Our annual Fall Festival includes live music, car show, children s activities, merchandise vendors, and lots of great food. Vendor spaces are limited and are granted on a first come first served basis, so register quickly! Terms and Conditions 1. Vendor must provide all supplies and materials, including but not limited to: tables, chairs, fans, canopies, lighting, cooking devices. By agreeing to the terms herein, Vendor understands that the City of Warrenton ( City ) reserves the right to approve or disapprove supplies or materials used by Vendor. 2. Vendor shall comply with all applicable City ordinances and other laws and regulations, Federal, State, and any political subdivision thereof, including but not limited to, unemployment and workers compensation, occupational safety, collection and payment of Missouri Sales Tax, equal employment and affirmative action and wage and price laws insofar as applicable. 3. Vendors providing food shall comply with the 2013 Missouri Food Code Guidelines for Temporary Food Events and all other applicable Missouri Health Department requirements detailed in 19 CSR 20-1.025 Sanitation of Food Establishments. 4. Although the City will make all efforts to accommodate booth location requests, the City reserves the exclusive right to determine placement of vendors and vendor booths. By agreeing to the terms herein, Vendor also understands and agrees that the City can relocate or move a vendor or booth at any time prior or during the event. 5. Vendors hereby agree that all Vendor property shall be located within their City allocated 15 x 15 booth space. If, in the discretion of the City, a Vendor has not contained his/her property safely within the City allocated booth space, the City reserves the right to cancel Vendor s use of said space. 6. All booths must be safely set up and maintained by Vendor during: transportation to the site, setup of booth, the event, break down of booth and transportation off site. 7. The City reserves the exclusive right to approve any signage or marker used by Vendor. Failure of Vendor to follow requests of the City can result in immediate revocation of Vendor s license. 8. Vendor agrees to have booth setup at least one hour prior to event for inspection by the City. 9. Vendor agrees to remove all property from the site within one hour after event has ended. Vendor will have sole responsibility for removal and cleanup of site. 10. Vendor shall conduct himself at all times in a safe, professional and courteous manner before, during and after the event. 11. No spikes, stakes, poles or other like items may be used by Vendor 12. Unless special written permission is received by Vendor prior to event, no animals may be brought onsite by Vendor. Vendors requiring the use of a service animal under the Americans with Disabilities Act must notify City prior to event. 13. No animals shall be sold at the event. 14. Materials used for transportation, storage, delivering or packing of Vendor s property shall be stored in a safe manner and shall not be visible from public view. 15. Vehicles and/or Motorized devices are restricted to designated Vendor parking areas. Anyone who requires special assistance under the Americans with Disabilities Act must make arrangements at least twenty four (24) hours in advance of event. 16. By signing this agreement, Vendor acknowledges that the City can hold Vendor personally liable for any damage to City property, whether by intentional act, negligence or recklessness or part of Vendor. 17. If the City decides that there exists a potential risk to the health or safety of the attendees of the event, the City reserves the right to suspend, postpone or reschedule the event. If an event is rescheduled, the booth rental fee will be credited towards a future event.

18. No refunds will be given for Vendor cancellations. 19. The sale or consumption of alcoholic beverages is strictly prohibited, unless otherwise provided. 20. Subleasing of booth space is not allowed. 21. Vendors parking a large vehicle on the premises, such as a motor home, travel trailer cargo trailer or other like vehicles are strictly prohibited unless special arrangements are made with the City in advance. 22. To the fullest extent permitted by law, the Vendor agrees to indemnify and hold harmless the City, its officers, engineers, representatives, agents and employees from and against any and all liabilities, damages, losses, claims or suits, including costs and attorneys' fees, for or on account of any kind of injury to person, bodily or otherwise, or death, or damage to or destruction of property, or any other circumstances, sustained by the City or others, arising from Vendor s participation in the event. Vendor also agrees that on behalf Vendor s heirs, assigns, personal representatives and next of kin, hereby release the City of Warrenton, other participants, sponsoring agencies, advertisers, and if applicable, owners of the premises used to conduct the event, with respect to any and all injury, disability, death, or loss or damage to person or property incident to my involvement or participation in these programs, whether arising from the negligence of the City of Warrenton or otherwise, to the fullest extent permitted by law. I, and on behalf of my/our heirs, assigns, personal representatives and next of kin, hereby indemnify and hold harmless all the above releases from any and all liabilities incident to my involvement or participation in the event, even if arising from negligence, to the fullest extent permitted by law. 23. I give my permission to The City of Warrenton to take my photo or photo of my booth, while participating in the Fall Festival, and to post the images that include myself, my booth, and/or merchandise on the City of Warrenton website, facebook page, or printing materials for the purpose of viewing, advertising, or generating printable materials. 24. I, the undersigned, in consideration of the ability to participate in the event, understand and agree to the information on both sides of this form. I understand and agree that the additional requirements listed in the event specific guidelines are a part of this agreement.
