3 3 Summary of 2012 Legislation HB Modify 2011 Appropriations Act Projected salary increase of 1.2% The 10% salary provision expires on June 30, 2010 Expansion of ORP to SPA employees hired on or after January 1, Revised statute concerning ORP Forfeitures. New language allows the forfeitures to remain with the plan and not be sent to the Retirement System 1% COLA for TSERS retirees

5 5 Summary of 2012 Legislation HB Modify 2011 Appropriations Act Retirement Contribution Rates as of July 1, 2012 ORP ORP Vendor % Retiree Health Plan Reserves 5.30% Disability Income Plan % Total ORP Rate % SB 187 Modifications 2012 Appropriations Act Special Annual Leave Bonus Provides full time permanent employees with one time five days of annual leave credited on July 1, The leave will expire on June 30, 2013 and may not be paid in a lump sum upon termination of employment unless the person effects a retirement from a State supported retirement system immediately upon termination of employment. Part time employees will receive a pro rata amount of the five days.

6 6 Summary of 2012 Legislation HB No Public Retirement for Convicted Felons Prohibits a person who has been convicted of a felony related to employment, or holding office, from receiving retirement benefits from TSERS, LGERS, CJRS, LRS, ORP for the University of North Carolina, the ORP for the Community Colleges, the supplemental retirement income plan for state law enforcement officers and local governmental law-enforcement officers. HB 1085 State Health Plan Statutory Change amends the definition of "dependent child" in order to comply with the affordable care act (this has NO impact on our current practice with dependents) limits enrollment without a qualifying event to the annual enrollment period to comply with IRC Section 125 provisions, repeals the optional program of long-term care benefits (eff. Jan 1, 2013) makes a clarifying change related to coinsurance

7 7 Summary of 2012 Legislation HB 244 State Health Plan Whistle Blower Protection Provides for whistle-blower protections to persons alleging fraud or other misconduct related to the State Health Plan. The bill also allows two charter schools to participate in the State Health Plan HB Stop Waste, Fraud, and Abuse in Govt. Act To provide protection and remedies for reporting violations of retirement law To establish guidelines for fraud investigations that will enhance the department of state treasurer's capability to prevent and to detect fraud, waste, and abuse To make it a Class 1 misdemeanor to fraudulently receive a decedent's monthly disability benefit To clarify the appointment of the medical board

8 8 Summary of 2012 Legislation SB 803 Retirement Administrative Changes Clarifies the role of the Retirement Board of Trustees Clarifies that retirees can have their health premiums deducted from their TSERS pension payments Specifies that retiree health benefits can only be earned at agencies/institutions participating in the State Health Plan that contribute to the Retiree Health Benefit Trust Corrects the 2011 vesting change that prevented conversion from Disability to Disability Retirement based on the 10 year vesting requirement implemented for employees hired on or after August 1, For the purpose of conversion from disability to service retirement, non-contributory creditable service while on disability shall be deemed as membership service for those employees hired on or after August 1, Allow TSERS retirees to volunteer at Educational Attractions (i.e. Museums) please note this provision did NOT make it into the final bill.

9 9 Summary of 2012 Legislation SB 804 Retirement Technical Changes Include actuarial reports in the TSERS Plan Document for IRS compliance Clarifies that creditable service for unused sick leave shall be allowed only for sick leave accrued monthly during employment under a duly adopted sick leave policy Conform statutes to federal laws on Required Minimum Distributions Conform statutes to federal laws on retirement trust funds

10 10 Health Care Updates State Health Plan Retiree Lawsuit (Lake vs. State) Lawsuit pending by retirees against the State Health Plan concerning the premium for the PPO 80/20 Plan. Data is being requested on ORP participants and will be sent to UNC General Administration.
