The bidder who satisfies EMD conditions, Letter of under taking for confirming all the tender conditions in the prescribed format, alone will be considered as responsive bidders and their Part II covers will be opened. 3.0 Tender documents are uploaded in NLC India Limited website www.nlcindia.com. Approved firms for LTE of this work can download the documents from the NLC India Ltd website www.nlcindia.com under the head Limited Tenders. Documents can also be obtained by the approved firms from the O/O The General Manager/CSR/NLC India Ltd, Neyveli, free of cost.
2 4.0 Bids submitted by the approved firms only will be considered for evaluation. Other bids received will be treated as unsolicited bids and will not be considered for evaluation. 5.0 The bid shall be kept valid for acceptance for 06 (Six) months from the date of opening of the bid.(part I). 6.0 Amendments / Errata / corrigendum / clarifications, if any issued for the tender shall form part and parcel of the tender document. Amendments / Errata / corrigendum / clarifications will be posted in NLCIL s website.www.nlcindia.com. Bidders are requested to visit NLCIL s website and note the amendments before submission of offer. Any ignorance on the part of the firms in not seeing the website will not be an excuse. NLC India Ltd shall not be responsible if any Bidder omits to notice any amendments / Errata / corrigendum / clarification. Amendments / Errata / corrigendum / clarification will be numbered serially. The bidders are requested to sign all the Amendments / Errata / Corrigendum / Clarifications issued for the tender and enclose along with the bid as these form part and parcel of tender document. 7.0 QUALIFYING REQUIREMENTS. 7.1. The bidder should have independent Provident Fund code number allotted in favour of his establishment under EPF & Misc. Provisions Act 1952.The PF code Number so allotted shall be furnished with documentary proof along with tender documents. 7.2 The personnel/workmen engaged by the bidder for execution of works in NLC shall be in the rolls of the bidder agency and shall have to be given appointment letter/employment card under CL (R&A) Act 1970 issued by the bidder to that effect.the bidder has to furnish a certificate of undertaking to that effect, along with the tender documents. 7.3 The bidder shall also possess a valid certificate of registration under GST Act/ Rules and furnish a copy of the same in the bid if in any financial year the value of service rendered by them/ the value of a contract exceeds Rs.20 Lakhs (the present threshold limit for levy of GST); he should have discharged his liability, under the GST Act/ Rules to the effect of which a Certificate of under taking (format enclosed with Part-II) is to be furnished along with the Bid & produce GST Registration Number. In case the above value does not exceed Rs.20 Lakhs, a self declaration to this effect shall be furnished. 7.4 The bidder should have obtained Permanent Account Number (PAN) under the Income Tax Act and he is not a defaulter in payment of Income Tax as evidenced by Income Tax Assessment Records for four consecutive years prior to bidding. 7.5 Documentary evidence/certificate of Undertaking for the above qualification requirement shall be enclosed in Cover II (Part II)
3 8.0 PAYMENT OF EMD 8.1. The cost of EMD may also be remitted through RTGS/NEFT and the designated bank account for TA is STATE BANK OF INDIA, NEYVELI (MAIN) BLOCK-2, BRANCH CODE: 00958, IFSC CODE: SBIN0000958, ACCOUNT NUMBER: 10895129124.The bank commission charges will be to the account of the bidder. The remittance details viz., UTR number shall be clearly indicated by the bidder in their offer and the qualification of the bidder is subject to receipt of cost of tender documents stipulated in the tender. No other mode of payment will be accepted. The bids without Tender document cost will be summarily rejected. 8.2. The tenderer who are downloading the tender documents from NLC India Limited web site/ obtained the documents directly are advised to visit the NLC India Limited s website regularly for any amendments/ clarifications /corrigendum issued on the tender and shall submit a signed copy of the amendments/clarifications/corrigendum issued in acceptance of the same. Any failure on this part shall be attributable only to the tenderer and NLC India Limited is not responsible in this regard. Issuance of tender documents need not be construed to mean that such tenderer would be automatically considered. 8.3. The quotation must be submitted in the prescribed schedule only and must accompany with necessary Earnest Money in any of the following forms: Demand draft/guarantee Bond/Banker s cheque/pay Order/RTGS/NEFT drawn in favour of Director Finance, NLC INDIA Ltd, on any nationalized/scheduled Bank recognized by RBI payable at par at Neyveli. Guarantee bonds from the Bank should be executed on a Non-Judicial Stamp paper for Rs.80/-.The tender without full EMD as stipulated are liable for summary rejection. 8.4. In the case of EMD is furnished in the form of bank guarantee, the bank guarantee shall be as per the format enclosed in tender document, otherwise the bid shall be summarily rejected. 8.5. The bid submitted without the Earnest Money Deposit / Bid Guarantee in the aforesaid manner or in any other manner or short in amount or any adjustment with any pending payment, shall be summarily rejected. Earnest Money Deposit / Bid Guarantee will be returned to the unsuccessful tenderer only after finalization of the tender. 8.6. No interest will be allowed on Earnest Money Deposit / Bid Guarantee or any money due to the bidder from NLC India Ltd. 8.7. The firms registered with NSIC/MSME are exempted from furnishing Bid Guarantee (EMD), provided that such small scale units are registered under single point registration scheme of NSIC/MSME and are valid on the scheduled date of tender opening and the product range mentioned in the certificate is the same or similar to our requirements. NSIC copies duly attested by any Notary Public (or) Gazetted Officers (or) Practicing Charted Accountant with seal and date shall only be accepted.
4 8.8. Submission of Bid Guarantee is exempted if the following agencies compete in tender: i. MSIC/MSME ii. iii. Central Government Departments, Government funded Education/ Research Institutions. 8.9. If the quarters address under NLC India Limited control is indicated as communication Address in the NSIC certificate furnished by the bidder, then the NSIC certificate will be accepted. But if it (Quarters Address under NLCIL control) is mentioned as Factory Address the NSIC certificate will be rejected. 9.0 SUBMISSION OF TENDER AND OPENING: 9.1 The bids signed in all pages with date shall be submitted in two separate covers as specified in tender document ( as described below) as Part I & Part II and shall be put in another cover duly sealed with inscription on the top of each of these three covers with Tender No., Opening Date & Opening time and addressed to The General Manager/CSR, CTO Building, NLC India Ltd, (Formerly Neyveli Lignite corporation Ltd), Block-1, Neyveli 607801 9.2 The address of the Tenderer shall be indicated on the Left hand bottom of the sealed envelope clearly and dropped in the Tender Box kept in the office before the time fixed. 9.3 The Part I and Part II cover should be clearly marked / indicated before putting Part I & Part II covers into common cover. 9.4 Name of work & Tender No shall also be written on the top of Part-I, Part-II and outer covers. 9.5 The tender shall be kept valid for 90 days from the date set for tender opening. However if any extension of validity is called for the bidder shall extend the same. 9.6 The bids so submitted will be opened in the presence of the Tenderers and or his authorized representatives, not exceeding one person from each tenderer. 9.7 NLC India Ltd shall not be responsible for any delay/loss in receipt of the bid which is sent through post/courier. 10.0 SEALED DETAILS OF THE BID 10.1 Part I Cover: It should contain a) EMD and b) Duly filled up and signed letter of undertaking accepting all techno-commercial conditions of the tender in the prescribed format given in the tender documents.
5 10.2 Offers without enclosing EMD and letter of undertaking in Part-I Cover will be summarily rejected. On the scheduled date and time of tender opening, Part-I cover will be opened first. Bid guarantee/emd will be examined and compliance of Letter of Undertaking will be scrutinized. The bids confirming all the above shall be treated as Responsive Bids and Part- II covers of the responsive bidders only will be opened. 10.3 Part II Cover: 11.0 GENERAL It should contain (a) Technical & Commercial aspects as detailed in Instructions to Bidder and (b) Price Schedule with quoted offer. 11.1 General Manager/CSR reserve the right to reject any quotation without assigning any reason thereof. 11.2 Notwithstanding anything stated above the owner (NLC India Ltd.) reserves the right to assess the capacity and capability of the tenderer to perform the contract should the circumstances warrant such an assessment in over all interest of the owner/purchaser. 11.3 NLC India Ltd reserves the right to check the authenticity of the certificate furnished. 11.4 The bids submitted late shall not be accepted and shall be rejected. 11.5 If the date of submission of Tender is later declared as a holiday, Tender can be submitted on the next working day and the Tender Box shall be opened on the next working day 11.6 Tender submitted by telex / telefax, E-mail and tender received after the expiry of the time specified for receiving the tender shall be rejected 11.7 No deviations from the draft contract, general commercial conditions and technical conditions/specifications are allowed.
