MINUTES HARBOR COMMUNITY REDEVELOPMENT AGENCY ADVISORY COMMITTEE MEETING NOVEMBER 9, 2016-5: 30 PM DESTIN CITY HALL BOARDROOM 1. CALL TO ORDER: Chairman Buckingham called the meeting to order at 5: 30 p.m. on Wednesday, November 9, 2016 in the Destin City Hall Board Room. 2. OLD BUSINESS: A. Discussion/ Workshop for Mobile Vendors The CRA/Development Manager Steve Schmidt presented the following suggested checklist for mobile food vendors for discussion; noting this is a list of recommendations presented to staff by the food vendors following this committee' s October 26"' special meeting/workshop when this item was discussed. Suggested Checklist for Mobile Food Vendors Food Trucks, Food Trailers and Food Kiosks) ALL mobile food vendors are required to adhere to the following: 1. Current City of Destin Business Tax Receipts as deemed appropriate for usage as follows: a. Mobile Long Term: In place longer than 48 hours( Unless under special events festival license) b. Short Term: In place less than 48 hours 1) Must provide proof of Commercial Auto Insurance( Trucks and Trailers) 2. Okaloosa County Tax Receipt 3. State of Florida Sales Tax Receipt 4. Vehicle( Truck or Trailer) shall be registered in the State of Florida and the operator shall have a valid driver' s license 5. Mobile Vending License by the appropriate state regulatory agency a. Department of Agriculture( EX: Kona Ice) b. Department of Business Professional Regulations( EX: Big Red Truck, Fishheads, Wine Not?) 6. Proof of General Liability Insurance 7. Parking Requirements: No additional parking requirements due to Internal Capture for Employees and Customers( Discussion: Everything falls under one umbrella vs sorted out by district = fairplaying field)
8. If selling and/ or serving Alcohol: Proof of valid license from the Division of Alcohol Firearms& Tobacco 9. In preservation of the family environment, mobile vendors shall not sell or distribute vape or drug paraphernalia or any other items that the possession or use of which is deemed illegal under any federal, state or local law. 10. Placement of tables, stools, chairs or other fixtures is up to the discretion of the property owner. 11. All mobile food vendors shall provide a trash receptacle and keep their area free of trash and debris. 12. All mobile food vendors shall be in compliance with disposal of all waste( black water, gray water, grease, roughage and oil) (Discussion: Maximum penalties as allowable by the city should apply) 13. All mobile food vendors are responsible for any spillage of waste and the damage it causes to someone else' property. 14. No mobile vendor shall operate any horn, sound amplification system, or other soundproducing device or music system outside the code limits of the existing City of Destin ordinances. 15. No mobile food vendor shall utilize the utilities of others without written consent. 16. Any mobile vendor found to be in violation of any of the above; After 10 day calendars, shall be issued applicable fines as deemed appropriate by the local governing agencies Discussion: We know there are caps and/or stipulations, but are uncertain as to what they entail) 17. Host representatives from Dept of Ag, DEP, DBPR at upcoming workshop so we can learn who' s regulations start where and end where Committee member Green asked for clarification regarding item# 1 of the above checklist. Committee member Jones explained they are trying to distinguish between long term and short term usage; and that" 48 hours" is just an arbitrary time frame they used. He added it could be shorter or longer as deemed appropriate. Committee member Green requests further explanations for item# 4 of the checklist. According to Committee member Jones, this item was intended to be part of a checklist if City staff was to create a checklist. Referring to item # 7 of the checklist, Committee member Green opined that there should be required parking spaces for long term mobile food vendors as they do with other vendors on the harbor. Committee member Jones stated that they hope to use some internal capture for employees and customers with regards to the parking requirements. There was a brief discussion relating to short term Business Tax Receipts ( BTR). Mr. Schmidt noted there is no provision in place for a short term BTR. Committee member Green wants to know if item # 9 of the checklist (" mobile vendors shall not sell or distribute vape or drug paraphernalia...") is just precautionary or an existing problem down on the harbor. According to Committee member Jones, it is for precautionary measure. Referring to item # 10 of the checklist, Committee member Trammell suggests they include a language to not allow tables, stools, chairs or other fixtures to be placed on designated parking spaces 2
required for the property. Committee member Raim stated that out of state mobile food vendors should be held to similar standards as the local vendors. Referring to item # 7 of the checklist, Committee member Best stated that they should have parking requirement for long term mobile vendor employees. She also recommends requiring long term mobile vendors to sign a lease agreement with the property owner and be registered with the City to help prevent saturation of parking spaces especially down at the west end of the harbor. Committee member Trammell asked if they have special events permit for out of state vendors that come in for special events such as the Destin Seafood Festival. Mr. Schmidt replied affirmatively; adding they are taking a hard look at their special event They want to hold special event vendors to the same standard as the local food permitting process. vendors. Committee member Trammell suggests they review the current special event requirements and recommend appropriate amendments as a group. In reference to item# 11 of the checklist, Committee member Trammell wants to see the plans for disposal of trash and debris. She stated that as a business owner that has several dumpsters, she finds a lot of things in her dumpsters that do not belong to her tenants. Committee member Trammell suggests they add to the title of the checklist " within the harbor district" unless their recommendations cover other parts of the City. Mr. Schmidt explained there are different situations for food trucks; and that they probably would not allow long term mobile food trailers in most zoning districts within the City outside of the Festive Market Place. Committee member Trammell moved that all recommendations made by the committee tonight be incorporated into the document; and that a revised document be brought back at their December meeting for review; seconded by Committee member Raim. Motion passed 6-0. Committee member Casey abstained from voting. Chairman Buckingham announced he will now allow public comments regarding this issue. Ms. Jamie Jones, a Destin resident and business owner explained that the nature behind this effort was to give the City a starting point for identifying requirements for mobile food vendors to legally operate in the City; and that people that operate the kiosks and the rental and charter services would need She also recommends having allotted parking instead of designated parking; to be looked at separately. and that some type of sticker or decal be used to designate legitimate/ valid mobile food vendors. Having no further comments from the public, the Chairman turned the matter over to the committee members for further discussion. Considerable discussion followed regarding parking requirements for short term versus long term mobile food vendors. Chairman Buckingham stated that a property owner should have enough parking spaces available before allowing a short term mobile vendor ( in place less than 48 hours) to come to the property, or arrange a place for it to park. 3
According to Committee member Best, any commercial property owner should be allowed to decide to have mobile vendors park on their property on a short term basis if they feel they have enough parking. Committee member Green stated that commercial property owners should provide additional parking spaces for both long and short term vendors. Committee member Trammell wants to make sure they include a language stating mobile food vendors are only allowed to park on commercial properties. Committee member Best stated it should be incumbent upon the prope y owner to police their own property and not be micro-managed. Committee member Trammell noted they currently do not have a rule placing the responsibility on the property owner and no requirements for vendors to follow. Chairman Buckingham stated that vendors in place for 48 hours or less on commercial property should be considered short term and no additional parking spaces are required. The commercial property owner should provide additional parking for vendors that are to be in place for over 48 hours; adding it should be a minimum of one depending on the type of operation. Committee member Trammell recommends at least two additional parking spaces for trucks. She also suggests making the parking requirements consistent with the new parking formula for the south side of US Hwy 98. There was some discussion on providing some guidance on what food trucks or trailers should look like in the City of Destin. Committee Green noted that a food trailer is one thing, but a food kiosk would have to conform to the guidelines they set. Mr. Schmidt pointed out that kiosks down in the flood plain area had to be grandfathered prior to the FEMA requirement for flood elevation; adding they are not movable. He continued they have current standards for portable buildings. He added that for" box- type" food trailers with wheels and windows on the sides and want to serve food, standards need to be set in terms of look, duration of stay, and whether or not they should be permitted as trailer at all. Committee member Trammell stated that in terms of aesthetic look, if they want the area to look like a harbor and they already have set standards for kiosks and portable buildings, then they should require food trailers to follow the same standards. Chairman Buckingham noted there are phenomenal food trailers in downtown Pensacola and Seaside; and that both areas have come up with aesthetic requirements and other rules and regulations. He suggests staff contacts both places, gather some ideas and bring it back. Ms. Melissa Aikens, a Destin resident and business owner, came forward and stated that from the aesthetic standpoint, food truck businesses are very unique with each having different " personality"; adding they are, in most cases, professionally done. She suggests coming up with basic standards such as 4
requiring they be painted, no rust, and clean; but, allowing them to keep their individuality. that as long as they meet the basic requirements, they should be allowed to operate and prosper. She added Ms. Jamie Jones noted the problem with food trailers is not just aesthetics, but the parking enforcement; adding that some property owners are allowing tenants on their property without proper parking. Committee member Best stated she would like some suggestions from staff on what to put in place and how to enforce it to make property owners do the right thing. Committee member Trammell moved to invite the Community Development Director to come to the meeting and address the issue of food trailers and the aesthetics of development within the harbor district; seconded by Committee member Best. Motion passed 6-0. 4. NEW BUSINESS: B. Review of Proposed Annual Report and Work Plans Mr. Schmidt presented to the committee proposed fiscal year 2016 annual report and fiscal year 2017 work plans for their review and approval for presentation to the CRA Board and City Council. Chairman Buckingham asked that the Committee be allowed to review the work plans and bring them back at the next meeting. Committee member Trammell noted that the issue they are currently discussing is not listed as part of their work plan; adding it should be added to their work plan for Council to approve before they could go forward with it. Committee member Raim moved to approve the fiscal year 2016 annual report; seconded by Committee member Green. Motion passed 5-1, with Committee member Trammell dissenting. 5.
