14 KEY JUDGEMENTS ON CAPITAL GAINS v BUSINESS INCOME Circular No 4 / 2007 dated The Income Tax Act, 1961 makes a distinction between a capital asset and a trading asset - Authorized by Memorandum of Association - Substantial Nature of Transaction, quantum of purchase & sale and ratio between purchase & sale - Motive for earning profits View: -The assessee can maintain portfolios as investments & as stock-in-trade. -This circular to act as a guide to the AO to decide whether the transaction is business income or capital gains. 14
