Charter reference 801 et seq. SUBTITLE 1. DEFINITIONS; GENERAL PROVISIONS Definitions. In this article, the following words have the meanings indicated. (1) "Annual leave" means paid leave for religious holiday leave, vacation, and other personal uses. (2) "Class" means a position or a group of positions that have similar duties and responsibilities, minimum qualification requirements for education, knowledge, skill, and ability, and a comparable pay rate. (3) "Class series" means multiple classes in an occupational group that are allocated to different pay grades because of differences in their levels of responsibilities and duties. (4) "Compensatory time" means time off instead of monetary payment for overtime work. ANNE ARUNDEL COUNTY, MARYLAND 2

3 (5) "Demotion" means the competitive or non-competitive administrative movement of an employee to a different classification in a lower grade or to a different classification with a lower level of job responsibility as determined by the Personnel Officer. (6) "Disability leave" means paid leave that may be granted to an eligible employee who is unable to pursue the duties of the employee's position because of physical or mental impairment. (7) "Emergency appointment" means an appointment made when an emergency arises and time does not permit compliance with the appointment procedures contained in the Charter. (8) "Holiday leave" means paid leave for full-day or part-day official holidays. (9) "Management, professional, or confidential employee" means a management employee, a professional employee, and a confidential employee as defined in (10) "Master personnel resource list" means a list of candidates identified by proficiency or aptitude testing from which names may be drawn to create eligibility lists. (11) "Overtime" means time worked by an employee in excess of the employee's normal workday. (12) "Position" means a unique group of duties, tasks, and responsibilities allocated to a class in the classification plan. (13) "Priority employment" means the non-competitive administrative placement of an employee or former employee on a certification list for a classification for which the employee or former employee is qualified, at the same or a lower grade, when an employee is disabled according to 808(a) of the Charter, demoted as a result of a reclassification or reallocation, laid off under 810 of the Charter, or on an approved leave without pay for more than 60 days in accordance with (c). (14) "Proficiency advancement" is the reclassification of an occupied position to a higher-level classification within a proficiency class series. The employee in the position to be reclassified must meet the minimum qualifications for the higher-level classification and must have demonstrated the satisfactory performance of higher-level duties and responsibilities as defined under a written departmental plan that has been approved in accordance with Office of Personnel policies and procedures. Proficiency advancements are not automatic and are based on the recommendation of the appointing authority in accordance with Office of Personnel policies and procedures. (15) "Proficiency class series" is a set of classifications that form a natural progression and that have been designated by the appointing authority for proficiency advancement under a written departmental plan that has been approved in accordance with Office of Personnel policies and procedures. (16) "Promotion" means the competitive movement or non-competitive movement through proficiency advancement, reclassification, or reallocation of an employee to a different classification in a higher grade or to a different classification with a higher level of job responsibility as determined by the Personnel Officer. (17) "Prorated" means in proportion to the time worked in the reduced work week. (18) "Reallocation" means a change in the classification plan that revises an established class by changing the pay grade assigned to the class. ANNE ARUNDEL COUNTY, MARYLAND 3

4 (19) "Reclassification" means a change of a position from one class to another class with the same or different pay grade. (20) "Temporary appointment" means an appointment made in the absence of an eligibility list to fill a vacancy or a newly created position in the classified service. (21) "Transfer" means the competitive or non-competitive administrative movement of an employee to a different classification in the same grade, to a different position with the same classification, or to a position on a different pay scale that has the same level of job responsibility as determined by the Personnel Officer. (22) "Uniformed officer" means a full-time classified sworn employee of the Police Department, Fire Department, Sheriff's Office, or Detention Center. (23) "Workday" means the number of hours an employee is normally required to work per day. It is the policy of the County, for the maintenance of business and good government, to assure persons an equal opportunity in receiving employment with the County and in receiving promotions and other personnel action within the County's merit system, that there will be no discrimination on the basis of race, color, religion, sex, disability, ancestry, or national origin. (1985 Code, Art. 8, 1-102) (Bill No ) Hours of work. Unless the nature of the work or the service requires otherwise, all County departments and offices shall remain open for the transaction of business from 8:30 a.m. to 4:00 p.m. Monday through Friday. (1985 Code, Art. 8, 1-103) Powers and duties of Personnel Officer. The Personnel Officer has the following powers and duties: (1) to supplement the minimum qualifications of the classification plan with special requirements for individual positions and consistent with the plan; (2) to substitute an equivalent combination of acceptable education and experience or licensure for the minimum qualifications of the classification plan; (3) to allocate and reallocate all positions to classes of the classification plan, subject to the review by the Personnel Board on appeal by the appointing authority; (4) to recommend to the County Council the creation of new classes and grade changes in existing classes; (5) to administer the classification plan; (6) to create master personnel resource lists; (7) to establish work-related physical agility standards for Police Department, Fire Department, and Detention Center employees; and ANNE ARUNDEL COUNTY, MARYLAND 4

5 (8) to provide for the deduction of monies from an employee's pay on termination for any overpayment made to the employee for leave, pay, or benefits, or for the cost to the County to replace any unreturned equipment or property. (1985 Code, Art. 8, 1-104) (Bill No ; Bill No ; Bill No ; Bill No ; Bill No ) Review of title by Personnel Officer. To maintain the compensation plan in a competitive position with area employers, the Personnel Officer shall conduct a review of the compensation plan once every five years. The review shall include a comprehensive survey of pay and other employee benefit practices of other employers in the appropriate labor markets, and the development of revisions to this title in the compensation plan and related provisions. (1985 Code, Art. 8, 1-105) (Bill No ) Eligibility and certification lists. (a) Generally. (1) Except as provided in subsection (b), the Personnel Officer shall evaluate all timely applications for a position and establish an eligibility list of those applicants who are qualified for the position. (2) The Personnel Officer may remove persons from an eligibility list for good cause, shall determine how long an eligibility list remains in effect, and shall certify from an eligibility list the names of those persons who appear to be the most qualified for the position. (3) An applicant for a position as a Fire Fighter II is entitled to receive preference in hiring if the applicant is certified as having satisfactorily completed the Maryland Fire and Rescue Institute basic firefighting course; is a certified emergency technician; is certified by the Controller as having completed the two consecutive years immediately preceding the date of application for employment as an active volunteer member of the Anne Arundel County Fire Service as defined in of this Code; and successfully completes all components of the selection process. The hiring preference shall not displace any preference or requirement of any lawful selective certification applicable to the selection process for the position of Fire Fighter II. (4) (i) Eligible veteran means a veteran of any branch of the Armed Forces of the United States who has received an honorable discharge or a certificate of satisfactory completion of military service, including the National Guard, the Coast Guard and the Military Reserves. An eligible veteran does not include a person who is employed by the County at the time of application. (ii) An eligible veteran applying for the position of Fire Fighter II, Police Officer, Detention Officer, Deputy Sheriff I, Fire Communications Operator, Sheriff s Communications Operator, or Police Communications Operator I or II who successfully completes all components and lawful requirements of the selection process shall receive preference in hiring. The hiring preference shall not displace any preference provided in subsection (a)(3) of this section. (iii) Except for positions referenced in subsection (a)(4)(ii), an eligible veteran applying for a position in the classified service who meets all the components and lawful ANNE ARUNDEL COUNTY, MARYLAND 5

6 requirements of the position, and meets all the preferences posted for the position that other certified candidates meet, will be interviewed for the position. (5) (i) County resident preference means the criteria established by the Personnel Officer to provide preference in hiring for a County resident. (ii) A County resident applying for the position of Fire Fighter II, Police Officer, Detention Officer, Deputy Sheriff I, Fire Communications Operator, Sheriff s Communications Operator, or Police Communications Operator I or II who successfully completes all components and lawful requirements of the selection process and is among the best qualified candidates shall receive a County resident preference and be certified for the position. The hiring preference shall not displace any preference provided in paragraph (a)(3) of this section. (iii) Except for positions referenced in subparagraph (ii), a County resident applying for a position for initial appointment in the classified service who meets all the components and lawful requirements of the position, and is among the best qualified candidates shall receive County resident preference and be certified for the position. (b) Eligibility list not established. Without the establishment of an eligibility list, the Personnel Officer may certify: (1) the names, in order of seniority, of all persons eligible and currently entitled to priority employment or priority re-employment; or (2) the name of a former employee who was terminated due to an inability to perform the essential functions of the employee's position due to medical restrictions so long as the rehiring occurs within one year of the employee's termination date. (c) Administration. The Personnel Officer shall administer this section in accordance with Office of Personnel policies and procedures. Unless otherwise required by law, each individual in the classified service shall be a probationary employee until the individual satisfactorily completes a probationary period of six months. The appointing authority shall submit to the Personnel Officer notice of the appointing authority's decision to retain or dismiss the employee. An employee dismissed during the probationary period shall be considered permanently separated from the position without the privilege of appeal. At the request of the appointing authority, the Personnel Officer may extend the probationary period for one additional six-month period. (1985 Code, Art. 8, 1-107) (Bill No ; Bill No ) Reclassification of position. When the Personnel Officer has determined that a position in the classified service should be reclassified and the Controller has certified that funds are available, the Personnel Officer shall recommend the reclassification to the Chief Administrative Officer for approval. 7 Layoff rights. (a) Definitions. In this section, the following words have the meanings indicated. (1) "Department or office" means a unit of County government under the authority and supervision of a single appointing authority as that term is defined in 804 of the Charter. (2) "Layoff" means: (i) a termination of an individual from County employment caused by workload reduction, reduced or eliminated appropriations, or abolition of positions in the budget; or (ii) a permanent reduction in the work hours of an employee from full-time to part-time. (3) "Order of layoffs" means the sequence in which employees within an affected classification are terminated from employment. (4) "Recall" means the re-employment of an individual with the County in the same classification held by the employee at the time of the layoff. (5) "Seniority" means an employee's length of continuous service with the County since the employee's last date of hire by the County, unless defined otherwise by a collective bargaining agreement. (6) "Time in grade" means the time that an employee has served in the classification from which the employee is laid-off. (b) Order of layoffs generally. Except as otherwise provided in this subsection, or memorandum of agreement, negotiated and executed in accordance with Title 4: (1) A laid-off employee may displace the least senior employee in the same classification in another department or office. (2) The order of layoffs among uniformed officers in the Detention Center, Sheriff's Office, Police Department, or Fire Department shall be as follows: (i) The employee with the least time in grade occupying the position subject to layoff shall demote to the preceding classification within the rank structure. This process shall be repeated in subordinate classifications as may be necessary to fulfill the requirement for personnel reduction. The employee with the least seniority in the department shall be laid off. (ii) If two or more employees have the same time in grade, demotion shall be governed by seniority. If two or more employees have the same seniority, the order of layoffs shall be determined by the appointing authority on the basis of the relative qualifications, skills, and abilities of the employees. (iii) An employee who displaces another uniformed Detention Center, Sheriff's Office, Fire Department or Police Department employee shall be recalled to a position within the employee's former classification when such a position becomes available. An employee with the most time in grade shall have the first right to be recalled, and an employee with the least time in grade shall have the last right to be recalled. (3) For employees whose job classifications are included in a collective bargaining unit certified under the provisions of Title 4, the order of layoffs shall be governed by the applicable memorandum of agreement. (c) Seniority. For employees not within the representation of a collective bargaining unit, and employees within the representation of a collective bargaining unit for which there is no ANNE ARUNDEL COUNTY, MARYLAND 7

8 current, valid collective bargaining agreement, the order of layoffs shall be governed by seniority. If employees have the same seniority, the order of layoffs shall be determined by the appointing authority on the basis of the relative qualifications, skills, and abilities of the employees. (d) Notice. Unless specified otherwise by a collective bargaining agreement or by law, an employee shall receive at least 15 calendar days' written notice of layoff. (e) Benefits. A laid-off employee shall be paid for all annual and disability leave to which the employee is entitled upon leaving County service under and of this Code, and shall be allowed to continue health coverage under the provisions of the Consolidated Omnibus Budget Reconciliation Act (COBRA) of 1985, 42 U.S.C. 300bb-1 et seq. (f) Recall. Unless specified otherwise by a collective bargaining agreement or by law, a laid-off employee has the right to be recalled to the classification from which the employee was laid off if a position within the classification becomes available within 18 months after the employee was laid off, and if the employee retains the qualifications, skill, and ability to perform the duties of the position. Recall to work shall be in the reverse order of layoff. A laid-off employee shall be placed on eligibility lists for priority re-employment with the County in accordance with 810 of the Charter. (g) Re-employment. A laid-off employee who is re-employed with the County within 18 months of layoff shall be credited with the length of service accrued by the employee at the time of the layoff for purposes of calculating entitlement to annual leave and eligibility for longevity salary increases. (h) Pension plans. A laid-off employee may defer a request for a refund of participant contributions in the applicable pension plan for up to 18 months from the time of layoff. A laid-off employee who is re- employed with the County within 18 months of layoff shall be credited with the service accrued by the employee at the time of the layoff for purposes of pension eligibility if the employee did not receive a refund of participant contributions prior to re-employment. (i) Outplacement program. The Personnel Office shall establish an employee outplacement program to assist laid-off employees with re-employment and benefit counseling and other matters relating to the loss of employment with the County. (j) Rules and regulations. The Personnel Officer may adopt rules and regulations consistent with the express provisions of this section to implement the provisions of this section. (1985 Code, Art. 8, 1-109) (Bill No ; Bill No ; Bill No ; Bill No ; Bill No ; Bill No ) Control of positions. (a) Ordinance required for change in number or classification. Except as provided in subsection (b), the number and classification of positions, including the number of positions in each classification, in an office or department of County government that are approved as part of the annual budget and appropriation ordinance, shall not be changed during a fiscal year except as approved by ordinance of the County Council. (b) Exceptions. The number and classification of positions may be changed during a fiscal year without the approval of the County Council if a change results from: ANNE ARUNDEL COUNTY, MARYLAND 8

9 (1) reclassifying an occupied position pursuant to based on an evaluation by the Personnel Officer of the duties, tasks, and responsibilities performed by the employee in the position or based on a proficiency advancement within a proficiency class series; (2) filling an occupied position so that an incoming employee may be trained to assume a position that is anticipated will become vacant; (3) filling an occupied position within a rank structure when a promotion is anticipated in the Police Department, Fire Department, Detention Center, or Sheriff's Office; (4) creating positions to staff a recruit training academy class for the Police Department, Fire Department, Detention Center, or Sheriff's Office; (5) moving and filling a vacant position in a proficiency classification series from one classification to another within the series; or (6) moving and filling a vacant position to a position that has a lower level of job responsibility to meet a department's recruitment, cost saving, or organizational needs. (1985 Code, Art. 8, 1-110) (Bill No ; Bill No ) Distinguished service awards. (a) Generally. The County Executive may nominate an employee of the County to receive a distinguished service award. To be eligible for an award, an employee must have performed an act of extraordinary heroism in the direct line of duty involving unusual hazard to life and limb. (b) Annual payment. The recipient of a distinguished service award shall receive, in addition to salary, an annual payment of $500. The payment shall be made as of the date of the award and continue each year for life. If the recipient is a uniformed employee, the award shall be signified by an appropriate insignia to be displayed on the left forearm sleeve of the recipient's uniform. The insignia may not be used for any other purpose. (c) Ordinance required. The award may be bestowed only on the passage of an ordinance by the County Council that makes provision for annual payment. (1985 Code, Art. 2, 1-106) Disclosure protection. (a) Definition. In this section, a personnel action means an act, a refusal to act, or an omission by an appointing authority which has a significant adverse impact on the employee or a change in the employee s responsibilities that is inconsistent with the employee s grade and salary. (b) Action by appointing authority. Unless a disclosure is specifically prohibited by law, an employee may not be subject to a personnel action by an appointing authority as a reprisal for seeking any remedy under this section or for a disclosure to a federal, State, or County official or employee that the employee reasonably believes, in good faith, provides evidence of: (1) retaliation for a refusal to obey an instruction of an appointing authority or supervisor involving an illegal act or a refusal to participate in an illegal act; (2) an illegal action in County government; (3) an unauthorized use of County funds; ANNE ARUNDEL COUNTY, MARYLAND 9

10 (4) a substantial and specific danger to public health or safety; or (5) a violation of the County s policy against discrimination and harassment based on gender, age, religion, race, national origin, disability, color, sexual orientation, marital status, genetic information, or veteran status as set forth in the Anne Arundel County Employee Relations Manual. (c) Other action authorized. This section does not prohibit a personnel action that otherwise would have been taken regardless of the disclosure. (d) Grievances. An employee who believes they have been the subject of a personnel action under subsection (b) may file a grievance pursuant to or with the Personnel Board. (e) Disclosures to State officers. An employee has the same protections provided in subsection (b) of this section regarding a disclosure that is specifically prohibited by law, if the disclosure is made to the Office of the State s Attorney, the Office of the Attorney General of Maryland, or the Office of the Maryland State Prosecutor. (f) Other remedies. This section does not preclude the aggrieved employee from seeking any legal action or other remedies available. (Bill No ; Bill No ) SUBTITLE 2. MINIMUM QUALIFICATIONS; PAY Titles; pay grades; work weeks; minimum qualifications. (a) Definitions. In this section, the following words have the meanings indicated. (1) "Extensive experience" means the most advanced degree of experience likely to be found. The work calls for complete mastery and understanding of the subject. This level is generally attained through six or more years of experience in a relevant field of work. (2) "Thorough experience" means almost complete coverage of the subject matter area. The work calls for sufficient comprehension of the subject to solve unusual as well as commonplace work problems. This level is generally attained through four or more years of experience in a relevant field of work. (3) "Considerable experience" implies sufficient knowledge in a field to perform most assigned work with little direct supervision. The work calls for journeyman comprehension of standard work situations. This level is generally gained through two or more years of experience in a relevant field of work. (4) "Experience" means sufficient knowledge of the subject to enable the employee to work effectively in a limited range of work situations. This level is generally attained through one or more years of experience. (5) "Graduation from high school" means receipt of a high school diploma upon the successful completion of high school or upon the award of a G.E.D. diploma by the State of Maryland or other agency approved by the Personnel Officer. (6) "Motor vehicle operator's " means a valid of a certain class from the State of Maryland or from another state that authorizes the person to drive the types of motor vehicles that the Maryland would authorize the person to drive. (7) "Some experience" means sufficient familiarity with the subject to know elementary principals and terminology and to understand simple problems. This level is generally attained through six or more months of experience in a relevant field of work. ANNE ARUNDEL COUNTY, MARYLAND 10

11 (b) Work weeks. Except as provided in subsection (c) or as otherwise provided in a memorandum of agreement negotiated and signed under Title 4 between the County and an exclusive representative, a "B" work week means 40 hours; a "C" work week means hours as required; and a "D" work week means hours as scheduled. (c) Part-time positions. (1) A full-time position in the classified service may be permanently reduced to part-time by ordinance or temporarily reduced to part-time by agreement of an appointing authority and an employee. (2) A part-time position in the classified service is entitled to compensation at a prorated rate in the pay grade provided in subsection (d), and is required to follow the indicated work week as reduced. (d) Title, pay grades, work week, and minimum qualifications. The title, minimum standards, pay grade, and the work week designation that an employee is required to follow for each class within the classified service are as follows: (1) Accounting, Auditing, and Budgeting (AC).
