3 CANADA PENSION PLAN: DISABILITY BENEFITS Program Overview Canada Pension Plan (CPP-D) are only available to those who have made contributions to the plan in previous years. The program is administered through the department of Human Resources and Skills Development Canada. The program is funded by contributions from employees, employers, self-employed people and investment income. The Canada Pension Plan Act governs the program. All employees over the age of 18 who earn a salary contribute to CPP, and do so until one of the following events occur: you stop working, you become disabled, you turn 70, or you pass away. Since it is a program based on your contributions, your eligibility, or entitlement, is not influenced by any of your assets. Qualifying Criteria In order to be eligible for CPP-D, you must be between the ages of 18 and 65 years, meet the definition of disability according to CPP legislation (see below), and have made enough contributions to the program. Specifically, in order to potentially qualify, you must have made contributions to CPP in: 4 of the last 6 years; or 3 of the last 6 years, if you have contributed for more than 25 years. If you have not contributed to CPP for enough years, there are certain provisions which may help you qualify for a CPP disability benefit. For example, exceptions to the contribution rules may be available if there are periods of time when you did not contribute to CPP because you weren t working to raise children, or when you might have been previously collecting CPP-D. In addition, there is a Late Applicant Provision for first-time applicants who have not been working and have not contributed recently to CPP because of an ongoing disability and are late in applying to CPP-D. In order to qualify under the Late Applicant Provision, you must have had enough years of CPP contributions at the onset of your disability and you must have had a continuous disability from that date to the present time. ~ 3 ~

4 Definition of Disability The definition of disability requires certification from your physician that you have a mental or physical disability or illness that is both severe and prolonged. Severe means that you are incapable of regularly pursuing any substantially gainful occupation. Prolonged means the disability is likely to be long-term (at least one year from the time of your application), and of indefinite duration, or is likely to result in death. Waiting Period In order to apply for CPP-D, you must complete and return the CPP application either in person at a Service Canada Centre or by mail to a regional office. The application includes: A basic application of personal information, A questionnaire about your health, education and work history, A consent form, and A medical report completed by your physician. It usually takes a minimum of 4 months for your application to be processed and a decision made. CPP-D applications for someone with a terminal illness (see below) are processed in a much shorter time frame. Once approved, you will be sent a Notice of Entitlement noting the date the benefits start, your monthly entitlement and whether you are eligible for any retroactive payments. With respect to retroactive payments, a person cannot be found to have become disabled earlier than 15 months prior to the date of the application, even if they apply under the Late Applicant Provision described above. ~ 4 ~

5 Terminally Ill Applications A Terminally Ill CPP-D application is now available for patients whose physician has determined their illness to be terminal with a prognosis of less than 12 months. The application includes sections for the patient (or authorized representative) to complete, and the physician s medical form. Both are significantly shorter than the regular application. It is suggested that the physician include any relevant supporting information to help highlight the medical condition and prognosis. Once all parts are completed, the application and supporting information can be faxed to the local Service Canada office by the patient s social worker or other member of their medical team. For a complete file, CPP-D requests that the original be mailed to the appropriate office to keep on file. The typical processing time for the Terminally Ill application is usually within a week, sometimes shorter. Incomplete applications could take longer. Payment Amount The amount you receive is based on a few factors, including your age and the amount and length of time you have contributed to the plan. The average amount paid in 2013 was $882.80/month, and the maximum payment for 2014 is $1,236.35/month. Benefits are taxable, and increase according to the annual cost of living index. CPP will not withhold tax from your benefit cheque unless requested by you. Other Benefits Benefits for a child under 18 years old (or between years if attending school full-time) who has a disabled parent are paid. In 2014, the rate is $230.72/month Return-to-work incentives, such as being able to earn up to $5,200 per calendar year before your benefit is re-assessed (2014 rate) Vocational Rehabilitation Services No medication or dental benefits are available ~ 5 ~

6 Notice Requirements Once you are on CPP-D, you are required to notify Service Canada if: You move (you can move anywhere in Canada; it is important for CPP to have your current address even if your pension is directly deposited); Your condition has improved; You return to work full time; You have reached the maximum allowable earnings in a calendar year for a gradual return to work (for 2014, the maximum earnings is $5,200 gross income); or You have completed a course of training college, university, upgrading or retraining. How/Why the Benefit might end Your benefits will stop if you: Have regained the capacity to work (as assessed and verified by Service Canada), Reach the age of 65 years (at which point the disability benefit converts to a retirement pension), or Pass away. Your file could also be re-assessed to determine your ongoing eligibility for the program in certain circumstances, including the following: If your file has a pre-scheduled file assessment date, If there are third party complaints about your case, If CPP becomes aware of your earning income when reported by Canada Revenue Agency, If CPP becomes aware of your receipt of Employment Insurance Regular benefits from the Employment Insurance Program, If you are referred by CPP s Vocational Rehabilitation service, If you complete a school or training program, or If you voluntarily return to work. ~ 6 ~

7 If you are turned down for CPP-D If the decision is that you are not eligible for a CPP Disability benefit (or if you do not agree with a decision made on your application, such as the amount of the benefit or the date payment begins), you have the right to request a review of the decision. A new appeal system came into effect on April 1, CPP appeals are no longer made to the Office of the Commissioner of Review Tribunals or the Pension Appeals Board. Those two bodies have been replaced by the Social Security Tribunal (SST). There are three opportunities to request a review of your disability application. These must occur in the following order and be filed within the prescribed time frames: A request to Service Canada for a reconsideration, An appeal to the SST - General Division, and An appeal to the SST Appeal Division. The first of these is an internal review of the decision - in other words, Service Canada undertakes a review to ensure they have made the right decision. The other two levels are formal appeal levels administered by bodies separate and independent from Service Canada. New information, especially related to the medical condition, can be included at the first two levels of the appeal process (Reconsideration and General Division). At hearings before the Appeal Division, no new evidence or testimony can be presented, but rather a review of the General Division s decision is made. 9 DECISIONS, DECISIONS Are you over 60 years old and leaving work due to ill health, fatigue or treatment? Should you apply for CPP-Disability or CPP-Retirement? Practical information to help make your decision Imagine this situation you are in your early 60 s and living with cancer. You are thinking of leaving work, and need to secure your finances. One potential source for income replacement is the Canada Pension Plan. But within this Plan there are two options to consider Canada Pension Plan Retirement Pension (CPP-R) and Canada Pension Plan Disability Pension (CPP-D). Here is some practical information to explain the programs and your options to consider. Questions to Ponder: What are the differences between CPP-D and CPP-R? There are things to consider if you are trying to decide which program to apply to. They include: Have you contributed to CPP in four of the last six years to be potentially eligible for CPP-D (or three of the last six years if contributions for greater than 25 years)? Is your illness severe enough and prolonged enough for you to be accepted onto CPP-Disability? You may want to get your physician s opinion about your health in relation to the criteria CPP-D uses to determine disability. CPP-Disability always pays more than CPP-Retirement. Applications for CPP-R will most likely be processed much more quickly than CPP- Disability. Do you want to receive a lesser amount from CPP-R but receive your pension much more quickly? Can you afford to wait the extra time for your CPP-D to be adjudicated and granted? Your CPP-R monthly pension will be reduced by a set percentage for each month before you turn 65 if you take your pension early. From 2012 to 2016, this early pension reduction will gradually increase from 0.5% per month to 0.6% per month (from 6% to 7.2% per year). ~ 9 ~

10 If you take your CPP-R prior to age 65, your monthly entitlement will not increase when you turn 65. If you are under age 65 and are receiving a CPP-R pension and continue to work, you and your employer will be required to continue to contribute to CPP. As you continue to contribute, this will enable your CPP-R benefit rate to increase over time. Program Introductions: Eligibility Criteria Canada Pension Plan Disability Must have made contributions to the CPP Program in 4 of the last 6 years that you worked (some exceptions exist) OR 3 of the last 6 years if you have made contributions for more than 25 years Under the age of 65 Have a certified disability as defined by CPP-D legislation Canada Pension Plan - Retirement Must have made valid contributions to the program Be at least 65 years old, or between years old if you wish to take early CPP-R Do not have to stop working to collect early CPP-R If continue to work between age 60 and 65, it is mandatory that you contribute to CPP If continue to work between 65-70, have option of continuing to make CPP contributions If make contributions between ages 60 and 70 while collecting CPP-R, will receive a Post-Retirement Benefit, in addition to CPP-R benefit (Note: maximum monthly Post- Retirement Benefit for 2014 is $25.96) ~ 10 ~

11 Definition of Disability Canada Pension Plan Disability Under Canada Pension Plan legislation, a defined disability is one that is severe and prolonged. This includes a disability that makes the person incapable of pursing any gainful occupation, and the assessment that the disability is likely to last greater than 12 months or result in death Amount of Payment $1, CPP-D maximum monthly entitlement (2014) $ CPP-D average monthly entitlement (2013) Canada Pension Plan - Retirement There is no disability requirement to apply for CPP-R $1, CPP-R maximum monthly entitlement for recipient over 65 years old (2014) $ CPP-R average monthly entitlement for recipients over 65 years old (2013) $25.96 CPP-R maximum monthly Post-Retirement Benefit (2014) Your CPP-R payment is reduced by a set percentage for each month before you turn 65 if you take your pension early. From 2012 to 2016, this early pension reduction will gradually increase from 0.5% per month to 0.6% per month. Can I apply to both programs? Yes. You can submit applications to both programs, called simultaneous applications. You can send in both applications together, or if sending applications separately you can complete a CPP form letter to both indicating that you are applying to both. Your CPP-R application will also ask if you have applied for other CPP benefits and you can note on this application that you applied to CPP-D. ~ 11 ~

12 It is likely your CPP-R will be granted first. If your CPP-D application is approved at a later date, CPP-D will re-adjust your monthly payment so that you will now receive a regular CPP-D pension, and any retroactive top-up (the difference between CPP-D and CPP-R) will be sent to you. HOWEVER, this only happens if: 1. you have been receiving your CPP-R pension for less than 15 months and 2. your disability is adjudicated to have begun prior to the start date of your CPP-Retirement. If your disability is determined to have started after your CPP-R pension started, your application for CPP-D will not be granted and you will continue to receive CPP-R. Why would I apply to both? There is no penalty for applying to both programs. The main reason to consider two applications is if you want to receive money sooner from CPP-R while waiting to learn if you are considered disabled by CPP-D. Your entitlement will increase if you are granted CPP-D (see note above on condition), but at least you will have a pension coming from CPP-R in the meantime. However, some people may want to apply to CPP-D first, then, if denied, decide if they want to apply to CPP-R or wait until a later time or their 65th birthday to access CPP-R (in order to receive a full pension). The one risk to applying for both CPP-D and CPP-R is that you are taking your CPP-R prior to age 65, and your monthly pension will reduced for every month early that you access your pension. From 2012 to 2016, this early pension reduction will gradually increase from 0.5% per month to 0.6% per month. This means that if you start receiving your CPP pension in 2016, at age 60, your pension amount will be 36% less than it would have been had you waiting and taken it at age 65. If for any reason you change your mind after you start receiving your CPP-R, you can cancel your pension up to six months after it starts. You must request the cancellation in writing. You must also pay back all the benefits you received. If I am turned down for CPP-D, can I apply for CPP-R? Yes. The only thing to remember is that your CPP-R pension is adjusted down for each month that you take your pension prior to age 65, and your CPP-R will not increase when you turn 65. ~ 12 ~

13 If I am on CPP-R and become disabled, can I apply for CPP-D? No. If you are on CPP-R and become disabled, you will not be eligible for CPP-D. Your disability began after the date your CPP-R started. What if I take CPP-R early and decide to continue to work? If you are under age 65 and are receiving a CPP-R pension and continue to work, you and your employer will be required to continue to contribute to CPP. This will enable you to increase your retirement benefits through the receipt of a Post-Retirement benefit. What happens when I turn 65? If you are receiving CPP-D, your benefits will automatically be changed to CPP-R, and your pension will likely decrease to reflect the CPP-R rates. If you are receiving CPP-R, your pension benefit amount will remain the same and will only increase if there is an annual cost of living increase. It is important to consider the intricate program details when accessing the CPP pension program. 14 CANADA PENSION PLAN: DISABILITY AND RETURNING TO WORK The Canada Pension Plan has a number of potential avenues that recipients of CPP-Disability (CPP-D) can access as incentives or supports for returning to work. They include: Starting a work trial Earning $5,200 in a calendar year (2014 figure, might change annually) Participation in the Vocational Rehabilitation Program Work Trial Service Canada will give you three months to explore if you are capable of regular employment. To initiate this process, the CPP-D recipient must contact Service Canada and they will send you an assessment package (it includes a medical form for the physician to complete to assess capacity to work and a self-assessment). The package needs to be returned within three months. During the three month trial, you will continue to receive benefits. At the end of three months, if you are continuing to work, benefits will likely be suspended. Earning $5,200 in a Calendar Year A CPP-D recipient is allowed to work and earn up to the maximum allowable gross earnings for the calendar year ($5,200 for 2014) without a requirement to report earnings from employment and without being reassessed on earnings from employment alone. Once you have earned that amount, you must contact Service Canada. They will then send you an assessment package to determine if you have regained the capacity to work. You will be required to complete an update form and your physician will be required to complete a medical noting your prognosis and present ability to work. Factors considered to assess your work capacity include: Kind of work (compared to previous work) How quickly the $5,200 was earned Medical prognosis ~ 14 ~

15 Once the package is returned, CPP-D will determine if you have regained the capacity to work, or if you are still considered disabled. If you are determined as able to work, your file will be suspended. If you are determined to still be disabled, CPP-D benefits may continue to be paid, even if your income is higher than the maximum allowable earnings. Participation in Vocational Rehabilitation CPP Vocational Rehabilitation is a voluntary program designed to help people receiving CPP-D benefits to return to work. To qualify for CPP vocational rehabilitation, you must be: Medically stable; Considered by a physician to be a suitable participant for a work-related rehabilitation program; Motivated to return to work; Living in Canada; and Selected by the CPP-Disability Vocational Rehabilitation Program. If you are receiving CPP-D and are interested in the Vocational Rehabilitation program, contact Service Canada, and a pre-screening will take place over the telephone (overall health, physician s opinion, vocational goal, number of hours you can work, services needed to return to work). If CPP-D proceeds with an assessment, a telephone interview will be held. The Case Manager will want to determine your skills, abilities, functional limitations, job skills, new skills that are required for working and any new skills acquired while you were off work. Next steps will be a full assessment and you will need to return an updated medical form from your physician (your physician will need to verify that you are medically stable and able to participate in vocational training). You will be matched with a service provider (likely an Employment Specialist or a Vocational Rehabilitation Counsellor) to explore options and establish a return to work plan (work suitability, skills, transferable skills, required upgrading). If you are approved for Vocational Rehabilitation, vocational supports will be offered as part of your approved employment plan, including development of individualized return to work plans, training programs and assistance with job searches. Once you have finished your training program, your CPP-D benefits will continue during a 3 month work trial. Following the work trial, if you are medically stable and able to maintain employment, your CPP-D benefits will be suspended. 16 What if you return to work and your illness recurs? If, within two years of the date your benefit stopped, you cannot continue working because your disability has recurred, you may be eligible for automatic reinstatement. You can request a reinstatement by filling out a simple form confirming that you cannot continue working because your disability has recurred, and asking to have your benefits reinstated. Your doctor must fill out a separate form, confirming that your disability has recurred. You have up to one year from the month you stop working because of your disability to inform Service Canada that you would like your benefits reinstated. Your CPP-D benefits are reinstated starting the month after you become unable to work. If your children are still eligible, their benefits will also be reinstated. The amount of your CPP-D benefit will generally not be less than what you were receiving before your benefits stopped. It will reflect all annual increases and any increases due to additional CPP contributions. If your disability recurs after you ve been working and contributing to the CPP for more than two years, automatic reinstatement will not be available to you. You may, however, be eligible for a fast-track reapplication a simpler and faster process than filing a new application. Fast-track reapplication is available for those who have been working for more than two years but not more than five years after benefits were stopped because of your return to work, and have a recurrence of the same illness to which you were originally granted CPP-D.
