1 2017 Legislative Wrap-up and Proposed 2018 Legislative Platform Karen Lange Shaw/Yoder/Antwih, Inc.
2 CACTTC engaged on much legislation in Sponsored legislation. Other legislation of interest or affecting tax collector or treasurer operations.
3 SPONSORED LEGISLATION
4 SB 7 (Moorlach) 2 Year Bill The changes would require specific information be included for voter review in school bond elections. Information would include the school or college campus being impacted, and project information based on support documentation such as plans and cost estimates.
5 AB 271 (Caballero) 2 Year Bill This proposal will include new oversight provisions to PACE programs: Treasurer-Tax Collector has authority to direct Auditor to strip PACE liens from the property tax roll. Penalties and interest accruing on the PACE lien would be deposited into a special fund to offset losses in a tax sale.
6 SB 653 (Moorlach) as originally proposed This proposed legislative change would give the County Treasurer and Tax Collectors the flexibility to post Revenue and Taxation Code required notices on their website as an option, as opposed to requiring newspaper publication. (Kern County). The author changed the bill to mandate that Tax Collectors put online any notices that are published in a newspaper. The Governor signed this bill and it will take effect on January 1, 2018.
7 SB 812 (Senate Governance and Finance) Certain property owners, on a habitual basis, do not pay their property taxes, allow them to go Power to Sell, be put into a tax sale, and then buy them back once the minimum bid is reduced far below the taxes that are owed. This proposal would stop that practice by making it illegal to buy back your own property at tax sale at a reduced price below the minimum bid. This bill is to the Governor.
8 OTHER LEGISLATION OF INTEREST
9 SB 2 (Atkins) Will authorize a $75 fee per recorded document, up to $225, to fund a permanent funding source for affordable housing. As part of a larger housing package, the Governor signed this bill. There are exclusions to this bill.
10 SB 148 (Wiener) Would have allowed tax collectors to collect taxes and permit application fees on behalf of the State for cannabis-related activities. This measure would have required tax collector consent along with Board consent. CACTTC had no position; the bill was held in Senate Appropriations but the language was put in the Cannabis trailer bill with a focus on the North Coast Counties, and was chaptered.
11 SB 182 (Bradford) Will help transportation network companies (TNCs) by only requiring that drivers get a business license where they LIVE but not where they work. CACTTC opposed the bill and requested a veto, as it was sent to the Governor s desk.
12 AB 1265 (Caballero) Would have authorized the consolidation of the San Benito County Treasurer-Tax Collector office with the Auditor-Controller office. CACTTC opposed the bill and the author held it for the year.
13 AB 292 (Ridley-Thomas) Would have prohibited local governments from taxing streaming videos (Netflix, etc). The measure died in its first committee. CACTTC had no position.
14 SB 242 (Skinner) This measure was sent to the Governor and establishes more significant disclosure requirements in taking out a PACE lien, and includes a confirmed terms call. CACTTC opposed the measure due to the overall weakness of the measure relative to the abuses many TTCs are seeing.
15 AB 1284 (Dababneh) CACTTC supported this measure and suggested amends. This bill will establish a regulatory construct for PACE, administered by the Department of Business Oversight. There will be emergency regulations forthcoming and urgency legislation in January to clean up some provisions. Renovate hired no less than 5 firms to help get the bill which was a late-session play to the Governor.

19 Proposed 2018 Platform
20 Proposal 1 Merced County This proposal will specifically add internet tax sale language into the current code and the reference to commencement and conclusion of the tax sale after the final right of redemption.
21 Proposal 2 Merced County This proposal adds language into the current code to affirm the required notifications to property owners of tax defaulted properties are not in violation of the automatic stay when a property owner files for bankruptcy. Also, provide due process by notifying property tax owners of tax defaulted status that are also in bankruptcy.
22 Proposal 3- Merced County This proposal states that local office consolidations would only be authorized through a vote of the people.
23 Proposal 4 - Humboldt County This proposal will allow County Tax Collectors to collect cannabis cultivation excise taxes on the secure tax roll since cannabis is grown on real property.
24 Proposal 5 - San Bernardino County This proposal will allow agencies access to AA-AAA rated securities that are currently ineligible for purchase due to the originating issuer rating being below the minimum A rating, and also clear up any ambiguity over the application of the five-year tenor limit to securities authorized under this section.
