1 SHEET METAL WORKERS NATIONAL PENSION FUND 8403 ARLINGTON BLVD., SUITE 300 FAIRFAX, VA Notice of Benefit Changes for Persons working in Covered Employment with Air System Components signed to a Collective Bargaining Agreement with SMART/SMWIA Local No. #464 October 2013 Introduction As you know from previous communications, the Sheet Metal Workers National Pension Fund ( NPF or Fund ) is in critical status for purposes of ERISA. ERISA is the federal law that governs pension plans like the NPF. As required by ERISA, the Board of Trustees has issued and modified a Rehabilitation Plan that combines benefit reductions and contribution increases that are intended to enable NPF to emerge from critical status within a 13-year Rehabilitation Period. Earlier notices have described much of the information in this Notice, including potential and actual changes to adjustable benefits as defined in ERISA (and other benefit changes and information). For copies of previous communications, including prior notices about benefit changes, the Rehabilitation Plan and Schedules, and other information, go to NPF s website and click on the Rehabilitation Plan section, or contact NPF at info@smwnbf.org or 8403 Arlington Blvd. Suite 300, Fairfax, VA 22031, The Rehabilitation Plan currently includes the following Schedules: the First Alternative Schedule, the Second Alternative Schedule and the Default Schedule. NPF has received notice that Local Union 464 and Air System Components, hereafter referred to as the Bargaining Parties, will not be making the increases required under an Alternative Schedule for employees working under the Local Union 464 Collective Bargaining Agreement. This communication gives you advance notice that your benefits will be reduced as prescribed under the Rehabilitation Plan as described below. This Notice also applies to Beneficiaries and Alternate Payees of Participants described in this Notice. If you do not believe that this Notice applies to you, write to the Fund Office (you may call but we will need written information on, among other things, your work history). Change in the Rate of Accrual for Contribution Hours worked on or after December 1, 2013 and continuing through December 31, 2013 Effective December 1, 2013, all Employees working under the Air System Components signed to a Collective Bargaining Agreement with SMART Local #464 will accrue pension benefits at a lower percentage (referred to as a benefit factor ) than the rate of accrual specified under the First Alternative Schedule and Plan Document. How Benefits accrued before December 1, 2013 The Plan Document, including the Rehabilitation Plan and Schedules, provides the benefit formula or benefit factors used to determine your monthly benefit. The formula takes into account the hours a Participant has worked in Covered Employment (Contribution Hours) and the benefit factor(s) of the total Employer contributions on a Participant s behalf.
2 Under the current First Alternative Schedule, a Participant s benefit factor is 1.5% of contributions made on his/her behalf up to 1,200 hours and.7% on contributions due on hours worked over 1,200. The following illustration shows how a Participant earned a monthly pension benefit for hours worked before December 1, The benefit amount below is the monthly amount payable at Normal Retirement Age (age 65) before applying any optional forms of benefits, such as a Joint and Survivor Annuity option. In addition, the Contribution Hours and Contributions Rates are strictly hypothetical; a Participant s actual hours will vary. EXAMPLE Matthew works 1,750 hours in Covered Employment during a Plan Year under the First Alternative Schedule. Under the terms of the Local Union 464 Collective Bargaining Agreement with Air System Components, your Employer is required to contribute 89 per hour for each hour worked in Covered Employment. The Normal Retirement Pension benefit earned for the 1,750 hours under the First Alternative Schedule is determined as follows: 1,200 hours x 89 = $ 1, $7,152 x 1.5% = $ hours x 89 = $ $3,509 x.7% = $ 3.43 *$ $3.43 = a Normal Retirement Pension benefit - $19.45 Matthew s Normal Retirement Pension under the above formula would have increased by $19.45 per month which is payable at Normal Retirement Age (65). Provided he attains Vested Status and earns sufficient Pension Credit, Matthew could elect to retire on an early retirement pension; however, this amount would be subject to reductions. How Benefits accrue on and after December 1, 2013 through December 31, Because the Bargaining Parties will not be making the increases required under the First Alternative Schedule pension benefits will accrue differently in lower amounts. For all work in Covered Employment on or after December 1, 2013, a Participant will earn a Normal Retirement Pension benefit equal to 1.0% of the contributions made on his behalf. Below find an example of a Normal Retirement Pension benefit calculation for work in Covered Employment after this date. EXAMPLE Jack works 160 hours in Covered Employment in December Under the terms of the Local Union 464 Collective Bargaining Agreement with Air System Components, his Employer is required to contribute 89 per hour for each hour paid. The Normal Retirement Pension benefit earned for the 160 hours is determined as follows: 160 hours x $ 89 x 1% = $1.42 per month Jack s Normal Retirement Pension benefit has increased by $1.42 per month which is payable at Normal Retirement Age (age 65). Provided he attains Vested Status and earns sufficient Pension Credit, Jack could elect to retire on an early retirement pension; however, this amount would be subject to reductions. See below for more information on changes in early retirement subsidies. **NOTE: In 2014, the benefit accrual formula is set to change for all NPF Participants to a Variable Benefit Accrual Rate wherein the rate at which benefits are earned is derived from the Fund s investment returns. A separate announcement about this will be issued later this year. See also the NPF website at and click on the Chairman s column. Adjustment to Early Retirement Pensions and Early Retirement Subsidies These changes apply to all Participants working under the Local Union 464 Collective Bargaining Agreement with Air System Components who retire on or after December 1, Please note that the earliest retirement age for eligible Participants is age 55. This Notice does not mean you are eligible to retire at age 55. You must still satisfy age, service, and other requirements. Page 2
3 In most pension funds like the NPF, the Normal Retirement Age ( NRA ) is 65. If a Participant retires before NRA, his/her pension is actuarially reduced to take into account the fact that benefits will be paid for a longer period. For instance, a person who retires at 55 and lives until age 85 receives 30 years of monthly payments; a person who retires at 65 and lives to age 85 receives 20 years of monthly payments. The NPF provides subsidized early retirement pension benefits, which means that early retirement pensions were not fully reduced to take into account the start of benefits at an earlier age. The difference between the full actuarial reduction and the actual reduction is an early retirement "subsidy." For a Participant who retires under the Local Union 464 Collective Bargaining Agreement with Air System Components on an early retirement pension on or after December 1, 2013, there has been reductions in the early retirement subsidies as described below. Under the First Alternative Schedule, a Participant working under the Local Union 464 Collective Bargaining Agreement with Air System Components had an opportunity to retire under a Standard Early Retirement Pension or a Special Early Retirement Pension. Because the Bargaining Parties will not be making the increases for employees working under the Local Union 464 Collective Bargaining Agreement with Air System Components as required under the First Alternative Schedule both the Standard Early Retirement Pension and the Special Early Retirement Pension are no longer available *NOTE: You may continue to qualify for subsidies at age 62 or older provided you meet certain service requirements. See below for details. In each example described below, any reduction in benefits depends on the number of years and months a Participant is younger than a specified age (e.g., 65 or 62). For Participants who retire on or after December 1, 2013 The Standard Early Retirement Pension is offered under the First Alternative Schedule. Under this type of early retirement pension, a Participant s Normal Retirement Pension benefit is reduced by a percentage age reduction factor for each month an eligible Participant retires before NRA (age 65). The age reduction factors for Standard Early Retirement Pension are 6% per year, from ages This means that if a Participant covered under the First Alternative Schedule retires under the Standard Early Retirement Pension at age 55, his monthly benefit will be 40% of the amount payable at NRA. The Special Early Retirement Pension reduces benefits by a percentage age reduction factor for each month an eligible Participant retires before age 62. If a Participant retires at age 62 1 under this option, there is no reduction for age. Under the First Alternative Schedule, the age reduction factor is currently 6% per year, from This means that if a Participant retires at age 55, his monthly benefit will be 58% of the amount payable at NRA. Because the Bargaining Parties will not be making the increases required under an Alternative Schedule for employees working under this agreement, the Standard Early Retirement Pension and the Special Early Retirement Pension are no longer available to Participants whose Effective Date of Pension is on or after December 1, EXAMPLE Suppose John is 55 years old and is a Participant described in this Notice. John would receive $1,000 a month if he retired with the NPF at Normal Retirement Age (age 65). Before this change, if John had retired at age 55 and qualified for a Special Early Retirement Pension, his monthly pension benefit would have been reduced 42%, to $580. Because the Bargaining Parties will not be making the increase required under the First Alternative Schedule the Special Early Retirement Pension 1 To qualify for a Special Early Retirement Pension, a Participant must work a minimum of 3,500 hours in Covered Employment within the five calendar years prior to the year he/she retires. 4 is no longer available, and John s pension is subject to a full actuarial reduction for age and he will receive a monthly pension of $366. *NOTE: Although subsidies associated with the Standard Early Retirement Pension and the Special Early Retirement Pension have been eliminated, Participants described in this Notice can still receive a benefit equal to their Normal Retirement Pension if he/she retires on or after age 62 and meets all eligibility and service requirements. EXAMPLE Let s say that Matt is 62 years old and is a Participant described in this Notice. In this example, Matt is eligible to receive $1,000 per month at Normal Retirement Age (age 65). Because Matt has worked 3,500 in Covered Employment within the five calendar years prior to the year he retired, and meets other eligibility requirements, he will not be subject to any age reduction and will receive a monthly pension of $1,000. In this example, there has been no change in what he would have received at age 62. The Full Disability Benefit For Participants described in this Notice, a Full Disability Benefit may be available if the Participant is under age 55 when disabled and he/she meets service and other criteria including, but not limited to, a finding by the U.S. Social Security Administration that he/she is eligible to receive Social Security Disability Insurance benefits. For eligible Participants working under the Local Union 464 Collective Bargaining Agreement with Air System Components, the monthly benefit would be subject to a full actuarial reduction for age as if he/she were age 55 on the Effective Date of his/her Full Disability Benefit. Other Changes to Benefits, Rights and Features under the Fund s Plan Document For Participants described in this Notice who retire with an Effective Date, on or after December 1, 2013, the Rehabilitation Plan also eliminates the 60 Certain Payments option found in the Plan Document. This form of payment requires that an eligible Participant earn a minimum of 15 years of Pension Credit and elects either a Lifetime Pension or a 50% Joint and Survivor Annuity option. If this feature was elected and the Participant was to die (under a Lifetime Pension) before receiving 60 monthly payments, or both he and his spouse (under a 50% Joint and Survivor Annuity option) were to die before receiving 60 payments, any remaining payments would be paid to his designated beneficiary until 60 monthly payments had been made. EXAMPLE Suppose this Notice covers Karen. Since Karen has earned a minimum of 15 years of Pension Credit both the Lifetime Pension and 50% Joint and Survivor Annuity option includes a 60 Certain Payment option. Let s say that Karen elects a 50% Joint and Survivor Annuity option and dies having only received 12 pension payments. Under this option, her spouse would be entitled to 50% of her amount for the rest of his life. However, in this example, Karen s spouse dies 6 months later. Prior to this change, her beneficiaries would have been entitled to the remaining payments under the 60 Certain Payment Option. This benefit is no longer available for a pension with an Effective Date on or after December 1, In this example, all payments would stop once Karen s spouse dies. Participants described in this Notice who retire with an Effective Date on or after December 1, 2013, are not eligible for the reversion feature (also referred to as the pop-up ) found in the Plan Document. This adjustable benefit increases an eligible retiree s monthly payment to the Lifetime Pension in the event he elected a Joint and Survivor Annuity option and his spouse pre-deceases him after his NPF retirement. EXAMPLE Suppose this Notice covers Mike. Mike retires with an Effective Date of December 1, Mike is offered a Lifetime Benefit of $1,854 per month; however, he elects a Joint and Survivor Annuity Option of $1,669, which provides a benefit to his spouse upon his death. In this example, Mike s spouse predeceases him. Prior to this change, Mike s pension would increase to $1,854 the month following his spouse s death. Because Page 4
5 Mike retired on or after December 1, 2013, he is not eligible for this adjustable benefit and he will continue to receive $1,669 per month for his lifetime. Information on a Participant s Rights and Remedies Federal law requires that this Notice contain information as to the rights and remedies of Participants and Beneficiaries. Fund Participants have certain rights and protections under the Employee Retirement Income Security Act of 1974 (ERISA), as amended. ERISA provides that all Participants have certain rights, including the following Receive Information about the Pension Fund and Benefits You have the right to: Examine, without charge, at the Fund Office all documents governing NPF. These include the Rehabilitation Plan and Schedules, previous notices issued in connection with the Rehabilitation Plan, the Plan Document and Summary Plan Description, the Annual Funding Notice, periodic actuarial reports and other financial information and summaries, Collective Bargaining Agreements, any application for extension of amortization periods to the Secretary of Treasury and the Secretary s determination on that application, and a copy of the latest annual report (Form 5500 Series) filed by NPF with the U.S. Department of Labor and available at the Public Disclosure Room of the Employee Benefits Security Administration (EBSA) of the U.S. Department of Labor, 200 Constitution Avenue, NW, Suite N-1513, Washington, DC 20210, The Fund s address is listed below and on this letterhead. Obtain, upon written request to the Board of Trustees, copies of documents governing the NPF s operation. These include the Rehabilitation Plan and Schedules, all previous notices issued in connection with the Rehabilitation Plan, the Plan Document and Summary Plan Description, Summary of Material Modifications, the Annual Funding Notice, periodic actuarial reports, and other financial reports, information and summaries, Collective Bargaining Agreements, the latest annual report (Form 5500 Series), any application for extension of amortization periods to the Secretary of Treasury and the Secretary s determination on that application. There may be a reasonable charge for copies. Receive the Annual Funding Notice. This notice provides information regarding the Fund s funding levels, assets and liabilities, number of Participants and a description of the benefits eligible to be guaranteed by the PBGC and an explanation of the limits on the PBGC guarantee and other information. Obtain at no charge, a statement telling you whether you have a right to receive a pension at Normal Retirement Age (age 65) and if so, an estimate of benefits at Normal Retirement Age (age 65) if you stop working under NPF now. If you do not have a right to a pension, the statement will explain why that is. A written request for a statement must be made and the Fund need only provide one statement every 12 months. Obtain at least once every 3 years, a pension benefit statement showing your nonforfeitable accrued benefit provided that an employer maintaining the plan at the time the statement is to be furnished employs you. You may also obtain such a statement upon written request. Note also that if you have filed an application for vesting information with the Fund Office, you can get an estimate of your benefit at Normal Retirement Age (age 65) by going to the NPF website and clicking on the Participant Sign In section. For documents and statements, write to Board of Trustees c/o Marc LeBlanc, Fund Administrator, Sheet Metal Workers National Pension Fund, 8403 Arlington Blvd, Suite 300, Fairfax, VA Prudent Actions by Plan Fiduciaries In addition to creating rights for Participants, ERISA imposes duties upon the people who are responsible for the Page 5
6 operation of the Pension Fund. The people who operate your plan, called fiduciaries, have a duty to do so prudently and in the interest of you and other plan Participants and Beneficiaries. No one, including your employer, your union, or any other person, may fire you or otherwise discriminate against you in any way to prevent you from obtaining a pension benefit or exercising your rights under ERISA. Enforce Your Rights If you make a claim for a pension benefit that is denied or ignored, in whole or in part, you have a right to know why this was done, to obtain copies of documents relating to the decision without charge, and to appeal any denial, all within certain time schedules. Under ERISA, there are steps you can take to enforce the above rights. For instance, if you request a copy of documents or the latest annual report from the Fund and do not receive them within 30 days, you may file suit in a federal court. In such a case, the court may require the plan administrator (Board of Trustees) to provide the materials and pay you up to $110 a day until you receive the materials, unless the materials were not sent because of reasons beyond the control of the administrator. If you have a claim for benefits, which is denied or ignored, in whole or in part, you may file suit in a state or federal court. In addition, if you disagree with the plan's decision, or lack thereof, concerning the qualified status of a domestic relations order or a medical child support order, you may file suit in federal court. If it should happen that plan fiduciaries misuse the plan's money, or if you are discriminated against for asserting your rights, you may seek assistance from the U.S. Department of Labor ( DOL ), or you may file suit in a federal court. If you wish to seek assistance from the DOL, you should contact the DOL s Employee Benefits Security Administration ( EBSA ), which maintains regional and district offices covering your state or territory. You may obtain the contact information for the closest EBSA office (or receive other assistance) by calling, their toll free Hotline at EBSA [3272] (Text Telephone: ). If you contact the DOL, it may be helpful if you have NPF s Employer Identification Number and its Plan Number 001. If you choose to file suit in a federal court, the court will decide who should pay court costs and legal fees. If you are successful, the court may order the person you have sued to pay these costs and fees. If you lose, the court may order you to pay these costs and fees, for example, if it finds your claim is frivolous.
