1 The Orissa Gazette Extraordinary PUBLISHED BY AUTHORITY REGISTRATION NO.0- No.882 CUTTACK FRIDAY, JULY 2, 1994/ASADHA 31, 1916 No.46-IVEMM-37/93-(I)-EPM GOVERNMENT OF ORISSA INDUSTRIES DEPARTMENT RESOLUTION The 7 th July 1994 Sub:- Rules for registration of Small/Medium/Large Scale Industries etc. In accordance with Industrial Policy Resolution, 1992, the following Rules for Registration of Small/Medium/Large Scale Industries etc. are made. These Rules will supersede the Rules circulated in the Circular No.5394(105)/EPM, dated of the Directorate of Export Promotion & Marketing, Orissa ORDER Ordered that the Resolution be published in the Orissa Gazette and copies thereof be forwarded to all Departments of Government and all Heads of Departments and Accountant-General, Orissa. By order of the Governor B. Sarangi Additional Secretary to Govt. RULES FOR REGISTRATION OF SMALL/MEDIUM/LARGE SCALE INDUSTRIES 1. Objectives The main objectives of registration of firms with the Directorate of Export Promotion & Marketing is to have a list of reliable firms from which purchase can be made by Government, Semi-Government offices either through rate contract or otherwise.

Authority Competent to Register The Director, Export Promotion & Marketing will be the competent authority to register the Small/Medium/Large Scale Industries located in the State under these rules. 3. Eligibility for Registration A Small Scale/Medium/Large Scale/ Ancillary/ Panchayat Samiti Industry or a Co-operative Society under the State Government which has its own workshop/factory in the State will be eligible for registration, provided that :- i) It is manufacturing store items which are normally purchased by Departments of Government/Quasi-Government Bodies. ii) iii) It is capable of manufacturing materials of standard specification. The large/medium Scale Industry will be registered for the store item/items not being manufactured by the S.S.I. units located in the State. 4. Benefit of Registration The Units registered with the Directorate of Export Promotion & Marketing will enjoy the following benefits :- a) They will be supplied with tender notices received from DGS&D, Hindustan Steel Limited and State Government Offices, etc. in respect of store items for which they are registered. b) Subject to the suitability of the units, rate contracts when necessary will be concluded only with them. c) The Directorate of Export Promotion & Marketing may take up0 their grievances and difficulties with the concerned Departments/Offices of the State Government and Quasi-Government Offices relating to payment of their dues and marketing their products. The general Manager, District Industries Centre may also take up their grievances and difficulties with the concerned District Level Officers at his level. d) The Small Scale Industries will be exempted from depositing earnest money while tendering for store items for which they are registered (a) Procedure for Registration The unit will apply for registration in the prescribed form (Annexure-A) to the Director, Export Promotion & Marketing either directly or through the Director of Industries/General Manager of concerned District Industries Centre who after scrutiny will forward the application and other documents with their views to the Director, Export Promotion & Marketing, Orissa, Bhubaneswar for grant of registration. (b) Each Application for registration will accompany with a non-refundable registration fee of Rs.200/- in respect of S.S.I. units, Rs.500/- in respect of Medium
3 Scale Industries and Rs.1,000/- in respect of Large Scale Industries in shape of Indian Postal Order or deposit in Treasury Challan under the Head 1475-Other General Economic Services-104-Receipt from Certificate Marking and Testing Fees payable to the Director, Export Promotion & Marketing. Payment of the fees by other means will not be accepted The application should be accompanied with the following: - i) Testing Report, if any, from a competent authority in support of quality of the articles for which registration is sought for. ii) Copy of the Loan Sanction Order of the financial institutions or a certificate from the Banker or a certificate from the Credit Manager, D.I.C. concerned regarding the financial standing of the unit. iii) Document regarding the proof of ownership and Memorandum and Article of Association in case of limited companies. iv) Attested copy of the certificate of permanent registration with the Director of Industries, Orissa/District Industries Centre concerned and appropriate authority. v) Copy of the Land document in support of the ownership of the land and building in which factory of the unit is located. vi) 5.3. If the replies to various questions in the application form disclose that the unit is not prima facie suitable, registration will be refused straight away An Officer of the Directorate of Export Promotion & Marketing or the General Manager, D.I.C. concerned who may be entrusted with the case will inspect the unit concerned, draw sample of the finished products and raw-materials, if necessary, for testing the quality of the product. The inspecting officer shall submit his report to the Director, Export Promotion & Marketing within seven days from the date of inspection On completion of the enquiries, if a firm is considered suitable for registration, a certificate of registration will be granted to the unit under signature of the Director, Export Promotion & Marketing The unit will get permanent registration or till date of validity of land document/d.i.c. PMT/Drug Licence/B.I.S. Certificate etc The temporary registration will be renewed on receipt of the valid documents along with written application of the unit concerned The unit if interested will be granted registration for additional store items after proper enquiry. The unit concerned will have to pay Rs.50/- for inclusion of additional item/items in the original registration certificate in each occasion.
4 5.9. Additional fees of Rs.50 will be payable in case of issue of duplicate certificate amendment of the original certificate. The fees for the additional item and duplicate certificate etc. will be payable as per the manner indicated in 5.1(b) Suspension of the registered firms The registered firms will not be eligible to do any business with the offices of the Orissa Government for the punishment of Suspension as detailed below: When a prima facie case of corruption etc. is made out against an unit, business with it by the offices of Government of Orissa will be suspended under orders of Director, Export Promotion & Marketing pending full enquiry and final decision When reports with full details against the unit for corrupt practice etc. are received by the Director, Export Promotion & Marketing, he will make necessary preliminary investigation, and if satisfied that a prima facie case exists he will take immediate steps to issue orders suspending business with it pending final decision. After full investigation, the final decision in the matter may be taken by
