RFQ/PEDN/EGE/SUPL/18/011 The Private Education Development Network (PEDN) is a registered Ugandan non-profit organization with a vision of creating a Ugandan society that is enterprising and productive. The organization was founded in 2004 and empowers in and out of school youth between the ages of 10-35 across 28 districts of Uganda through innovative and demand led entrepreneurial interventions that enable them transform their livelihoods and communities. PEDN is currently implementing the Empowerment for Girls Education (EGE) project across 26 districts in 132 affordable private schools. The EGE project is funded by DFID/UKAid and implemented under a consortium including: Opportunity International the Lead Partner, The Private Education Development Network (PEDN), Opportunity Bank Uganda Ltd (OBUL), Teach a Man to Fish (TAM2F), Aflatoun International and Link Community Development (LCD) as Key Partner Organization s (KPOs).The EGE project envisions marginalized girls of Uganda being able to complete a full cycle of education, supported through economic empowerment initiatives, life-skills training and the efficient use of financial services. Terms and conditions of the supply include: All payments will be made within seven (7) working days from the date of delivery All payments will be made by cheque(s). Loss or damage of goods in transit shall be on the Supplier Damaged or sub-standard goods that do not correspond to specification shall be rejected by PEDN, at the Suppliers expense, Goods shall be received on GOODS RECEIVED NOTE. Termination for Default The Private Education Development Network, without prejudice to any other remedy for breach of Contract, by notice of default sent to the Provider, may terminate the Contract in whole or in part if: Page 2 of 6
(i) (ii) (iii) the Provider fails to deliver any or all of the Supplies within the period specified in the Contract, or within any extension thereof granted by PEDN the Provider fails to perform any other obligation under the Contract; or the Provider, in the judgment of the Procuring and Disposing Entity has engaged in corrupt or fraudulent practices, in competing for or in executing the Contract. Termination for Insolvency PEDN may at any time terminate the Contract by giving notice to the Provider if the Provider becomes bankrupt or otherwise insolvent. In such event, termination will be without compensation to the Provider, provided that such termination will not prejudice or affect any right of action or remedy that has accrued or will accrue thereafter to the Procuring and Disposing Entity. Termination for Convenience PEDN, by notice sent to the Provider, may terminate the Contract, in whole or in part, at any time for its convenience. The notice of termination shall specify that termination is for the Procuring and Disposing Entity s convenience, the extent to which performance of the Provider under the Contract is terminated, and the date upon which such termination becomes effective. EVALUATION METHODOLOGY PEDN shall use technical compliance selection method: 1. Preliminary; this is where all legal documents shall be examine and other information submitted by Bidders to verify the eligibility of Bidders and Supplies related. If after the examination of eligibility, PEDN determines that the Bidder, the Supplies and/or the related Services are not eligible, it shall reject the bid. PEDN shall confirm that the following documents and information have been provided in the bid. If any of these documents or information is missing, the offer shall be rejected. 2. Commercial and Technical; PEDN shall examine the bid to confirm that all terms and conditions specified have been accepted by the Bidder without any material deviation or reservation. If, after the examination of the terms and conditions, PEDN determines that the bid is not substantially responsive in accordance with ITB, it shall reject the bid. PEDN shall evaluate the technical aspects of the bid submitted in accordance with ITB, to confirm that all requirements specified in Section of Statement of Requirements of the Bidding Document have been met without any material deviation or reservation. If, after the technical evaluation, the Procuring and Disposing Entity determines that the bid is not substantially compliant in accordance with ITB, it shall reject the bid. 3. Financial comparison; PEDN shall financially evaluate each bid that has been determined, up to this stage of the evaluation, to be substantially compliant and responsive. To financially evaluate a bid, PEDN shall only use the criteria and methodologies defined in RFQ, Evaluation Methodology and Criteria. No other criteria or methodology shall be permitted. To financially compare bids, PEDN shall: (a) (b) Correct any arithmetic errors; apply any unconditional discounts offered if any; Determination of Best Evaluated Bid(s) PEDN shall compare all substantially compliant and responsive bids to determine the best evaluated bid or bids, in accordance with, Evaluation Methodology and Criteria. Post-qualification of the Bidder PEDN shall determine to its satisfaction whether the Bidder that is selected as having submitted the best evaluated bid is qualified to perform the Contract satisfactorily. An affirmative determination shall be a prerequisite for award of the Contract to the Bidder. A negative determination shall result in disqualification of the bid, in which event the Procuring and Disposing Entity shall proceed to the next best evaluated bid to make a similar determination of that Bidder s capabilities to perform satisfactorily.
