1 WES VIC HOLIDAY SANDS P.O.A. BOARD MEETING BOARD MEMBERS PRESENT: Kenny Folsom, Vera McDaniel, Orville Creager, Miles Schuler and Ray Ott via phone. Also, Michelle Rogers (treasurer) and Nancy Powell (secretary). PROPERTY OWNERS PRESENT: Dabo & Jan Renfroe, Joe Weber, John Rogers, Frank & Marsha Hart, Ralph Powell and Kevin Marano. Kenny Folsom called the meeting to order at 5:30 P.M. Orville Creager made a motion to approve the minutes from the previous board meeting. Ray Ott seconded the motion. All were in favor. Kenny discussed the possibility of alternate locations for future board meetings. Miles stated he would check with the owners of The Sail Inn. Kenny stated the board could utilize his porch and Orville stated they could use the green house. Proposed budget was discussed. Orville asked if money already spent is included in the $3000 allocated for the roads. Legal expenses were discussed. Kevin asked about how the attorney was hired? Kenny stated he had asked the previous president about the hiring of Kerry Ann Schultz, as there is no record of the previous minutes pertaining to whether the attorney was hired and/or how. Orville stated he knew one to two days after the original meeting that Bill and Vince went to her office and signed a contract. Kevin asked about Kerry Ann Schultz. Ray Ott made a motion to approve the proposed budget. Orville Creager seconded the motion. All were in favor. The prior year s expenses were discussed. Kevin asked about Sunshine Laws and if three out of the five board members knew than that is the majority of the board. Orville withdrew his request for an audit. Michelle stated there was no reason for an audit. Kevin asked about the current dues, which were mailed on August 19, Kenny explained that no one would be delinquent until after 30 days received. Bonding the treasurer was discussed. Kenny feels it would just be a good idea in case there is any question about how money is being spent. Miles Schuler made a motion to look into this issue. Orville Creager seconded the motion. All were in favor. Kevin stated that the board members, including the treasurer and secretary, should be covered under the D&O insurance. John Rogers suggested capping the amount of the bond. Kenny will look into the bonding issue. Roads were discussed. $1,400 has been spent to date. John asked about the road in front of the Marano s home and Frank stated he is working on that.

Ray Ott made a motion to accept. Orville Creager seconded the motion. All were in favor. ACC ~ members consist of John Rogers (chair), Kenny Folsom and Marsha Hart. Orville Creager made a motion to accept. Ray Ott seconded the motion. All were in favor. Roads ~ members consist of Ray Ott (chair), Frank Hart, Dwight Ford and Ralph Powell. Vera McDaniel made a motion to accept. Miles Schuler seconded the motion. All were in favor. Beach and Pier ~ members consist of Miles Schuler (chair) and John Rogers (until November). Orville Creager made a motion to accept. Vera McDaniel seconded the motion. All were in favor. Miles asked what other items need to be done to the beach/pier. The beach needs to be mowed. Kenny stated that some support beams got knocked loose. Dabo stated he tightened as many loose boards as possible on the pier. John suggested a work day in October. Kenny stated a work day will be scheduled for October. Neighborhood Upkeep ~ Vera McDaniel made a motion to accept. Miles Schuler seconded the motion. All were in favor. Orville asked about what this would entail? Previous committee had overstepped their boundaries. Kevin discussed the situation at the Matheny home. The POA is responsible for situations like these. Orville also discussed the home across from the Marano s. Orville stated only one dead rat was found and one snake crawling through the fence. He further stated that Fireman s Pest Control said Honduran rats would go back to their swamp and die there. Kevin discussed WVHS Preservation Association and that the property to the east is POA owned. Kenny asked Orville if he would head up this committee. Orville asked John about evicting and John explained that a renter can be evicted, but a homeowner cannot be evicted. He further explained that the board can fine a homeowner. Kevin stated it is the responsibility of the board. John suggested that the president draft another letter to Lane Lynchard. Kevin stated that a stray dog was taken into the Matheny home. Animal control was called but said the pound was full. Dabo requested that authority be given to someone to help stabilize the neighborhood situation. Kenny stated he would try to find other members to be on the committee. Orville agreed to chair the committee. Kevin discussed Jimmy Jayne s situation and that he has nothing to lose. Neighborhood Watch ~ members consist of Jan & Dabo Renfroe, Ralph & Nancy Powell and John Rogers. Vera McDaniel made a motion to accept. Orville Creager seconded the motion. All were in favor. It was stated that anyone can call the Sheriff.

3 Marsha Hart asked who owns the property next to her home, as the grass is overgrown. It was stated that the Bank of Thomas County, Georgia is the owner. Orville stated he would check into this. Dabo asked if it was okay for him to go ahead and cut the grass. Orville will check with bank to see if they want our help. WES VIC HOLIDAY SANDS P.O.A. BOARD MEETING PAGE 3 All committees should check with the board prior to making any final decisions. Retaining Kerry Ann Schultz to represent the POA was discussed. Kevin explained that he believes there is a conflict of interest by having Kerry Ann Schultz as attorney for the POA. Kenny stated he has spoken with Kerry Ann Schultz and he doesn t believe there is a conflict. Kenny discussed using Kerry Ann Schultz to attend mediation on the re-plat issue. He requested the board approve expenditure of $ per day for up to two days for Kerry Ann Schultz to attend mediation on the re-plat issue. Ray Ott made a motion to retain Kerry Ann Schultz. Miles Schuler seconded the motion. Orville Creager abstained from voting. All were in favor. Kenny discussed Ann Nickroo s research and how most of her research has been extremely valuable. He felt that she went too far in making accusations against Kerry Ann Schultz and that Ms. Schultz stated all research will be utilized for the good of the POA. Appointing Kenny Folsom, Vera McDaniel and Burton McDaniel to attend mediation of the re-plat issue was discussed. Orville Creager made a motion to accept. Ray Ott seconded the motion. All were in favor. Kenny feels that everyone wants the same thing. He stated he is concerned about the Preservation Association, but still feels that everyone ultimately wants the association s rights to be taken care of. Lease issues were discussed. Kenny discussed anonymous request to ban BS Squared from leasing. The anonymous letter discussed such issues as BS Squared leasing to a sexual predator, a dangerous person, an irresponsible person, etc. Orville (as BS Squared s representative) discussed Ray & Tiny, Brad, Vanderbush, Jimmy Jaynes and Ralphy Warden. Orville stated Jimmy Jaynes was not brought in by BS Squared. He was a guest like Brad, per Orville. Ralphy Warden was a deal between the real estate agent and BS Squared. John requested to speak. He stated that BS Squared comes in and quickly fixes their wrongs as soon as they are caught. All leases are not current per John Rogers. Nancy Powell asked Orville who is responsible for leasing for BS Squared. Orville stated he is in charge. John stated he didn t think a ban would be possible. Ray Ott made a motion to not consider request to ban BS Squared from leasing, due to sent anonymously. Vera McDaniel seconded the motion. Orville abstained from voting. All were in favor. Kevin asked to suspend for 14 days of leasing in order to get a committee

4 together. Orville Creager made a motion to require a Driver s License, Credit Check and Background Check for any leasors. Kenny Folsom seconded the motion. Vera requested to include information sheet for each lease. Orville agreed to include this to his motion. Marsha Hart asked if renters are given a copy of our rules and regulations. Orville stated yes. Miles requested a discussion and stated that someone cannot be refused due to their credit score. WES VIC HOLIDAY SANDS P.O.A. BOARD MEETING PAGE 4 Kenny stated he liked the motion and the information sheet. John suggested tabling this until the next meeting. Kenny tabled until the next meeting. Kevin asked where does this leave us now? Kenny discussed lease transfer of Jimmy Herron. The current lease is not valid. Kenny stated he would need to research and verify whether BS Squared has valid leases. Orville stated Jimmy Herron is leasing to buy the old Lambeth property. Kevin stated that a corporation in here is still profiting from their lawsuit when other property owners cannot refinance or sell properties due to the lis pendens. Orville stated that BS Squared will no longer cut anyone s properties other than their own from now on. Filing liens on properties with delinquent assessments was discussed. Kenny asked to wait until 30 days after most recent dues were mailed. The issue will be addressed. John stated no property has changed hands, so can file liens at any time. Additional items were discussed. Orville requested that the ACC have the two trailers removed that were placed next to the Powell property. Kenny stated he would speak to the property owner and request that the two trailers be removed. Kevin asked where the lease situation stands right now. Kenny stated he would review the previous lease. Vera requested that current renters be given recent by-laws and made aware of leash laws. Dabo asked for more signs for the pier and neighborhood watch signs from the county. Kenny asked Miles to look into signs, such as private pier, etc. John asked if planning a party at the pier and expecting more than ten people that you let the neighborhood know through the board. Orville asked about having a small dumpster at the pier. The Beach and Pier Committee will look into this. Orville Creager made a motion to adjourn the meeting. Miles Schuler seconded the motion.
