As mentioned, I wanted to reiterate our position ahead of your appearance in the House of Lords Select Committee on Monday. We currently offer two compensation schemes that you can consider for whether they are suitable for your parents circumstances, given that the entirety of their property is outside of safeguarding limits and does not need to be purchased by the Secretary of State for construction or operation of HS2. Firstly, your parents are entitled to make an application under the Need to Sell Scheme. Provided they were successful in demonstrating a compelling need to sell the property and have been unable to do as a direct result of the announcement of the HS2 route and meet other eligibility requirements, the Secretary of State would offer to buy the property at its unblighted open market value. The assessment of his unblighted value would be the midpoint of two valuations carried out by a valuer chosen by HS2 Ltd from its framework panel and a suitably qualified valuer of your choosing. This value would take account of the house, the accommodation that is currently used for the day nursery, and the extent of the grounds which may have hope value for further development. I understand that you have had discussions with the local authority about this additional potential. Alternatively, the value of the entire site for wholesale redevelopment may also be assessed. I would emphasise that the Need to Sell Scheme only allows for payment of the open market value of the property. There is no scope for paying any alleged business losses, relocation of residential or business uses, compensation for winding-up of the business, or similar heads of claim. The second potential scheme is consideration of any special circumstances that might apply or where the property is atypical. This might be an option if your parents felt that they were ineligible for the Need to Sell Scheme or had some other situation that the Secretary of State should consider as part of a decision about whether to buy the property and on what terms. Any formal application under this scheme would be considered by governance boards within HS2 Ltd and the Department for Transport on behalf of the Secretary of State. The view expressed by Oliver Bayne, Director of Land & Property, in his of 18 February 2016 in response to your request for advice is that any such application is unlikely to give rise to an offer any more favourable than a successful Need to Sell application namely, an offer to buy the property at its unblighted open market value but with no allowance for business relocation, etc. Anything else would, in our view, be unfair to other Need to Sell applicants and inconsistent with the range of compensation schemes offered by the Secretary of State.
