard-surfaced areas. All trimming should be completed with care so as to avoid excessive wear and damage to the bases of light fixtures, picnic tables, fence posts, and similar structures by string trimmer lines. 8. Contractor shall move picnic tables during mowing to ensure that grass at the original location of tables is cut at the same height as surrounding grass. In no case shall any picnic table be moved more than one table length away from its original placement. 9. The Contractor shall not direct mowed grass onto chain link fence around the Park s perimeter, concrete pavilion pads, walkways or paved parking areas, or playground surfaces. Accumulations of grass on the fence or other areas forenamed shall be removed after each mowing by sweeping or blowing. 10. Contractor personnel will adhere to the Orleans County Safety Rules. Damage to Vegetation and Property The Contractor shall be responsible for damage to county facilities, structures or property caused as a result of his/her operations. Mowing of ground saturated by precipitation that results in ruts or scalping of grass at it roots shall be the responsibility of the Contractor to repair. The Contractor shall immediately notify the County of any damages resulting from Contractor s operations on the day such damage is noticed. The County reserves the right to order cessation of work in progress if it deems the continuance of said work would result in excessive damage to the Park due to marginal conditions, such as wet grounds. The County may deduct the total cost of damages from any amount owed the Contractor. Terms of Payment The contractor shall specify on an invoice the specific date(s) the work was performed and the cost for each. Monthly installments will be made to the Contractor upon submittal of time and work reports setting forth the work performed and payments due under this agreement along with a county
voucher. The County shall cause such vouchers to be properly audited within two weeks after presentation for payment. The County shall have the right to withhold payment for any period of unsatisfactory performance, as determined solely by the County, under this agreement provided the Contractor is notified in writing of the County s dissatisfaction. Orleans County is a tax exempt municipality. Payroll Taxes The County will not withhold or pay any state or federal income tax or any other payroll tax on behalf of the Contractor or any employees of the Contractor. The Contractor will be responsible for payment of its own payroll taxes. Workers Compensation The County will not obtain or pay for workers compensation insurance for the Contractor or the Contractor's employees. The Contractor shall be responsible for procuring workers compensation insurance for the Contractor and the Contractor's employees. Insurance The Contractor shall comply with the insurance requirements described in Attachment A.
Attachment A COUNTY OF ORLEANS STANDARD INSURANCE REQUIREMENTS PROFESSIONAL SERVICES Contracts Involving Professional Services A. Professional Liability Malpractice -with a minimum combined single limit of liability for Bodily Injury and Property Damage of $1,000,000 per occurrence and annual aggregate. The coverage shall include: Personal Injury Liability (Coverages A, B and C) B. Optional Excess "Umbrella" Liability - If excess umbrella liability is provided with a minimum limit of $3,000,000 underlying coverages can be reduced to $500,000. C. Worker's Compensation and Employer s Liability - providing statutory coverage in compliance with the Worker s Compensation Law of the State of New York. D. Disability Benefits - providing statutory coverage in compliance with the New York State Disability Benefits Law. Professional Liability - Malpractice and "Umbrella" Liability shall name the County of Orleans and any Board, Bureau, Commission or Agency thereof as additional insureds.
