The Grower Report is to be received from all growers annually. A signed copy of this Grower Report for 2017, and any assessment which may be due from the grower, is to be received by the U.S. Highbush Blueberry Council (USHBC) no later than November 30, Note that any grower producing less than 2,000 pounds of blueberries annually may apply to the USHBC for exemption from assessment. Growers also have the option if they produce organic blueberries to apply annually for organic exemption from assessments if they wish. As stated in Section of the Blueberry Promotion, Research and Information Order (Part 1218), The collections of assessments on domestic blueberries will be the responsibility of the first handler receiving the blueberries (See attached USDA Memo). In the case of the producer acting as its own first handler, the producer will be required to collect and remit its individual assessments. Production reporting, payment calculation and payment instructions, as well as report due date and late payment fees are detailed in the Instructions section located on the reverse side of the Grower Report. 4 INSTRUCTIONS The Grower Report is to be received from all growers annually. All blueberry growers are required to complete Part A, Part B and Part C of this report, and sign the certification statement at the bottom of each report. The U.S. Highbush Blueberry Council (USHBC) must receive the original of the report, with signature, by no later than November 30 of each calendar year. Note: If no payment is required from the grower, a signed and completed copy of this form can be faxed to the USHBC office at Also note that a grower assumes the responsibility of a grower/handler on any of their product that the grower sells on their own (Line 3 of this report). Assessment required from a grower on this product must also be received by November 30 of each calendar year. A late payment charge will be imposed on any grower who fails to remit the total amount in a timely manner. The staff of the U.S. Highbush Blueberry Council holds all reports in strict confidence. Assessment Exemption: Any grower producing less than 2,000 pounds of blueberries annually can apply to the USHBC for exemption from assessment. Organic Assessment Exemption: Any grower producing organic blueberries can apply annually to the USHBC for exemption from assessment on their organic production. Submission of Reports and Payments: Reports and payments are to be sent to the U.S. Highbush Blueberry Council at the following address: USHBC #1, c/o El Dorado Savings Bank, 3963 Park Drive, El Dorado Hills, CA Handler Definition: The definition of First Handler is stated in Section of the Blueberry Promotion, Research and Information Order (Part 1218) as follows: First Handler means any person, excluding a common or contract carrier, receiving blueberries from producers and who as owner, agent or otherwise ships or causes blueberries to be shipped as specified in the Order. This definition includes those engaged in the business of buying, selling and or/offering for sale; receiving; packing; grading; marketing; or distributing blueberries in commercial quantities. This definition includes a retailer, except a retailer who purchases or acquires from, or handles on behalf of any producer, blueberries. The term first handler includes a producer who handles or markets blueberries of the producer s own production. Responsibility for Assessment Collection: As stated in Section of the Blueberry Promotion, Research, and Information Order (Part 1218), The collection of assessments on domestic blueberries will be the responsibility of the first handler receiving the blueberries. In the case of the producer acting as its own first handler, the producer will be required to collect and remit its individual assessments. Late Payment Fees As noted in Section , Item E of the Order, All final payments for a crop year are to be received no later than November 30 of that year. A late payment charge shall be imposed on any handler who fails to remit to the USHBC the total amount for which any such handler is liable on or before the due date established by the USHBC. In addition to the late payment charge, an interest charge shall be imposed on the outstanding amount for which the handler is liable. Per Section of the Order, the USHBC will levy a one-time late payment charge of 5% on the outstanding amount due and an interest charge of 1% per month on the total outstanding balance plus the late payment charge. The late payment will be imposed on any assessments not received within 30 calendar days of the date when assessments are due. Interest will continue to accrue monthly until the outstanding balance is paid to the Council. This rule amends the current regulations to allow persons that produce, handle, market, process, manufacture, feed, or import organic and 100 percent organic products to be exempt from paying assessments associated with commodity promotion activities, including paid advertising, conducted under a commodity promotion program administered by the Agricultural Marketing Service (AMS), regardless of whether the person requesting the exemption also produces, handles, markets, processes, manufactures, feeds, or imports conventional or nonorganic products. Previously, only persons that exclusively produce and market products certified as 100 percent organic were eligible for an exemption from assessments under commodity promotion programs. This new rule expands the exemption to cover all organic and 100 percent organic products certified under the National Organic Program regardless of whether the person requesting the exemption also produces, handles, markets, processes, manufactures, feeds, or imports conventional or nonorganic products. To be considered for exemption from USHBC assessment under this new rule, the blueberry producer or importer must complete and sign the enclosed Organic Operation Exemption Request Form and file it with the USHBC office. This application is a signed certification that the applicant meets all of the requirements specified for an assessment exemption. This application must be filed annually, on or before January 1, as long as the applicant remains eligible for exemption. The USHBC has 30 days to review and approve an exemption request. If your request is not approved the USHBC will notify you of the reason(s) for disapproval within this same timeframe. You can appeal if exemption is not granted with first appeal to the USHBC. If not satisfied with the results of this appeal a second appeal can then be made to the USDA, which will make a final decision. In order to be exempt, the producer or importer must meet all of the following requirements: Operates under an approved organic system plan authorized by the National Organic Program (NOP) (7CFR Part 205) The exemption shall apply to all certified organic or 100 percent organic (as defined in the NOP) products of a producer regardless of whether the agricultural commodity subject to the exemption is produced by a person that also produces conventional or nonorganic agricultural products of the same agricultural commodity as that for which the exemption is claimed.

6 Along with your completed assessment exemption form you must also provide a copy of your valid certificate of organic operation as issued under the Organic Foods Production Act of 1990 (7 U.S.C ) (OFPA) and the NOP regulations issued under OFPA (7 CFR part 205) Importers must provide a copy of the organic farm or organic handling operation certificate from each person from whom they receive product Any producer so exempted shall continue to be obligated to pay assessments under this part that are associated with any agricultural products that do not qualify for an exemption under this section. Though this assessment option is being made available to organic operations and importers, it is the hope of the USHBC that the value of market promotion and health research activities supported with USHBC funds are recognized when considering exemption. How effective have these programs been? This is a question that all federal check off programs must answer through independent program evaluations. These evaluations are conducted every five years and the USHBC has recently completed its third evaluation. The evaluation was conducted by Dr. Harry Kaiser from Cornell University in 2015 and consisted of an econometric evaluation of USHBC activities from 2010 to The evaluation was designed to determine the market impact of USHBC promotional programs and to provide a benefit cost ratio, or rate of return, for promotional activities. According to the evaluation, generic blueberry promotion by the USHBC during this period had a positive and statistically significant effect on domestic demand, per capita consumption and grower price. The average impact of USHBC activities on grower price totals cents per pound. The benefit cost ratio for USHBC activities came in at 9.07 meaning that the benefits of the USHBC program exceeded costs by eight-fold. The evaluator notes that the analysis shows a positive market impact from USHBC activities and that the benefits of the USHBC promotion program are greater than their cost. With the growing international interest in blueberries and health, our industry is riding the health wave with very favorable blueberry demand. The USHBC will continue to support and encourage additional health related blueberry research to learn more about the healthful properties of our fruit. Given recent acreage increases and future production potential, the industry also needs to continue to aggressively develop new markets both at home and abroad, work with food manufacturers to increase their blueberry use, increase consumer consumption, and encourage new users. With effective market promotion and management, a continued willingness to explore market opportunities, and a vision of future market potential, the blueberry industry, both conventional and organic operations, will continue to ride this wave and enjoy a healthy and profitable industry Blueberry market promotion and health research efforts conducted by the USHBC to date have proven beneficial to all highbush blueberry producers, both conventional and organic. Funds from both conventional and organic operations are needed to continue efforts to maintain positive demand for blueberries and to continue to keep demand ahead of future supply. It is hoped the benefits of the USHBC program enjoyed by both organic grower operations and conventional blueberry growers are considered and the program continues to be voluntarily supported by those with organic operations through their continued assessment funding.

8 SUMMARY BLUEBERRY PROMOTION, RESEARCH AND INFORMATION ORDER FOR CULTIVATED BLUEBERRIES U.S. HIGHBUSH BLUEBERRY COUNCIL Background The North American Blueberry Council (NABC) submitted a proposal for a national promotion program for blueberries (the U.S. Highbush Blueberry Council) on December 2, The program is implemented under the Commodity Promotion, Research and Information Act of The final rule implementing the order was published in the Federal Register on July 17, Initial Referendum Results Before the program could be implemented, it had to be approved by producers and importers. Approval was determined by a majority of producers and importers voting for approval who also represented a majority of the volume of blueberries represented in the referendum. In order to be eligible to vote, a producer or importer must have produced or imported 2,000 pounds or more of cultivated blueberries during the period from January 1, 1999 to December 31, 1999 (representative period). The referendum was conducted by the USDA's Agricultural Marketing Service from March 13 through April 14, Results of this referendum, announced on July 13, 2000, showed that 67.8 percent of those who voted favored implementation of the Blueberry Promotion, Research and Information Order. Those who voted in favor represented 73.2 percent of the volume of cultivated blueberries represented in the referendum. Continuance Referendum Results As required under the Order, a continuance referendum is conducted every five years to ascertain whether continuance of the Order is favored by producers and importers of blueberries. A referendum was conducted by mail from July 5 to July 28, 2016 with 74 percent of those who voted favoring continuation of the order. Those voting in favor represented 80 percent of the volume of cultivated blueberries represented in the referendum. Based on these results, the order will continue. In accordance with the provisions of the Order, blueberry producers and importers will be provided another opportunity to participate in a continuance referendum in the year Assessments The Order authorizes a fixed assessment to be paid by producers (collected by handlers) and importers (collected by the U.S. Customs Service) at a current rate of $18 per ton. Assessments are used to pay for: promotion, research, and information projects; administration, maintenance, and functioning of the U.S. Highbush Blueberry Council (USHBC); and expenses incurred by the Secretary of Agriculture in implementing and administering the Order, including referendum costs. 9 U.S. Highbush Blueberry Council The current twenty member U.S. Highbush Blueberry Council (USHBC) administers the program under the supervision of the Secretary of Agriculture. The USHBC is represented by one member and alternate from each of the following regions: Western Midwest Northeast Southern Alaska Illinois Connecticut Alabama Arizona Indiana Delaware Arkansas California Iowa New York Florida Colorado Kansas Maine Georgia Hawaii Kentucky Maryland Louisiana Idaho Michigan Massachusetts Mississippi Montana Minnesota New Hampshire North Carolina Nevada Missouri New Jersey Oklahoma New Mexico Nebraska Pennsylvania Puerto Rico Oregon North Dakota Rhode Island South Carolina Utah Ohio Virginia Tennessee Washington South Dakota Vermont Texas Wyoming Wisconsin Washington D.C. West Virginia There is also one member and alternate from each of the top eight blueberry producing states. For the current nomination and election period, state representatives are to be elected from Michigan, Oregon, Georgia, Washington, New Jersey, Florida, North Carolina and California. Four importers and alternates, two exporters and alternates, one first handler and alternate, and one public member and alternate also serve on the USHBC. Producers are nominated directly by state commissions or producers. All other members are nominated by the USHBC. The duties of the USHBC include the following: develop annual budgets; appoint members of the USHBC to serve on committees; develop and evaluate projects of promotion, research, and information, and pay the costs of such projects; collect assessments; receive, investigate, and report to the Secretary complaints of violations of the Order; recommend amendments to the Order; employ a staff to administer the program; prepare and submit to the Secretary financial reports; and cause the books of the USHBC to be audited. The Secretary oversees the activities of the USHBC. In addition, the USHBC recommends to the Secretary regulations to carry out the terms of the Order. Subsequent Referenda Every five years, the Secretary of Agriculture will hold a referendum to determine whether producers and importers of cultivated blueberries favor the continuation of the Order. The Order will continue if it is favored by a majority of producers and importers voting for approval who also represent a majority of the volume of blueberries represented in the referendum. In addition, the Secretary may hold a referendum at any time after the effective date of the program. Additional referenda may be requested by the U.S. Highbush Blueberry Council or 10 percent of all cultivated blueberry producers and importers. Product Shipped from U.S.A. to Canada (or any other country) and back to U.S.A.: A U.S. grower who exports blueberries automatically becomes a handler and is responsible for submitting domestic assessments to the USHBC. U.S. grower pays USHBC assessment on all product he ships to Canada (or other country) and reports shipment on his USHBC assessment report form. Canadian shipper requests refund from USHBC for that part of product received from U.S. grower and now shipped from Canada back to U.S. for sale. Shipper provides name and address of U.S. grower, amount shipped back to U.S. for sale, and U.S. Customs Invoice showing amount of product shipped to U.S. and verifying import assessment has been taken on this shipment. USHBC staff matches grower assessment report with Canadian refund request and verifies that amount grower indicates as having sold to Canada is in keeping with the refund amount requested. A searchable list has been created to satisfy these requests. The supplier list is available on the USHBC website at and can also be downloaded for printing. Handlers, Grower and Importers, who are interested in being listed, must complete a USHBC Online Supplier List signup sheet and send a completed and signed copy of the signup sheet back to the USHBC office. Data from the signup sheet will be added to the USHBC Online Supplier List and posted on the USHBC website. Suppliers are listed in alphabetical order by state or country. A supplier will remain listed each year as long as USHBC assessments are current or until the supplier requests to be removed from the list. Those currently in the 2016 list will continue to be listed in Contact information and types of products offered and noted in the listing are the responsibility of the supplier. 12 USHBC 2017 BLUEBERRY ONLINE SUPPLIER LIST SIGNUP SHEET The USHBC Blueberry Online Supplier List will provide those interested in purchasing highbush blueberries with an indication of the types of blueberry products each potential supplier can offer. The USHBC Blueberry Online Suppliers List lists handlers, grower/handlers and importers. The USHBC must receive a completed and signed USHBC Blueberry Online Supplier List signup sheet prior to being listed. Suppliers will remain listed each year as long as USHBC assessments are current or until the supplier specifically requests to be removed from the list. It is the responsibility of the supplier to contact the USHBC should there be any necessary changes or updates to their listings. In order to develop as accurate a supplier list as possible, please complete the contact information requested below and indicate the types of blueberry products you are able to offer to potential domestic and international customers.
