1 THE 35 TH TRIPARTITE TECHNICAL EXPERTS GROUP (TTEG) MEETING ON THE SAFETY OF NAVIGATION IN THE STRAITS OF MALACCA AND SINGAPORE HELD IN SHERATON MUSTIKA HOTEL, YOGYAKARTA, INDONESIA, FROM 4 TO 5 OCTOBER 2010 REPORT OF THE MEETING 1 OPENING OF THE MEETING 1.1 The 35 th Tripartite Technical Experts Group (TTEG) Meeting on the Safety of Navigation in the Straits of Malacca and Singapore was held from 4 to 5 October 2010 at the Sheraton Mustika Hotel Yogyakarta, Indonesia. 1.2 The Meeting was attended by representatives from the three littoral States: Indonesia, Malaysia, Singapore, and observers from Australia, China, India, Japan, Norway, Republic of Korea, International Maritime Organization (IMO), Malacca Strait Council (MSC), Nippon Maritime Center (NMC), as well as members of shipping industries, namely International Association of Independent Tanker Owners (INTERTANKO), International Chamber of Shipping (ICS), the Baltic and International Maritime Council (BIMCO), Federation of ASEAN Shipowners Association (FASA), Asian Shipowners Forum (ASF). The list of participants appears as ANNEX A. 1.3 Mr. Sunaryo, Director General of Sea Transportation, Ministry of Transportation, representing the host of Indonesia, opened the meeting and delivered the opening remarks. In his remarks he welcomed all participants of the Meeting and underlined the significant accomplishments of the TTEG in order to support the sustainability of safety of navigation as well as to minimizing the risk of marine environment pollution in the Straits of Malacca and Singapore. In that opportunity, he also conveyed his hope for the good cooperation among littoral States and other stakeholders to enhance the safety of navigation and marine environment protection in the Straits. 2 ELECTION OF CHAIRMAN AND VICE-CHAIRMAN 2.1 Mr. Yudustar, Head of Indonesian Delegation and Mr. Baharin Bin Dato Abdul Hamid, Head of Malaysian Delegation, were respectively elected as Chairman and Vice-Chairman. 2.2 Malaysia and Singapore conveyed their appreciation and thanked Indonesia for hosting and convening the Meeting. 1

2 2.3 In their remarks, Malaysia expressed the relevance of the TTEG as a forum for cooperation among the littoral States to ensure the safety of navigation and protection of marine environment in the Straits of Malacca and Singapore. In light of the impacts to shipping in this busy waterway, this will also make the Straits as a safe place to sail hence contributing to the World Maritime Day of the Year of the Seafarers. The remarks appear in Annex B. 2.4 Singapore further highlighted that the conduct of the 35 th Meeting of the TTEG demonstrated the long and successful cooperation amongst the littoral States to maintain safety of navigation and environmental protection in the Straits of Malacca and Singapore. Singapore also underlined the continued role of the TTEG as an important body to govern the aspects of safety of navigation and environmental protection in the Straits of Malacca and Singapore, and commended the work that has been done by the TTEG to keep the Straits open and safe for international shipping. 3 ADOPTION OF THE AGENDA 3.1 The meeting made several amendments and incorporated additional items to the agenda. 3.2 The Meeting considered and adopted the Agenda that appears as ANNEX C. 4 BUSINESS ARRANGEMENTS 4.1 The Meeting agreed to discuss the Agenda in plenary and Working Groups. 5 STATUS REPORTS Aids to Navigation 5.1 The Meeting noted the status reports on Aids to Navigation by Indonesia, Malaysia and Singapore. With regard to the hit and run incidents involving the Batu Berhenti buoy, Singapore suggested the possible use of technology such as CCTV, AIS and LED to reduce such incidents. Singapore also raised the possibility of relocating the buoy to avoid such incident. Indonesia expressed that in regard to the hit and run incidents that often occur to the Indonesian AtoN, cooperation within the littoral States including related VTS data sharing might be required. The reports appear as ANNEX D. 2

3 Marine Casualty Affecting Traffic Movement 5.2 The Meeting noted the status reports on Marine Casualty Affecting Traffic Movement by Indonesia, Malaysia, and Singapore. Singapore highlighted that most of the incidents which occurred in the Singapore Strait involved either one or two vessels engaged in crossing the Traffic Separation Scheme (TSS) with most incidents taking place in the hours of darkness. The reports appear as ANNEX E. Mandatory Ship Reporting System (STRAITREP) 5.3 The Meeting noted the status report by Malaysia and Singapore that there were no occurrence of vessels not complying with the provisions of STRAITREP failure to report. Contravention of Rule 10 of Collision Regulation (COLREGS) 5.4 The Meeting noted the status report by Malaysia that there were no occurrence of vessels not complying with Rule 10 of the International Regulations for Preventing Collisions at Sea (COLREGS). The Meeting also noted the status report by Singapore that there were 77 occurrences of vessels not complying with Rule 10 of COLREGS, in the Singapore Strait Traffic Separation Scheme. The report appears as ANNEX F. 5.5 The Meeting also recalled that pursuant to the decision of the 34 th TTEG, a corresponding circular on Information concerning Anchoring in the Traffic Separation Scheme in the Straits of Malacca and Singapore (SN.1/Circ.282 of 27 November 2009) had been issued by the IMO which was expected to improve the situation. 6 UPDATE ON PROGRESS OF THE CO-OPERATIVE MECHANISM 6.1 The Meeting noted the report by Malaysia on the update on 4 th Aids to Navigation Fund (ANF) Committee Meeting. The Meeting also noted that the 5 th ANF Committee Meeting will be held on 11 to 12 October 2010 in Langkawi, Malaysia. The report appears as ANNEX G. 6.2 The Meeting noted the report by Singapore on 2 nd Co-operation Forum which appears as ANNEX H. 6.3 The Meeting noted the report by Indonesia on the 3+1 Meeting of the Littoral States and the International Shipping Industry on the Straits of Malacca and Singapore under the Co-operation Forum of the Co-operative Mechanism on Safety of Navigation and Environmental Protection. The presentation of the report appears as ANNEX I. 3

4 6.4 The Meeting noted the presentation of the Industry s Proposals on Safety of Navigation and Marine Environmental Protection. The Meeting agreed that the Proposals would be discussed for further detail in Working Group during this Meeting. The Presentation of the proposal appears as ANNEX J. 6.5 The Meeting noted the update on the progress of Project 1 and Project 2 of the Cooperative Mechanism presented by Malaysia. The Meeting agreed that the request to be made from the IMO Straits Fund to finance phase one of the Project 2. The reports appear as ANNEX K. 6.6 The Meeting noted the update on the progress of Project 3 and Project 4 of the Cooperative Mechanism presented by Singapore. The Meeting agreed that, based on the presentation of the outcomes of the demonstration trial, Project 3 has been formally completed. The reports appear as ANNEX L. 6.7 The Meeting noted the update on the progress of Project 5 and Project 6 presented by Indonesia. The reports appear as ANNEX M. 6.8 The Meeting noted the presentation by Indonesia on Development of VTS In the Straits of Malacca and Singapore. Indonesia also indicated the possible areas of cooperation with potential contributors to anticipate Indonesia s plan to operate their VTS in The Meeting agreed to establish Working Group for further discussion on the Development of VTS in the Straits of Malacca and Singapore at the 36 th Meeting of the TTEG. The presentation appears as ANNEX N. 6.9 The Meeting discussed the review and enhancement of measures in the Straits of Malacca and Singapore for Safety of Navigation and the Protection of the Marine Environment. The meeting agreed that a working group be established for this review and enhancement of such measures, and for the working group to discuss the terms of reference, the scope of work, and the way forward at this Meeting The Meeting noted the presentation by Malaysia on Ship Carrying Capacity of the Strait of Malacca. The Meeting agreed that this matter be discussed in the working group on the review and enhancement measures. The presentation appears as ANNEX O. 7 WORKING GROUPS MEETING 7.1 The meeting noted the Working Group on: Concept Proposal of Emergency Towage Vessel (ETV) Service in the straits of Malacca and Singapore presented by Singapore; on Development of proposal by Industry by Singapore. The meeting also noted the Drafting Group on Voluntary Pilotage Services in The Straits of Malacca and Singapore. 4

5 8 REPORT OF DRAFTING GROUP ON VOLUNTARY PILOTAGE SERVICES IN THE STRAITS OF MALACCA AND SINGAPORE 8.1 The Meeting agreed that more time be given to finalize the revised guidelines for circulation amongst the littoral States, and that a meeting can be convened intersessionally where necessary. After reaching an agreement on the revised guidelines, the joint paper will be drafted and sent to IMO. 8.2 The Meeting noted and agreed the report of the Drafting Group on Voluntary Pilotage Services in The Straits of Malacca and Singapore. The report of the Drafting Group appears as ANNEX P. 9 REPORT OF WORKING GROUP ON THE PROPOSAL FOR CONCEPT STUDY ON EMERGENCY TOWAGE VESSEL (ETV) SERVICE IN THE STRAITS OF MALACCA AND SINGAPORE BY THE THREE LITTORAL STATES 9.1 The Meeting approved the recommendations as proposed by the Working Group in its report. The report of the Working Group appears as ANNEX Q. 10 REPORT OF WORKING GROUP ON REVIEW AND ENHANCEMENT MEASURES IN THE STRAITS OF MALACCA AND SINGAPORE TO IMPROVE SAFETY OF NAVIGATION AND ENVIRONMENTAL PROTECTION / DEVELOPMENT OF PROPOSALS BY INDUSTRY 10.1 The Meeting noted the report of the Working Groups and agreed to the proposals by the Industry and that they be presented to the 3 rd Co-operation Forum as project proposals from the Industry. The Meeting also commended the efforts by the Industry for providing the proposals The Meeting approved the proposed timeline set out by the Working Groups on the Safety of Navigation and the Protection of Marine Environment as presented in their reports. The reports of the Working Group appears as ANNEX R The Meeting also agreed the terms of reference, scope of work, and implementation plan for the Working Group on Safety of Navigation would be the same as that of the Working Group for Review and Enhancement Measures in the Straits of Malacca and Singapore. The Working Groups are one and the same. 5

6 11 ANY OTHER MATTERS 11.1 The Meeting noted the presentation on the Cooperative Mechanism Website proposed by Malaysia. The Meeting also commended Malaysia for proposing the initiative and to support the initiative in principle The Meeting further agreed that such website is important to give information related with Cooperative Mechanism. The Meeting also agreed to launch the Beta version/soft launch of the said website. Further details regarding the contents, administrator etc will be discussed via correspondence. The presentation appears as ANNEX S The Meeting noted the presentation by Malaysia on Indiscriminate Anchoring in The Straits of Malacca and Singapore. The presentation appears as ANNEX T. Singapore highlighted that the non-anchorage areas in the Malaysian Shipping Notice no. 35/2010 include waters that have yet to be delimited. The full text of Singapore s statement appears in ANNEX U The Meeting noted the presentation on Signals to be Displayed by Vessel Crossing Separation Scheme in the Straits of Malacca and Singapore. Malaysia informed the Meeting that it will continue with the trials on the use of night signals and to inform the stakeholders on the implementation of the trials. The presentation appears as ANNEX V. 12 DATE AND VENUE OF THE NEXT MEETING 12.1 The Meeting agreed that the 36 th Meeting of the TTEG would be held in Malaysia, either in the first or second week of October CONSIDERATION AND ADOPTION OF THE REPORT 13.1 The meeting considered and adopted the report. 14 CLOSING REMARKS 14.1 The Chairman thanked all delegations for their positive contributions and cooperation during the Meeting, and looking forward to have another fruitful discussion on the next TTEG The delegations from Singapore and Malaysia as well as observers from Australia, China, India, Japan, Norway, Republic of Korea, International Maritime Organization (IMO), Malacca Strait Council (MSC), Nippon Maritime Center (NMC), 6
