Contribution will be paid by Company only based on the actuarial valuation provided by LIC of India. 4 How are contribution deposited Monthly / Quarterly Company will pay contribution on yearly basis as per LIC valuation. 5 What are the rules for appointment of beneficiary/nominee a) Nomination form should be filed on becoming a member of the fund. b) MEMBER shall appoint his/her spouse, one of his/her child/children or dependents to receive the benefits hereunder in the event of the death of MEMBER. If a MEMBER dies whilst in service or before he has commenced to draw the pension or after he has commenced to draw the pension but before he has received all the guaranteed installments under the pension option elected by him, the TRUSTEES shall hold the benefits in respect of the MEMBER UPON TRUST for payment to the Beneficiary or Beneficiaries as shall have been appointed by the MEMBER in accordance with the remaining paragraphs of this Rule. c) Appointment made under this Rule shall be in writing, signed by the MEMBER and attested by two witnesses and shall be made in Form F. Such appointment shall remain in full force and effect, if accepted by the TRUSTEES, until the death of the Beneficiary or until it is revoked in writing by the MEMBER by whom it was made and a fresh appointment is made in the manner aforesaid and is accepted by the TRUSTEES. d) A MEMBER may from time to time or at anytime, without the consent of the Beneficiary revoke or change the Beneficiary by revising his nomination form and filing the same to the TRUSTEES in Form G. If the new Beneficiary is acceptable to the TRUSTEES under these RULES, acknowledgement of the change and registration of the new Beneficiary shall be given to the MEMBER by the TRUSTEES for attachment to the Certificate. Subject to acceptability under these RULES, the new appointment shall take effect on the date the aforesaid notice was signed whether or not the MEMBER was living on the date of acceptance of the change but without prejudice to the TRUSTEES on account of any payment
2 made before acceptance of the change. e) If a Beneficiary shall at the time of his appointment be a minor or otherwise under disability to give a legal receipt or discharge to the TRUSTEES, the MEMBER must at the time of such appointment as aforesaid, appoint a person of full age who is capable of giving a legal receipt of discharge to the TRUSTEES and to whom the benefits are to be paid for and on behalf of such beneficiary so long as such minority or disability continues. f) If more than one Beneficiary is appointed and in such appointment, the MEMBER has failed to specify their respective interests, the Beneficiaries so named shall share equally. If any designated Beneficiary predeceases the MEMBER the interest of such Beneficiary shall terminate and his share shall be payable equally to such of the remaining Beneficiaries as survive the MEMBER unless the MEMBER has made written request otherwise to the TRUSTEES in the prescribed form. 6 What are the Benefits on Leaving service? The member shall be entitled to the under noted benefits No. of years of completed Gratuity Benefits Less than 1 Year NIL 1 year and above 15 days basic salary for each completed year of service 7 What are the Benefits on Death of the member In the event of death of a MEMBER whilst in the Service of the COMPANY, a gratuity amount equal to 15 days basic salary for each completed year of service, for total service rendered as well as future service to be rendered by employee (till the date of retirement) will be paid by LIC to employee. Future service benefits will be maximum of Rs.4 Lac. 8 Can we take loan against the accumulated funds? No any loan will be allowed against Gratuity benefits, Gratuity is payable only in case of retirement/resignation or death( to nominee). 9 What is the withdrawal process of payment of Gratuity? Gratuity withdrawal Form which is available on Mynd portal should be completely filled in and signed by the employee. Alcatel will pay Gratuity benefits within 30 working days from the date of submission of application by an employee. Filled Form will be sent to Ms. Neetu Yadav at under-mentioned address: Alcatel Lucent India Ltd. Plot No. 406, Fortune Towers, Building No-1, Udyog Vihar, Phase-III, Gurgaon (Haryana)
3 For confirmation of receipt of Form, please raise your query on web portal of Mynd Solutions after 7days of submission of Form to concerned person The Gratuity Application will be submitted with LIC (Fund is administrated by LIC of India, New Delhi ) within week after the required verification by Mynd Solutions. After receipts the Gratuity payment from LIC, Mynd Solutions will release the payment within a week after deduction of tax (if applicable) in favour of employee and courier the same as address provided in application form. 10 What is the Income Tax treatment on payment of Gratuity? Payment of gratuity at the time of leaving the service/at retirement is tax free up to Rs Lac (subject to completion of 5 year service with ALU). In this circumstance, if gratuity amount exceeds Rs Lac then amount over and above Rs Lac will be taxable in the hands of the employee. Payment of Gratuity before completion of 5 year service will always attract tax implication. Payment of gratuity in case of death of the employee will be paid to nominee of the employee and will also attract tax liabilities as per above provisions. 11 What are the forms required for Gratuity benefits?
