1 MINUTES OF THE MEETING BETWEEN MANAGING DIRECTOR, AWHO & PRESIDENT MANANGEMENT COMMITTEE, SANDEEP VIHAR, WHITEFIELD 1. A meeting between the Maj Gen Gurdip Singh, SM, VSM, Managing Director AWHO and Brig C Sandeep Kumar,VSM (Retd) President MC Sandeep Vihar Whitefield, was held at Bangalore on 26 Mar 2017 to discuss important issues of taking over of assets / common areas by the Managing Committee of Sandeep Vihar.The following officers attended the meeting :- (a) Maj Gen Gurdip Singh, SM, VSM - Managing Director AWHO. (b) Brig C Sandeep Kumar, VSM (Retd) - President, Managing Committee, Sandeep Vihar. (c) Col Arun Y Haltore - Project Director, AWHO Bangalore. (d) Lt Col Prem Singh (Retd) - Dy Project Director, AWHO Whitefield. 2. Minutes of the meeting are given in succeeding paragraphs :- Ser Issues Discussed Decision / Direction Action Info (a) President MC brought out that a lot of correspondence regarding the formation and registration of the owners association has happened. He said now that a Owners Association has been registered under Societies Act 1960, correspondence on this issue should be frozen from HQ AWHO. PD brought out that the legal mandate on the part of AWHO is to complete all actions as given in the Karnataka Apartment Ownership Act 1972, for which the owners have to submit the Form Bs. Moreover, the KAOA 1972 would be the pertinent act to administer the Managing Committee of Sandeep Vihar. President MC said that the KAOA 1972 does not envisage any registration of the society and therefore the regn of society was carried out under Societies Act After the receipt of the Form Bs and completion of all formalities of KAOA 1972, migration to the same shall be carried out. Therefore, he requested the MD that the correspondence on the same be frozen. He also requested that the maintenance account be handed over to the MC. AWHO HQ Secy Sec PD & MC MD AWHO directed that maintenance account shall be audited
2 -2- and handed over to the MC and further correspondence on this issue shall not be carried out from AWHO HQ with imdt effect. He also said that the actions under KAOA 1972 shall also be expedited and requested the President to urge the allottees to send the pending Form Bs imdtly. (b) The President MC conveyed that Sandeep Vihar has won the best residential complex prize under the category of large apartment complex. Sandeep Vihar was adjudged as the best in Overall Category, Best in Waste Management and best in Water Management in the recently concluded My Place of Pride Competition conducted by BPAC and Rotary Club of Bangalore. MD complimented the MC and the volunteers for their effort and said that AWHO shall always endeavour to achieve allottees satisfaction. - (c) President said that fixing of Concertina coil in existing fencing of H Block is yet to be completed. PD said that the fencing of the compound wall of H Block has already been completed and only the concertina coil on top is left which will be carried out with the fencing of rest of the complex. MD AWHO directed that concertina coil to be put immediately in H block to complete the fencing. PD Plg Sec AWHO HQ (d) Taking over of assets by MC as per original scope of work within DLP of the main contracts. MD AWHO said that MC should take over the assets and common areas, as per original scope of work and prepare a final defects list. New requirements should not be linked to taking over of assets. new works beyond the original scope shall be considered case to case basis and since the defects are required to be communicated to the contractors within DLP, this should be done on priority, failing which the contractors shall not be legally bound to rectify the same, after expiry of DLP, which will go against the interest of the allottees. MC & PD
3 -3- (e) The President opined that there are still issues regarding land which need to be sorted out. He mentioned that the issue of Land behind the project which was also initially included in the land purchased by AWHO is not clear. He also said that the land relinquished to BDA should be taken back for which case should be taken up. He also requested that the land be again surveyed by Revenue Dept to confirm the boundary. PD clarified that the land of AWHO has been fully demarcated already with a boundary wall. The compound erected in front of the road between H Block and rest of the project is in private land as already explained in writing earlier. He also said that all the land documents have been handed over to the President including the relinquishment deed. PD also clarified that initially the AWHO had purchased the 8 Acres of land behind also. However, since Govt of Karnataka had included a Ring Road in this land in their Master Plan and also had promulgated this in the Newspapers, AWHO persuaded the seller to take back this land and return the relevant amount back to AWHO. He said that this fact also has been clarified earlier by AWHO HQ in writing. Land Sec, PD & MC PD said that as per the existing law of the land and BDA Rules and their approvals, some of the open areas have to be relinquished to them. This also includes the Common Amenities Area (CA Site). As a policy the BDA gives the relinquished areas of CA back to Society only on their application on lease on payment after a duration of approx five year. He said AWHO had managed to convince the BDA to give the CA site on lease back to AWHO as a special case, which had facilitated the constr of the Club House so early. Without this, the club house constr would have been delayed or else the area from the existing land other than the CA site would have had to be used for the club house. PD said that survey by Revenue Auth again shall be only possible on application by the MC and this would be charged by them. MD AWHO directed to write a letter to Asst Commissioner of Land for demarcation of boundaries of Schedule A and Schedule B property jointly with MC if it is still required to be done and payment would have to be made from the project funds for the same.
