(Tolko) for an Exemption Pursuant to Section 88(3) of the Utilities Commision Act (UCA) We are legal counsel to Tolko in this matter and write further to the Commission s April 16, 2015 regulatory timetable. That timetable requires Tolko to provide written notification to British Columbia Hydro and Power Authority (BC Hydro), Lavington Pellet Limited Partnership (LPLP), and any other potentially affected parties by Wednesday, April 22, 2015, and to provide the Commission Secretary with a copy of the notification. The notification is to contain a request that the affected parties submit their comments in writing directly to the Commission Secretary by Thursday, April 30, The only potentially affected party beyond BC Hydro and LPLP is CN Rail, who owns land crossed by the LPLP powerline connecting Tolko s substation to LPLP s plant. Tolko previously requested letters of support from those parties and has since received them. They are enclosed. Tolko has also requested that those parties provide copies to directly to the Commission. Copies of those communications are enclosed as well.
