GENERAL CONDITIONS WRIGHT CITY R-II SCHOOL DISTRICT REQUEST FOR PROPOSAL Wright City West Elementary School Teacher Desks and Chairs June 27, 2018 The Wright City R-II School District (hereafter District ) is seeking proposals for teacher desks and chairs for Wright City West Elementary School from qualified individuals, firms or organizations (hereafter Vendor ) as described in this Request for Proposal (RFP). If awarded bid: Vendor must provide a certificate of liability insurance for $1,000,000 naming Wright City naming Wright City R-II School District, 90 Bell Road, Wright City MO, as an additional insured. Vendor must carry statutory amounts for Worker s Compensation insurance. Vendor must participate in E-Verify. Employees must be verified within 30 days of the bid award and to continue using E-Verify throughout the life of the contract. New employees must be verified within 3 days. (See attached DL0018526, 2 pages). Per board policy, no registered sex offenders are allowed on District property. Per board policy, no firearms, alcohol, tobacco, imitation tobacco, electronic cigarettes or illegal substances are allowed on district property. Vendors must provide a minimum of three references with names, addresses and phone numbers for which Vendor has provided the products being proposed. References from other school districts would be preferred. All Proposals must be sealed and marked West Elementary Desks and Chairs. The District requires delivery on November 1-2, 2018. If assembly and placement is included in quote all must be completed by 3 p.m., November 2, 2018. Please specify if quotes are based on being accepted as the sole provider of teacher desks and chairs or if the District is allowed to purchase partial items from your proposal. Vendor agrees to indemnify and hold harmless the District and its Board of Education, officers, employees, agents, representatives and volunteers from all suits, actions, losses, damages, claims, or liability of character, type, description, including but not limited to, all expenses of litigation, court costs, penalties and attorney's fees whatsoever of any kind or nature, arising directly or indirectly from the negligence of the Vendor, its agents, servants, employees, person or entities engaged as independent contractors by the Vendor and suppliers, provided, however, that the Vendor shall not be required to indemnify for the following: (a) acts or conduct by third parties, other than the District and its Board of Education, officers, employees, agents, representatives and volunteers, not under the control of the Vendor, except for persons or entities engaged as independent contractors by the Vendor; (b) claims where the District has failed to give adequate, prompt written notice thereof to Vendor (c) claims settled without the prior written consent of the Vendor; or (d) acts of intentional misconduct or negligence by the party to be indemnified. Vendor will include specification sheets for all products. Vendor will include the warranty terms for all items described above. Delivery and setup - The District prefers for the Vendor to unload furniture, assemble, set-up in classrooms and haul away all trash. The Vendor will specify whether price includes delivery, unloading, assembly, placement in classrooms, and/or removal of all trash. All items are to be delivered to Wright City West Elementary School, 100 Wildcat Drive, Wright City, Missouri 63390. Delivery and setup is allowed Thursday, November 1 and Friday, November 2, 2018 between the hours of 7 a.m. and 3 p.m. Payment Terms - The District will issue a purchase order for items requested and approved by the Board of Education. The District can pay by check within 60 days of receipt of invoice if all items are received undamaged and the order is complete. Or the District can pay by credit card with no fee within 30 days of receipt of invoice if all items are received undamaged and the order is complete. 3

FEDERAL WORK AUTHORIZATION PROGRAM ( E-VERIFY ) ADDENDUM Pursuant to Missouri Revised Statute 285.530, all business entities awarded any contract in excess of five thousand dollars ($5,000) with a Missouri public school district must, as a condition to the award of any such contract, be enrolled and participate in a federal work authorization program with respect to the employees working in connection with the contracted services being provided, or to be provided, to the District (to the extent allowed by E-Verify).
