Page 4 of 5 17. This schedule has been prepared in accordance with Section 87 of the Pensions Act 1995. 18. The RIBA Pension allows two alternative definitions of pensionable pay: qualifying earnings and total earnings. From your staging date onwards, statutory minimum contribution rates will apply. These depend on the definition of pensionable pay that you choose, and are subject to phased increases as shown below. Tick one of the boxes to make your selection. Under both definitions, earnings should include, in addition to wages or salary, any overtime, bonuses or commission as well as sick pay, maternity pay etc. It is for the employer to satisfy itself that it has included all the necessary components of pay. The scheme will be set up on the basis of the applicable minimum contributions. Following this, both employer and employee contributions can be adjusted (for more detail on this, and for making contributions via salary exchange, see the Employer Guide). However, by signing the declaration in the next section you are committing to meet the statutory minimums from your staging date onwards. 19. The pension administrator must receive contribution payments within 5 days of the end of the calendar month to which the contributions relate. If payment is not made within 19 days, the trustee will inform The Pensions Regulator within 30 days of the due date. 20. We (the employer named at section 1 of this form) hereby: a) Apply to the trustee of the RIBA Pension for the creation of a sub section of the RIBA Pension (a brand name of the Salvus Master Trust) for each scheme employee, being those persons who become members of the RIBA Pension and whose names we notify to the pension administrator, which shall contain the RIBA Pension s current standard terms and incorporate any special terms or provisions appropriate to our investment, or any part of it, which may be applicable. b) Agree to enter into an agreement with the trustee of the RIBA Pension. c) Agree to comply with the terms of the contribution payment schedule. d) Understand and agree that: i. Contributions to the scheme will be allocated to investment funds in accordance with members instructions; ii. There is an investment fund allocation procedure and this procedure may be changed from time to time; iii. Whenever a contribution is given to the pension administrator, HS Administrative Services Ltd (HS Admin), to apply under the scheme, and HS Admin does not have clear and complete instructions as to which investment funds that contribution is to be applied, then HS Admin will apply the contribution to investment funds chosen in accordance with the said procedure. e) Declare that the information given in this application is true and complete. f) Confirm that we comply with the requirements of the Data Protection Act 1998. 21.
