WHY THIS REPORT IS NEEDED 1.1 The licensing authority having received valid representations against the application for a premises licence is expected to hold a hearing to consider those representations. The application can be determined by the licensing authority without a hearing in certain circumstances. 2. REASONS FOR RECOMMENDATIONS 2.1 Where a representation is submitted under section 18(3) of the Licensing Act 2003 (and not withdrawn), the authority must hold a hearing to consider it, unless the applicant and any party or responsible authority who has made (and not withdrawn) a valid representation agree, or where the authority considers that the representations are frivolous, vexatious or will certainly not influence the authority s determination of the application. 3. 5 LICENSING ACT 2003 OFFICERS REPORT Fair Price Foods, 11 Church Road, London, NW4 4EB 1. The Applicants The application was submitted by PR Retail consultants on behalf of Sohail Razzaq. 2. Application The application before the sub committee was submitted under Section 34 of the Licensing Act 2003 to vary a Premises Licence. The application seeks to allow the following: To allow the supply of alcohol off the premises only from 00:00hrs until 00:00hrs (24 hours) Monday to Sunday. To allow the premises to remain open to the public from 00:00hrs until 00:00hrs (24 hours) Monday to Sunday. A full copy of the application can be seen attached to this report in Annex Premises Licence History This premises licence was first applied for and granted on the 2 ND September Since then there has been 1 application to vary the Premises licence. Current Premise Licence The current licence allows the below licensable activities: Sale or supply of Alcohol Both off the premises. 6 4. Representations Responsible Authorities We have received a representation from PC Vicky Wilcock on behalf of the Metropolitan Police. The representation relates to the Prevention of crime and disorder and PC Wilcock states: This store is situated in close proximity (within eyesight) to the Claddagh Ring who serve alcohol until 2am at the weekends. Police are concerned that patrons leaving that venue will be tempted to purchase more alcohol. We feel this would be likely to cause an increase in crime and disorder and anti-social behaviour. Other representations The Licensing Team have not received any representations from any other parties. The representation letter can be seen attached to this report in Annex Attaching conditions The operating schedule, which is part of the application, includes certain additional steps that the applicant will take to protect the licensing objectives. These will become enforceable conditions, should the licence be granted. Additional conditions may be attached to the licence if the committee thinks it appropriate. The Committee must have regard to all of the representations made and the evidence it hears, and is asked to note that it may not attach conditions or reject the whole or part of the application merely because it considers it desirable to do so. It must actually be appropriate in order to promote the licensing objectives. In relation to conditions, the statutory guidance at chapter 10.8 states that The licensing authority may not impose any conditions unless its discretion has been engaged following receipt of relevant representations and it is satisfied as a result of a hearing (unless all parties agree a hearing is not necessary) that it is appropriate to impose conditions to promote one or more of the four licensing objectives.. Full Copies of the Councils Statement of Licensing Policy, the Statutory Guidance to the Act and the Council s Guide to Good Practice at Licensed Premises will be available at the Licensing Sub Committee hearing or in advance if required. 23 Annex 1 Mandatory Conditions 1. No supply of alcohol may be made under the premises licence- (a) at a time when there is no designated premises supervisor in respect of the premises licence, or (b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended. 2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. 3. (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol. (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. 2. For the purposes of the condition set out in paragraph 1 (a) duty is to be construed in accordance with the Alcoholic Liquor Duties Act 1979 (b) permitted price is the price found by applying the formula P = D + (DxV) Where (i)p is the permitted price (ii)d is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii)v is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) relevant person means, in relation to premises in respect of which there is in force a premises licence (i) The holder of the premises licence (ii)the designated premises supervisor (if any) in respect of such a licence, or (iii)the personal licence holder who makes or authorises a supply of alcohol under such a licence; (d) relevant person means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and (e) value added tax means value added tax charged in accordance with the Value Added Tax Act 1994.

24 3.Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from the paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. 4.(1)Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day ( the first day ) would be different from the permitted price on the next day ( the second day ) as a result of a change to the rate of duty or value added tax. (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day. Annex 2 Conditions consistent with the operating schedule 5. Alcohol shall not be sold or supplied except during permitted hours. 6. Alcohol shall not be sold in an open container or be consumed in the licensed premises. 7. A CCTV system will be installed that complies with the following specifications: a. Digital recording colour CCTV comprising of a multi camera system. b. The head unit (recorder) for storing the images will store such data on a hard drive or a similar quality medium. c. If the head unit (recorder) is kept on the premises it must be located in a secure cabinet or other secure area, preferably out of the sight and reach of the public. The unit must be further secured by physical means to prevent anyone from merely picking up and removing the unit, e.g. a secure metal boot, or metal case strap, bolted to an immovable object like a wall or floor. d. A CD or DVD burner will also form part of the system to facilitate making copies of the images. e. The quality of the images must be of a sufficiently high standard to allow identification of the subject matter. f. Cameras will cover key areas identified by the operator and Police. These will include clear head shots of persons entering the shop area, the till area and areas where alcohol are displayed for sale. g. Images must be retained for a period of 31 days before overwriting. h. The images will be made available in reasonable time on demand by the Police and authorised officers of the London Borough of Barnet. i. At all times when the premises are open there shall be at least one person who is capable of operating the CCTV system if required to do so by the Police or authorised officers of the London Borough of Barnet. j. This system will be fully maintained at all times to ensure correct operation. 8. Staff will be trained regularly in underage alcohol sales, age verification and how to detect proxy sales. The training record will be updated regularly and would be made available on request by an authorised Police Officer or Officer of the Local authority. 9. The premises licence holder will ensure that a refusals and incident register will be kept and maintained on the premises. This will hold the details of the incident/ refusal, any contact details and the details of the person dealing with the incident/refusals. This will be made available on request to an authorised officer of the Police or Local Authority.

25 10. The premises licence holder will adopt and maintain a Challenge 25 policy. Signage of the Challenge 25 policy and signage of the legal penalties for purchasing alcohol for persons under the age of 18 will be prominently displayed on the premises. For the following reason(s) Police are satisfied that the exceptional circumstances of the case are such that by granting the application would undermine the licensing objectives, crime prevention and prevention of a public nuisance. Mr Razzaq made an application in September 2014 originally asking for a licence to sell alcohol between daily with the store open 24 hours a day. The Sergeant Altman objected to the time he could sell alcohol based on the likelihood of the impact on crime and disorder. It was likely that the alcohol bought would be consumed in the surrounding streets and alleyways. This is still very much a concern especially now that 24 hours has been applied for. This store is situated in close proximity (within eyesight) to the Claddagh Ring who serve till 2am at the weekends. Police are concerned that patrons leaving that venue will be tempted to purchase more alcohol. We feel this would be likely to cause an increase in disorder and anti-social behaviour. PCSO Grant from Hendon safer neighbourhood team has ed the police licensing office in response to this application expressing concerns of a 24 hour alcohol licence in this location. Street drinking causes a public nuisance. It is not something the police would want to see increase in any area as it is something that we are trying to tackle on a daily basis. (see attached) The Police respectfully request that the application is refused in order to fully promote the 4 licensing objectives. Dates to avoid where possible If possible could we avoid the 11th September as this is a mandatory training day for us. The 28th September due to booked leave and start times after midday due to childcare needs.
