2 DEATH TO THE PENALTY 2 Introduction Money is the one resource that is considered greedy to have huge amounts of, but yet everyone wants more of it in today s society. People are always finding new ways to cut down on spending and look for ways to keep the income they work for. With the United States being trillions of dollars in debt to numerous countries, most notably to China, it is not surprising to see that candidates in the 2016 election are promoting their various plans to save money. Many have failed to jump on board with a potential solution to save money in this indebted nation. Getting rid of the death penalty has been a controversial topic, because it deals with the lives and deaths of people guilty or potentially innocent. About 61% of the American population agree with the death penalty because they feel that it serves justice for the crime committed by the criminal(edwards-levy,2015). By looking at an economic standpoint, getting rid of the use of capital punishment is a smarter choice. The facts that support this are the number of executions, the upkeep of life without parole (LWOP) verses one with the penalty, the cost differences for trials, and the amount of money taxpayers could save. Upkeep of Life When comparing inmates that have Life Without Parole and other criminals sentenced to the death penalty, it is obvious that once they are in the prisons they are treated differently. Those sentenced to be executed have greater restrictions than those who have LWOP. Criminals charged with capital punishment each are put in solitary confinement, each in their individual rooms. This compares to the other criminals who have two people per cell. The extra space and electricity used from the people on death row costs money and by abolishing the penalty the prisons would be able to utilize their space more efficiently(reinhart,2011). Additionally, the amount of staff need to take care of the prisoners on death row are greater than those with
3 DEATH TO THE PENALTY 3 LWOP. Those with the sentence have a member of staff come around every 15 minutes to check on them. Many of the criminals on death row have mental illnesses and also have the help of therapists and psychiatrists. If there were no extra restrictions, the staff would decrease in size, thus making it cheaper for having life without parole (Forest Time,2016). Pretrial and Trials Whenever a situation deals with life and death, how it is handled is taken very seriously. The trials and pretrial are heightened due to the severity of the consequences. It is crucial that the person being prosecuted is indeed guilty of the crime and is not falsely sentenced to death. Each case that has the potential of the criminal being sentenced to capital punishment has to go through two trials. The first trial determines whether the person is innocent or guilty of the crime. Once the person is found guilty there is a second trial which finds if the person should be charged with LWOP or sent to death row (Minsker, 2008). The accused gets escorted to the trials with multiple enforcement staff because they are considered dangerous. In the case there are also experienced attorneys, the judge, and the jury. Having all of these people at the trial costs thousands of dollars. To add more money to the cost, all trials that involve the death penalty last about 3.5 times longer than a trial that ends in life without parole (Kasten,1996). Kasten (1996) writes: The average difference between a capital and a non-capital trial has been estimated to be thirty days. Assuming the courtroom costs to be $3011 per day, the additional cost of operating just the courtroom for capital cases is $90,325. To the extent that this general relationship holds nationwide, the time and resources spent on capital trials significantly exceeds any costs incurred for non-capital trials.
4 DEATH TO THE PENALTY 4 He later goes on to mention that this doesn t cover the 10,000 dollars at least that goes into the case investigations and that we have to put into consideration that this cost analysis has to be doubled because there are two trials (Kasten,1996). Costs where prosecutors seek the death penalty is at least 1 million dollars more than those who seek life without parole. Depending on the area studied, there are different amounts of savings can be acquired from abolishing the death penalty. In an article done by Fox News showed that Kansas could save up to 70% on their total costs of sentences by switching to doing solely LWOP while Tennessee would be projected to save 48%. Some of the bigger states such as Florida and California have more drastic changes. Florida would be able to cut 51 million in their total spending that would go otherwise towards paying for the accused to be sentenced to capital punishment. California, the state with over 700 on their death row, has spent over 4 billion on towards executions since it was reinstated there in 1978, by getting rid of the death penalty they would instantly save over 184 million instantly (N,2016). All of the millions that could potentially be saved would be able to go towards more beneficial things, such as the states spending and/or their economy. Taxpayers From the supporting reasons before it is not complicated to see that going through the criminal justice system is very expensive, but where does all this money come from? Many of the people who get prosecuted do not have enough money to cover all of their costs for going through with the trial. The burden of the expenses gets taken from taxpayers from that state. A Law Director from Anderson County in Tennessee did a study and found out that the residents living there were spending around 62 dollars each a day in order to pay for the inmates that had been sentenced and put on death row. Another statistic shows that California s residents pay 117
5 DEATH TO THE PENALTY 5 million in post-convictions or 175,000 per inmate yearly (Rawlings,2013). By making it so the only option for serious crime is LWOP, it will save many citizens money and help our economy grow stronger. Executions Out of the all of the states in The United States of America only 32 of them still use capital punishment as a penalty for breaking the laws and the other 18 have abolished it. This may seem like a lot of states that are pro death penalty, but even though they have it, many do a poor job of utilizing it. About 1% of convicts sentenced to the death penalty have been executed in the last 30 years. Many of the cases that have resulted in capital punishment get overturned as time goes on. The once feared death penalty has almost become a joke. It is more symbolic because most people don t get executed from it once they are sentenced. Natasha Minsker (2008), author of a new report of the Northern California chapter of the American Civil Liberties Union, stated that few will actually be put to death. In fact, the odds against being executed are so great, suspects seek the penalty because it s the only way to get a single room in the state s prison system. An example of this is shown in a southern California case where Steven Kraft was given the death penalty: Even when compared to other serial killers, Kraft s crimes were appalling. He often picked up his victims while they were hitch hiking near the military bases during the 1970 s and 80 s. There was no real question about his guilt. Kraft was ultimately convicted of 16 murders, and there is an excellent chance he committed dozens more. Today is the 25 th anniversary of Kraft s death sentence and Kraft is still alive (Beiser,2014).
6 DEATH TO THE PENALTY 6 What is the reason for allowing the death penalty when it is more likely for these criminals at the ages of now 70, to die from natural causes? A statistics of capital cases taken from New Jersey showed that out of the 197 cases tried, only 60 have been sentences; 50 of them were over turned. Only 10 of them made it to death row (Barnes,2010). It is not worth all of the time and effort spent on executing criminals when only 1 out of 20 people will actually make it to death row. Most of those convicted will die before their execution date. The amount of money that could be saved from the trial system and rooming/guards as discussed previously. The 253 million extra spent on these criminals in each state, could go towards more useful areas in the economy (Barnes,2010). Controversy The death penalty has been around since some of the earliest structured civilizations and government. Reggio (2014) stated, As far back as the ancient laws of China, the death penalty had been established as a form of punishment for being disobedient the laws present (2014). It has also been a very controversial topic about whether it should be justified to kill another human being for their crimes. Emotions run high from the sense of justice and morality involved. Some may claim that the sense of justice outweighs the cost of it. Professor Paul Cassell, the Ronald N. Boyce Presidential Professor of Criminal Law at the U of U and death penalty expert says: major changes are not likely to occur soon. You can make the argument that it is cheaper to have the death penalty, but that is not what the death penalty is about. The death penalty provides a sense of justice to the system, is a just punishment for murder and has a deterrent effect on crime (Barnes, 2010).
7 DEATH TO THE PENALTY 7 This opinion may be valid to some, but it is irresponsible to not look at the benefits from an economic stand point that we could be able to have. At what limit of money does the act of justice stop? It is cheaper to get rid of the option of capital punishment and it makes a good way for our country and states to save money. Conclusion In conclusion it would be a smart choice to get rid of the use of the death penalty. Looking at the numbers and benefits from doing so from an economic standpoint, it will save millions of dollars by switching to only using life without parole for serious crimes. A couple of the reasons why are that most of the time, those who are charged with the death penalty don t get executed anyways. It is also less expensive to go through all the trials and pretrial when the charge is LWOP. The cost in the living situation with death row is more expensive to keep up with when compared to the regular criminals. And it will save the taxpayers of the state millions and millions of dollars in just a year by eliminating the use of capital punishment. When making a decision on whether to be pro or against the Death Penalty it is important to look at all points that are presented. From a logical point of view, it will be better in order to save money, if we bring death to the death penalty.
